Because women are predominantly responsible for childcare, men are the primary income
earners. Having acquired the marital assets, on divorce the husband would retain them in a
marriage out of community of property. The wife would be left deskilled, financially
dependent, with little likelihood of receiving spousal maintenance and with no marital assets.
In 1984 the Matrimonial Property Act and in 1988 the Matrimonial Property Law Amendment
Act introduced a judicial discretion to equitably redistribute marital assets in certain
marriages out of community. This dissertation argues that the bases for the limitation of the
judicial discretion to women married before a certain date are unsound and that the limitation

Sex and the city : gender gaps in labor markets and economic geography / Le rôle des villes dans la discrimination des femmes sur le marché du travailNawaz, Shamaila 19 October 2012 (has links)
Cette thèse explore la dimension géographique des disparités entre les sexes dans le marché du travail. Les questions étudiées incluent la variation de la prime salariale urbaine entre les sexes (chapitre deux), l'exploration des différents mécanismes derrière les effets importants de la localisation géographique sur les gains du marché du travail des femmes (chapitre trois), et de l'écart entre les sexes sur les rendements d'expérience urbains (chapitre quatre). Le deuxième chapitre entreprend une analyse transversale à l'aide de données françaises pour estimer la prime salariale urbaine et sa variation entre les sexes. Les résultats confirment l'existence d'une prime salariale urbaine nettement supérieure pour les femmes. Un doublement de la densité de l'emploi dans une zone donnée entraîne une réduction de 2,4 pourcent de l'écart salarial entre les sexes, une valeur qui augmente de 4 pourcent lorsqu'on exclut la catégorie professionnelle des ouvriers. Contrairement au reste des professions, l'effet de la densité favorise les hommes dans la catégorie des ouvriers. Le troisième chapitre cherche à trouver les mécanismes à l'origine de l'effet importante de la localisation géographique sur les gains du marché du travail pour les femmes en employant l'approche par l'estimateur « within ». Les résultats suggèrent que la moitié de la prime salariale urbaine est attribuée sur la base d'un tri des travailleurs selon le type de compétences à travers des différentes zones. Cependant, en complément du tri de compétences, d'autres hétérogénéités individuelles contribuent également à l'excès de la prime salariale urbaine pour les femmes. / This dissertation explores the geographical dimension of the gender gaps in the labor market. The investigated issues include the variation of urban wage premium across genders (chapter two), exploration of different mechanisms behind stronger location effects for females' labor market gains (chapter three), and the gender gap in the urban returns to experience (chapter four). The second chapter undertakes a cross-sectional analysis by using French data to estimate the urban wage premium and its variation across genders. The findings confirm the existence of an urban wage premium that is significantly higher for women. A twofold increase in employment density of an area results in a 2.4 percent reduction in the gender wage gap, which increases to 4 percent when we exclude manual workers occupational category. Contrary to the rest of the occupations, the density effect favors men in the manual workers category. The third chapter seeks to find the mechanisms behind the stronger location effects on labor market gains for women by employing the within estimate approach. Results suggest that half of the urban wage premium is contributed by the sorting of workers according to skill type across different areas. However, in addition to skill sorting other individual heterogeneities also contribute to the excess urban wage premium for females. Firm level agglomeration effects attribute a minor part to the excess urban wage premium for females. The left over premium is a result of pure urban effects (lower discrimination, better matching, urban amenities).

台灣五大會計師事務所女性審計人員升遷問題之研究 / A Study of Upward Mobility of Female Auditors in Big 5 Public Accounting石倉安, Shi, Tsang-An Unknown Date (has links)
台灣五大會計師事務所審計部門的從業人員長久以來一直是女性多於男性,每年新進的人員亦以女性居多,然而在高階職位上卻是男性遠多於女性。換言之,若女性審計人員在事務所裡沒有遭受任何升遷上的障礙,以每年新進人員女性多於男性的情況比例計算,在高階職位上女性的人數亦應多於男性,然而真實的情況卻正好相反。故本研究參考之前研究者的研究發現,彙總出台灣五大會計師事務所女性審計人員可能面臨到的升遷障礙,包括性別歧視、性騷擾、家庭與工作衝突和缺乏良師益友(mentor)等,以問卷調查方式蒐集實證資料,並進行統計分析。另外,本研究詢問研究對象所知的審計人員離職原因以及五大會計師事務所現行的工作場所家庭政策,以了解男性與女性審計人員在離職原因上有無差異和事務所提供的家庭福利政策,得到的結果如下:
1.性別歧視:不管從性別、職位和事務所別的角度來看,受試者均趨向於不同意女性審計人員遭受到性別歧視;而在參加選修課程與社交活動的情形上,男性與女性亦沒有顯著的差異。
2.性騷擾:曾經遭受性騷擾的受試者雖然皆為女性,然而僅有12位,比例為8.43%,比之前的研究低許多。
3.工作與家庭衝突:已婚女性比已婚男性感受到較大的衝突程度,而且家中若有生活無法自理、需要特別照顧的家人或小孩的女性,其衝突程度會比沒有需要特別照顧的家人或小孩的女性來得高。反觀已婚的男性受試者,不管家中有無需要特別照顧的家人或小孩,其工作與家庭衝突的程度並沒有顯著的差異。
4.女性缺乏mentor:女性擁有mentor的比例與男性相同;相同職位的男性與女性擁有mentor的比例亦相似。而且深入分析後發現,女性與男性的mentor,在職位上的差異不大,且擁有mentor的女性受試者,對mentor所能提供協助的同意程度,與男性受試者差異不大。
5.離職原因:女性因為「結婚生子」而離職排名第4,為其主要離職原因,男性則否。衡量性別歧視的「升遷機會受限」,則非男女審計人員的主要離職原因。
6.工作場所家庭政策:五大會計師事務所皆有提供產假與留職停薪這兩項福利政策,然而,較具彈性的「半職(part-time)」只有兩個事務所提供;「彈性上班時間」只有一個事務所提供,顯示目前五大事務所的工作場所家庭政策仍不夠多元。
綜上所述,本研究所探討的四個女性升遷障礙:性別歧視、性騷擾、工作與家庭衝突和缺乏mentor等,僅有工作與家庭衝突得到支持。因此在沒有進一步地證據支持另外三項升遷障礙前,工作與家庭衝突似乎是目前五大會計師事務所女性審計人員所共同面臨到的升遷問題,故會計師事務所管理當局應提供更多元的工作場所家庭政策,以降低女性審計人員的工作與家庭衝突。

In order to gain a better understanding of the position of women in the field of policing, it was necessary to study the attitudes of the policewomen, which presently exist with regard to the role of the woman in the South African Police Service. Although some studies have been done on policewomen world-wide, none have been done in the rural areas of the Vaalrand and this is where the research took place. Only women formed part of this survey. Detailed questions were asked concerning their role in policing.
This was an empirical qualitative study. The research procedures as stipulated for a descriptive study were followed, as the main objective of the research was to describe the circumstances of women in the predominantly male environment of policing. A survey interview was drawn up, containing semi-structured in-depth questions regarding their recruitment, motivation for joining and job-related satisfaction and other issues including discrimination and domination by men. Qualitative methods were applied not only for data collection but also for data analysis. The coding consisted of conceptualising the raw data. Open coding was used in this qualitative research. The researcher read through all the collected data and then assigned initial codes to condense the mass of data collected.
The following main issues were found: that discrimination still exists in the SAPS, as well as resentment, a lack of recognition, misunderstanding and unfulfilled challenges which relate to conflict being experienced. These respondents have aspirations in their work and aspire to better positions in the SAPS, as there have been major contributions by women in the police. They have also had an impact on policing, as they have become major role players in the field where victims are concerned.
The presence of policewomen in the SAPS is an important asset to modern law enforcement and their present day role in policing should be explored and expanded. Qualified women could also be utilised in important staff service units such as planning and research, training, intelligence, inspection, public information, community relations, and as legal advisors instead of being utilised only in administrative work.

A surge of "masculinity in crisis" discourse suggests that men are primarily responsible for lawlessness, social mayhem, violence and other forms of psycho- and socio-pathology. This crisis is attributed, in part, to hegemonic models of masculinity which restrict men to certain modes of behaviour and specific roles in society. This study investigates the content of a group of South African adolescent males' cognitive schemata for masculinity and gender roles. A qualitative mode of enquiry was used to identify the beliefs held by participants about manhood and gender roles. The findings of this study affirm that a hegemonic model of masculinity exists is the sub-culture of South African society represented by the participants and suggests that hegemonic masculinity in South African is both restrictive and damaging to men and society. / Psychology / M. One of the principal objectives of equal opportunity plans for women and men is the reduction of gender gaps in accordance with the constitutional mandate of the right to equality and non-discrimination by sex. However, based on an analysis of seventeen regional plans between 2006 and 2010 we came to realize that the majority of such plans do not include elements that ensure their implementation in their design, and are therefore not actually capable of facilitating the reduction of gender gaps at the regional level. / Uno de los principales objetivos de los planes de igualdad de oportunidades entre mujeres y hombres es la reducción de las brechas de género, ello de conformidad con el mandato constitucional del derecho a la igualdad y el principio de no discriminación por sexo. She endures in time, in different areas, in different ways and also excludes or diminishes women in the labor market. Despite this have more years of education than men and have professional skills needed to perform the duties or function that aims remains sidelined,
particularly in the private sector in its various segments, at all stages of the bond employment, from selection and recruitment even after the termination of the
contract. A woman receives lower wages than men for the same work performed under the same conditions, have less opportunity to rise and career, and when the
mass layoff, becomes a priority. On the other hand, never the legal framework, including the internal standards possessed so protective of women, public policy,
backed by the phenomenon of constitutionalization of the principles of human dignity and non-discrimination. No embargoes, complaints, lawsuits, terms of conduct

An exploration of the representation of women in the South African Police Service operations in TshwaneMatsepe, Martha Mapakeng 01 1900 (has links)
It has been claimed that since the dawn of democracy, there have been remarkable strides which were made to deal with the inequalities and disparities of the previous years. Former South African Police was reformed into a formidable South African Police Service that recognises the importance of women in the police. However, the SAPS is still one of the male-dominated organisations in this country. The inclusion and the retaining of women within operational policing and in management as well as leadership positions is still not yet successful. This research aimed to explore the causes for underrepresentation of policewomen in operational policing in Tshwane. The aim of this study was attained by gathering information through literature review, interviews and document analysis. In this qualitative study, semi-structured one-on-one interviews were conducted with twenty policewomen from four different identified police stations in Tshwane. Each identified police station was represented by five participants who directly perform operational policing. The findings of this study show that the organisation is still very unbalanced with the scale favouring males in operational policing. It is therefore recommended that SAPS should empower women in operational policing with the appropriate knowledge, skills and competencies through providing opportunities for career development and growth to successfully realise the SAPS’ dream of including and retaining women in operational policing, as well as in management and leadership positions and providing all women in the SAPS with the necessary support. Educational opportunities for the girl child in Africa : a necessary revisit of the discrimination factor with reference to Egypt, South Africa and CameroonChofor Che, Christian-Aime January 2003 (has links)
"This paper is therefore inspired to look at education with respect to girl children in Africa. This paper, by drawing inspriation from other settings, is also motivated by the need to find solutions on how best the rights of the girl child can be protected in conjuction with the educational policy of African countries. ... The study is divided into six chapters. Chapter one provides the context in which the study is set, the objectives of the study and its importance. Chapter two examines the importance of the right to education and in education and takes note of the issue of discrimination with respect to girl child education in Africa. In chapter three various international treaties that concern provisions on education and the discrimination factor as to gender are identified. Also in the international milieu, the role of international bodies in the effective and efficient insurance of girl child education is included. Chapter four examines on a regional level, the extent to which the African Commission has effectively monitored the provision of the African Chater. The African Children's Charter and the Draft Protocol to the African Charter on Human and Peoples' Rights on the Rights of Women (the Draft Women's Protocol) in Africa are also discussed in relation to provisions in the African Charter and work done on girl child education by the African Commission. In this chapter, a comparative study is also done of instruments and the implementation mechanisms offered by the Inter-American and European systems to the African human rights system in terms of the girl child education. This is so because in terms of experience, jurisprudence and institutions, these systems are considered to be more advanced than the African human rights sytem. Finally chapter five discusses girl child education on a national level in Africa. This chapter focuses on the experiences of South Africa, Egypt and Cameroon. Educational policy and other national legislative instruments such as the constitutions of these countries are included.
