Etude numérique des corrections d'échelle au comportement dominant à l'équilibre et hors de l'équilibre

La première partie a pour sujet le comportement à l'équilibre du modèle d'Ising pour d>4. Dans un premier temps, nous étudions le comportement thermique dans le cadre du comportement d'échelle étendu. Par interpolation de données numériques en dimensions cinq à huit, nous obtenons un développement décrivant la susceptibilité dans toute la phase haute température. Dans un second temps, nous étudions les effets de taille finie. Les résultats numériques obtenus pour le modèle d'Ising 5d sont compatibles avec une croissance anormale de la longueur de corrélation pour des conditions de bords libres. La seconde partie a pour sujet le vieillissement dans les systèmes de spins 2d complètement frustrés. Dans un premier temps, nous étudions le vieillissement du modèle d'Ising complètement frustré 2d lors d'une trempe depuis la phase haute température jusqu'à la température critique. La présence de défauts topologiques, comme pour le modèle XY, se manifeste par des corrections logarithmiques lors de la croissance de la longueur caractéristique. Dans un second temps, nous étudions le vieillissement du modèle XY complètement frustré 2d. Lors d'une trempe depuis l'état fondamental jusque dans la ligne critique, le vieillissement des spins est bien décrit par les ondes de spins. Lors d'une trempe depuis la phase haute température jusqu'à la température BKT pour les spins et jusqu'à la température de brisure de symétrie de la chiralité, nous estimons les grandeurs universelles des deux variables. Les résultats pour la chiralité sont incompatibles avec la classe d'universalité du modèle d'Ising 2d. Des corrections logarithmiques sont également présentes.

「天有不測風雲,人有旦夕禍福」,生活中往往有不可預測的變故發生,而使社經環境波動、人之資力與其他履約相關能力受到影響。另一方面,貿易全球化、工商業分工專業化,以及電子商務的崛起等,均使交易型態日趨複雜;在契約當事人的有限理性下,欲以契約窮盡規範工商業上所有可能事態,實屬不易。履約環境若如契約締結時當事人之預想,且兩造亦依契約規定確實履行,自是最佳;惟契約之締結與履約行為若非同時發生,在時間上存在間隔而使履約環境暴露於變動風險中,而當事人締約時未加以規範,或有規範但程度超乎預期之變故發生,將可能導致一方當事人難依原契約履行,或依原契約履行已無意義。   在傳統私法自治、契約嚴守的概念下,即便遭遇前揭無法預測或預測不完全之變故,仍應依契約履行,而無法律介入之餘地。但毫無彈性的強制履行契約,不論就公平角度,抑或經濟效率而言,對當事人與社會或非妥適;因此,多數國家均將處理情事變更之制度納入法律體系中,以期獲致一較理想之結果。   本文首就我國情事變更原則之演進暨學說見解作一整理,並以現行情事變更原則(民法第二百二十七條之二)與我國民法中近似之概念(如不可抗力、動機錯誤),以及同樣處理「法律行為成立後之情事變更」相關民法法條(如不動產租金因價值升降之增減請求權)互為比較。第三章比較法部分,則以德國「法律行為基礎理論」、美國「履行不能、履行艱難、目的受挫」等規定為標的,敘述其演進及要件,並就其要件及效果與我國情事變更原則比較。第四章以我國近五年最高法院判決為本,依民法二百二十七條之二諸要件,分點探討最高法院與我國學說間見解之異同,並特就「非當時所得預料」及「顯失公平」兩點,觀察最高法院就此之評價方式。第五章則以對我國學說與實務之建議,作為本文之結論。 / Accidents happen from time to time and may seriously change the social and economic environment and affect people’s condition, including their ability to fulfill the contractual duties. At the same time, globalization, professionalization of services and eCommerce all make trades much more complicated than ever. As a result, under bounded rationality as well as finite contract clauses, using contracts to govern almost unlimited possibilities seems like asking for the impossible. The best case for the contractual parties is no unpredictable event happens after the constitution of the contracts; however, if a time gap exists between the entering into and the performing in full of a contract, there can be accidents which lead to the impossibility / impracticability for a party to fulfill the contractual duty, or the performance of a contract becomes meaningless (frustration of purpose). Under the principles of autonomy of private law and strict performance of a contract, there shall be no relief for a party which encounters the foregoing situations of impossibility, impracticability and the frustration of purpose. However, from a fair point of view, asking one party to bear all the disadvantage resulting from an unforeseen event and perform all its duties disregarding the cost may not be the best answer; therefore, in order to introduce more flexibility for the jurisdiction and the contractual parties, countries all over the world gradually adopt the principle of change of circumstances (and similar regulations) which may help to achieve an acceptable result. In this thesis, the principle of change of circumstances in our civil law will firstly be discussed, including its development as well as the elements and effects set forth in Article 227-2; then, two comparisons “(1) between Article 227-2 and similar concepts (force majeure, mistake...)” and “(2) between Article 227-2 and other Articles in our civil law dealing with the events occurring after the establishment of legal relations” will be conducted. In chapter three, the analysis of the regulation in Germany and the United States regarding change of circumstances is carried out. A historical German law review precedes the discussion of current BGB §313 “Störung der Geschäftsgrundlage”, and a comparison between Taiwanese and German regulation is given. After that, the United States’ regulations regarding the doctrine of impossibility, impracticability, and frustration of purpose are discussed in the same manner. At last, a summary comparison among the three countries is served as the conclusion of this chapter. In Chapter four, our Supreme Court’s 162 verdicts from year 2009 to 2013 are analyzed by the elements of Article 227-2, which are: (1)after the constitution of the contract; (2)changing of circumstances happens; (3) such change of circumstances is not predictable; (4)the performance of the original obligation will become obviously unfair; (5) by the party’s application, the court may increase or reduce his payment, or alter the original obligation.At the end, few suggestions for future legislation and Supreme Court’s application of Article 227-2 are given as the conclusion of this thesis.

Learners' aggressive behaviour in secondary school: a psycho-social perspective

This study was undertaken to determine the extent of aggressive behaviour exhibited by secondary school learners. Many factors were considered when investigating the problem of aggressive behaviour. The problem was traced from the theorists' perspectives and factors related to the family, school and community. An extensive literature review showed that the above factors contribute to aggressive behaviour among adolescents. In order to support or reject the findings of the literature study, quantitative (questionnaire) research and qualitative research (interviews) were conducted. The results of the quantitative research concerning learners' aggressive behaviour in secondary schools were analysed and interpreted while at the same time a deeper understanding of aggressive behaviour was revealed through qualitative research. The results of the empirical research indicated that the more negative the family climate, school climate, community climate or influence of friends are, or the more negative the emotional self-concept of the adolescent is, the more aggressive the adolescent is, and vice versa. Doodvonnis in Suid-Afrika : dinamiek van nie-teregstelling en afskaffing

Text in Afrikaans / Executions were discontinued during November 1989. In February 1990 the State President announced a moratorium on executions. Since 27 July 1990 the Criminal Law Amendment Act, 1990 effected important changes to the substantive law and procedure regarding the death sentence. The "new" death sentence dispensation was applied by the courts and the moratorium would be lifted as soon as the new dispensation became effective. That never materialised. The death sentence issue was dealt with in a game of political compromise. Criminal law and the esteem of the Government suffered as a result. Judicial frustration and uncertainty developed regarding application of the death sentence. The opportunity was seized by the abolitionists to attain their ideal. The Constitutional Court declared the death sentence unconstitutional. Presently a final Constitution is being drafted which will probably finally do away with the death sentence. An effective process of denigration of the death sentence thus resulted from the moratorium on executions. / Teregstellings is gedurende November 1989 gestaak. Die Konstitusionele Hof het die doodvonnis ongrondwetlik verklaar. Tans word 'n finale Grondwet geskryf wat waarskynlik die doodvonnis gaan afskaf. Meaning in work : the development, implementation and evaluation of a logotherapy intervention in a higher education institution

Over the past five decades, universities across the globe have been subjected to powerful forces of change that have impacted their definition, governance and funding structures, and managerial practices. In South Africa, the reform process was amplified by the country’s apartheid legacy and the political and socio-economic realities. Consequently, the transformation has resulted in the corporatisation of universities and the re-engineering of the academic profession into a managed profession that brought about a changed work environment with less secure conditions of employment, more expectations and increased work pressure, with diminished autonomy. The changed and changing South African higher education environment has had and continues to have its effects on academic employees’ well-being, health and morale. Limited research has investigated the sense of purpose and meaning and psychological health of academic employees. Moreover, there is an absence of empirical studies that have reported on the development and evaluation of a brief group-based meaning-centred intervention that focuses on both the sense of purpose and meaning, and psychological health of academic employees. The primary aim of the study was to first explore the meaning and/or meaning frustration embedded in the academic employee experience, in order to develop and empirically assess a brief group-based meaning-centred intervention in a higher education setting. The intervention was articulated from a logotherapy perspective of Viktor Frankl’s system of psychotherapy. An intervention mixed methods design, consisting of four interdependent phases, was used to pursue the aim of the study. The phase one qualitative single case study was used to explore and describe the sense of meaning and/or meaning frustration embedded in academic employees’ experiences. This was used as a means of developing and supporting the intervention that was implemented in the phase three quantitative quasi- experimental single-group pre/post test study. Phase two was thus an applied phase where the intentional mixing of the qualitative and quantitative phases took place. Likewise, phase four was an applied phase since it was used to draw conclusions based on the integration of the phase one findings and the phase three results. The results of the quantitative study indicated that the majority of academic employees who participated in the study had a sense of definite purpose and meaning (MPIL-post = 114.59, SDPIL-post = 18.04) and psychological health, despite the changed and changing HE landscape. The main finding suggests that a logotherapy brief group-based intervention, with a strong cognitive restructuring component, may have a positive impact on the sense of purpose and meaning of academic employees, whilst reducing the presence of symptoms of depression, post traumatic stress, binge eating and panic. The experience of purpose and meaning in work, and adaptive psychological coping, was related to academic employees’ sense of making a difference in students’ development, the appreciation they have received from students, their freedom of choice, their view of work as a calling, the unique benefits of working in HE, meaning beyond the meaning in the moment (ultimate meaning) and making a difference in colleagues’ (staffs’) lives. Llimitations in the study are noted and recommendations are made to formalise existential analysis as a research method of meaning informed organisational assessment. / Psychology / Ph. D. Microscopic description of magnetic model compounds

Solid state physics comprises many interesting physical phenomena driven by the complex interplay of the crystal structure, magnetic and orbital degrees of freedom, quantum fluctuations and correlation. The discovery of materials which exhibit exotic phenomena like low dimensional magnetism, superconductivity, thermoelectricity or multiferroic behavior leads to various applications which even directly influence our daily live. For such technical applications and the purposive modification of materials, the understanding of the underlying mechanisms in solids is a precondition. Nowadays DFT based band structure programs become broadly available with the possibility to calculate systems with several hundreds of atoms in reasonable time scales and high accuracy using standard computers due to the rapid technical and conceptional development in the last decades. These improvements allow to study physical properties of solids from their crystal structure and support the search for underlying mechanisms of different phenomena from microscopic grounds. This thesis focuses on the theoretical description of low dimensional magnets and intermetallic compounds. We combine DFT based electronic structure and model calculations to develop the magnetic properties of the compounds from microscopic grounds. The developed, intuitive pictures were challenged by model simulations with various experiments, probing microscopic and macroscopic properties, such as thermodynamic measurements, high field magnetization, nuclear magnetic resonance or electron spin resonance experiments. This combined approach allows to investigate the close interplay of the crystal structure and the magnetic properties of complex materials in close collaboration with experimentalists. In turn, the systematic variation of intrinsic parameters by substitution or of extrinsic factors, like magnetic field, temperature or pressure is an efficient way to probe the derived models. Especially pressure allows a continuous change of the crystal structure on a rather large energy scale without the chemical complexity of substitution, thus being an ideal tool to consistently alter the electronic structure in a controlled way. Our theoretical results not only provide reliable descriptions of real materials, exhibiting disorder, partial site occupation and/or strong correlations, but also predict fascinating phenomena upon extreme conditions. In parts this theoretical predictions were already confirmed by own experiments on large scale facilities. Whereas in the first part of this work the main purpose was to develop reliable magnetic models of low dimensional magnets, in the second part we unraveled the underlying mechanism for different phase transitions upon pressure. In more detail, the first part of this thesis is focused on the magnetic ground states of spin 1/2 transition metal compounds which show fascinating phase diagrams with many unusual ground states, including various types of magnetic order, like helical states exhibiting different pitch angles, driven by the intimate interplay of structural details and quantum fluctuations. The exact arrangement and the connection of the magnetically active building blocks within these materials determine the hybridization, orbital occupation, and orbital orientation, this way altering the exchange paths and strengths of magnetic interaction within the system and consequently being crucial for the formation of the respective ground states. The spin 1/2 transition metal compounds, which have been investigated in this work, illustrate the great variety of exciting phenomena fueling the huge interest in this class of materials. We focused on cuprates with magnetically active CuO4 plaquettes, mainly arranged into edge sharing geometries. The influence of structural peculiarities, as distortion, folding, changed bonding angles, substitution or exchanged ligands has been studied with respect to their relevance for the magnetic ground state. Besides the detailed description of the magnetic ground states of selected compounds, we attempted to unravel the origin for the formation of a particular magnetic ground state by deriving general trends and relations for this class of compounds. The details of the treatment of the correlation and influence of structural peculiarities like distortion or the bond angles are evaluated carefully. In the second part of this work we presented the results of joint theoretical and experimental studies for intermetallic compounds, all exhibiting an isostructural phase transition upon pressure. Many different driving forces for such phase transitions are known like quantum fluctuations, valence instabilities or magnetic ordering. The combination of extensive computational studies and high pressure XRD, XAS and XMCD experiments using synchrotron radiation reveals completely different underlying mechanism for the onset of the phase transitions in YCo5, SrFe2As2 and EuPd3Bx. This thesis demonstrates on a series of complex compounds that the combination of ab-initio electronic structure calculations with numerical simulations and with various experimental techniques is an extremely powerful tool for a successful description of the intriguing quantum phenomena in solids. This approach is able to reduce the complex behavior of real materials to simple but appropriate models, this way providing a deep understanding for the underlying mechanisms and an intuitive picture for many phenomena. In addition, the close interaction of theory and experiment stimulates the improvement and refinement of the methods in both areas, pioneering the grounds for more and more precise descriptions. Further pushing the limits of these mighty techniques will not only be a precondition for the success of fundamental research at the frontier between physics and chemistry, but also enables an advanced material design on computational grounds.

Le changement de comportement correspond à une situation dans laquelle, pendant l’exécution du contrat, le créancier adopte une attitude contraire au contenu de l’accord originel, pour ensuite exiger l’application de ce dernier. Confronté aux règles classiques du droit des contrats (intangibilité, consideration), cette volte-face ne devrait avoir aucune force juridique. Malgré cela, en interdisant au créancier de réclamer l’exécution de l’accord initial, les juges français et anglais introduisent cette situation dans la sphère juridique.Comme l’imprévision, le changement de comportement bouleverse l’exécution du contrat ; comme la bonne foi, il est fondé sur la morale ; comme l’abus de droit, il sanctionne l’inconstance ; comme l’apparence, il est à la frontière entre le fait et le droit. Il se singularise pourtant, car il ne se confond avec aucune autre insitution juridique. Par ailleurs distinct de la confiance légitime et de l’interdiction de se contredire auxquelles il est rattaché, il est en quête d’un régime juridique propre. Une construction s’impose alors. Elle est facilitée par le miroir de la comparaison des droits français et anglais.Le changement de comportement révèle une renonciation du créancier à la créance, rendue possible par les prérogatives contractuelles qu’il tient, elles-mêmes autorisées par sa propriété sur la créance ou le renforcement de sa titularité. L’efficacité de cette appréhension flexible du contenu contractuel requiert cependant l’anéantissement d’éventuels remparts procéduraux : l’interdiction du changement ne doit alors plus seulement être un moyen de défense contre la contradiction, mais exprimer un comportement juridiquement contraignant. / The change of behaviour refers to a situation in which, during the performance stage of the contract, the promisor behaves in a manner which is contrary to the existing contractual rights, but later neverthless insists on their application. Faced with the classic rules of contract law (sanctity of contracts, consideration), this volte-face should have no legal force. Yet, by prohibiting the promisor’s demand to perform the original agreement, French and English judges nevertheless introduce this situation in the law of contracts.Like frustration, the change of behaviour disrupts the performance of the contract ; like good faith and Equity, it is based on morality ; like an abuse of right, it punishes inconsistency ; like the theory of « apparence », it is in between facts and law. In spite of this, the change of behaviour stands out ; as it does not share the exact same scope as the expectations theory or the inconsistent behaviour theory, no other legal theory can wholly translate it into the law of the contracts. The change of behaviour therefore needs its proper legal framework which must consequently be found. The search is helped by the prism of comparative law, between French and Englis laws.The change of behaviour reveals a waiver of the promisor’s debt. The waiver is made possible by the contractual prerogatives he holds, prerogatives which are justified by the ownership of the debt. The efficiency of this flexible understanding of contractual content requires the obliteration of any litigation shield. As a consequence, forbidding the change should not only be seen as a defense against inconsistency, but should highlight a legally binding behaviour.

Evaluating Improvisation As A Technique For Training Pre-service Teachers For Inclusive Classrooms

Improvisation is a construct that uses a set of minimal heuristic guidelines to create a highly flexible scaffold that fosters extemporaneous communication. Scholars from diverse domains: such as psychology, business, negotiation, and education have suggested its use as a method for preparing professionals to manage complexity and think on their feet. A review of the literature revealed that while there is substantial theoretical scholarship on using improvisation in diverse domains, little research has verified these assertions. This dissertation evaluated whether improvisation, a specific type of dramatic technique, was effective for training pre-service teachers in specific characteristics of teacher-child classroom interaction, communication and affective skills development. It measured the strength and direction of any potential changes such training might effect on pre-service teacher’s self-efficacy for teaching and for implementing the communication skills common to improvisation and teaching while interacting with student in an inclusive classroom setting. A review of the literature on teacher self-efficacy and improvisation clarified and defined key terms, and illustrated relevant studies. This study utilized a mixed-method research design based on instructional design and development research. Matched pairs ttests were used to analyze the self-efficacy and training skills survey data and pre-service teacher reflections and interview transcripts were used to triangulate the qualitative data. Results of the t-tests showed a significant difference in participants’ self-efficacy for teaching measured before and after the improvisation training. A significant difference in means was also measured in participants’ aptitude for improvisation strategies and for self-efficacy for their implementation pre-/post- training. Qualitative results from pre-service teacher class iv artifacts and interviews showed participants reported beneficial personal outcomes as well as confirmed using skills from the training while interacting with students. Many of the qualitative themes parallel individual question items on the teacher self-efficacy TSES scale as well as the improvisation self-efficacy scale CSAI. The self-reported changes in affective behavior such as increased self-confidence and ability to foster positive interaction with students are illustrative of changes in teacher agency. Self-reports of being able to better understand student perspectives demonstrate a change in participant ability to empathize with students. Participants who worked with both typically developing students as well as with students with disabilities reported utilizing improvisation strategies such as Yes, and…, mirroring emotions and body language, vocal prosody and establishing a narrative relationship to put the students at ease, establish a positive learning environment, encourage student contributions and foster teachable moments. The improvisation strategies showed specific benefit for participants working with nonverbal students or who had commutation difficulties, by providing the pre-service teachers with strategies for using body language, emotional mirroring, vocal prosody and acceptance to foster interaction and communication with the student. Results from this investigation appear to substantiate the benefit of using improvisation training as part of a pre-service teacher methods course for preparing teachers for inclusive elementary classrooms. Replication of the study is encouraged with teachers of differing populations to confirm and extend results.
