[pt] O positivismo jurídico de H.L.A. Hart oferece respostas para a pergunta fundamental a respeito do conceito de direito com uma formulação bastante sofisticada, envolvendo a união de regras primárias e secundárias. Dentre os aspectos de maior relevância do modelo desenvolvido, ocupa posição central a figura da regra (última) de reconhecimento, regra secundária pensada como solução para o problema da incerteza, que advém da dificuldade de identificar quais regras pertencem ao ordenamento jurídico da comunidade e qual o âmbito de sua aplicação. A proposta do presente estudo é partir do marco teórico desenvolvido por Hart em O Conceito de Direito, trabalhando-o na interface entre a teoria do direito e o direito constitucional e procurando aplicar a teoria hartiana ao fenômeno jurídico brasileiro. Assim, os dois primeiros capítulos tratarão de questões conceituais a respeito do instituto tratado, com a identificação de algumas dificuldades na versão canônica e culminando com a proposta de uma nova compreensão do instituto, que considere o povo no grupo reconhecedor relevante. Por fim, no quarto capítulo, tenta-se descrever a regra última de reconhecimento do direito brasileiro, considerando as atuais práticas relevantes da comunidade político-jurídica brasileira de identificação do direito válido. / [en] H.L.A Hart legal positivism offers answers to the fundamental question about the concept of law with a very sophisticated formulation, involving the union of primary and secondary rules. Among the most relevant aspects of the developed model, at its core rests the (ultimate) rule of recognition, a secondary rule designed as a solution to the problem of uncertainty, stemming from the difficulty of identifying which rules belong to the community s legal system and their scope of application. The purpose of this study is, from the theoretical framework developed by Hart in The Concept of Law, to work in the interface between the legal theory and the constitutional law, and to apply the hartian theory to the Brazilian legal phenomenon. Thus, the first two chapters will address conceptual issues regarding the rule of recognition institute, identifying some problems in its canonical reading, and will culminate with the proposal of a new understanding of the institute, one that places the people in the relevant recognitional group. Finally, at the fourth chapter, there will be an attempt to describe the ultimate rule of recognition of Brazilian law, considering the current relevant practices of the Brazilian legal and politic community in identifying the law.

Målsättningen med rapporten är att bestämma på vilket sätt det går att hantera problem med gamla komponenter som går sönder på produktionslinjen som behöver ersättas med modernare utrustning. Att analysera valet till metod och val av passande ersättande komponenter, då valet kan vara kritisk för anläggningens funktion. Att jämföra de kommunikationsgränssnitt som används i arbetet i from av överföringshastigheter, distanser och funktion. Arbetet går igenom kommunikationsgränssnitt som PROFINET, RS-232, HART, Siemens protokollet RK 512 och proceduren 3964R. Hur signalöverföring med Current Loop fungerar. Arbetet visar hur det är möjligt att återfinna gamla data från produkter som installerats decennier tidigare genom litteraturstudie och mångsidig testning. Beroende på vilken situationen är i industrin och planer för framtida maskinuppgraderingar kan lösningsmetoden variera för att framtidssäkra produktionen med ny teknik eller med nya komponenter.  Resultatet av arbetet gav åter igen en fungerande produktionslinje. Kommunikationsgränssnitt som PROFINET är superiör med snabb överföringshastighet, långt kabelavstånd och skydd mot EMC. Vilket gör den till ett framtidssäkert gränssnitt. Till skillnad från äldre gränsnitt som den väletablerade RS232 som har långsam dataöverföring, korta kabelavstånd och är känslig för EMC. HART är ett flexibelt kommunikationsgränssnitt som använder Current Loop för signalöverföring. Eftersom gränssnittet använder ström möjliggör det mycket långa kabelavstånd och skydd mot EMC, men långsam datahastighet. / The aim of the report is to determine how to deal with problems with old components that break on the production line that need to be replaced with modern equipment. To analyse the choice of method and choice of suitable replacement components, as the choice can be critical for the plant's function. To compare the communication interfaces used in the work in the form of transmission speeds, distances, and function. The work goes through communication interface such as PROFINET, RS-232, HART, the Siemens protocol RK 512 and the procedure 3964R. How signal transmission with Current Loop works. The work shows how it is possible to find old data from products that were installed decades earlier through literature study and versatile testing. Depending on the situation in the industry and plans for future machine upgrades, the solution method can vary, as you want to secure the future of production with new technology or with new components. The result of the work once again gave a functioning production line. Communication interfaces such as PROFINET are superior with fast transmission speeds, long cable distances and protection against EMC. Which makes it a future-proof interface. Unlike older interfaces such as the well-established RS232 which has slow data transfer, short cable distances and is sensitive to EMC. HART is a flexible communication interface that uses the Current Loop for signal transmission. Because the interface uses current, it provides very long cable distances and protection against EMC, but slow data speeds.

Efficient search of an underwater area based on probability

Today more and more different types of autonomous robots and vehicles are being developed. Most of these rely on the global positioning system and/or communication with other robots and vehicles to determine their global position. However, these are not viable options for the autonomous underwater vehicles (AUVs) of today since radio-waves does not travel well in water. Instead, various techniques for determining the AUVs position are used which comes with a margin of error. This thesis examines the problem of efficiently performing a local search within this margin of error with the objective of finding a docking-station or a bouy.To solve this problem research was made on the subject of search theory and how it previously has been applied in this context. What was found was that classical bayesian search theory had not been used very often in this context since it would require to much processing power to be a viable option in the embedded systems that is AUVs. Instead different heuristics were used to get solutions that still were viable for the situations in which they were used, even though they maybe wasn’t optimal.Based on this the search-strategies Spiral, Greedy, Look-ahead and Quadtree were developed and evaluated in a simulator. Their mean time to detection (MTTD) were compared as well as the average time it took for the strategies to process a search. Look-ahead was the best one of the four different strategies with respect to the MTTD and based on this it is suggested that it should be implemented and evaluated in a real AUV. / Idag utvecklas allt fler olika typer av autonoma robotar och fordon. De flesta av dessa är beroende av det globala positioneringssystemet och/eller kommunikation med andra robotar och fordon för att bestämma deras globala position. Detta är dock inte realistiska alternativ för autonoma undervattensfordon (AUV) idag eftersom radiovågor inte färdas bra i vatten. I stället används olika tekniker för att bestämma AUVens position, tekniker som ofta har en felmarginal. Denna rapport undersöker problemet med att effektivt utföra en lokal sökning inom denna felmarginal med målet att hitta en dockningsstation eller en boj.För att lösa detta problem gjordes en litteraturstudie om ämnet sökteori och hur det tidigare har tillämpats i detta sammanhang. Det som hittades var att den klassiska bayesiska sökteorin inte hade använts mycket ofta i detta sammanhang eftersom det skulle kräva för mycket processorkraft för att det skulle vara ett rimligt alternativ för de inbyggda systemen på en AUV. Istället användes olika heuristiska metoder för att få lösningar som fortfarande var dugliga för de situationer där de användes, även om de kanske inte var optimala.Baserat på detta utvecklades sökstrategierna Spiral, Greedy, Look-ahead och Quad-tree och utvärderades i en simulator. Deras genomsnittliga tid för att upptäcka målet (MTTD) jämfördes liksom den genomsnittliga tiden det tog för strategierna att bearbeta en sökning. Look-ahead var den bästa av de fyra olika strategierna med avseende på MTTD och baserat på detta föreslås det att den ska implementeras och utvärderas i en verklig AUV.

Positivism Beyond the Hartian Pale

<p>This dissertation offers a critical analysis of the dominant philosophical theory of law today: Hartian positivism. The arguments proffered are not meant to strike at the underlying methodology of that account. Rather, they are intended to demonstrate that it performs sub-optimally with regard to its own jurisprudential aspirations. More specifically, this thesis contends that the Hartian position is unable to model the law in a way that captures the de facto terms of institutional governance, while also being able to give due theoretical credence to the normative structures and mechanisms that are widely deployed to regulate it. With this conclusion in hand, a new theory of law is suggested – one that seeks to stay true to the methods and aspirations of its predecessor, but which has been constructed so as to surpass its descriptive-explanatory capabilities. In this way, the following dissertation means to push analytic jurisprudence beyond the Hartian pale, and into new areas of theoretical discourse.</p> / Doctor of Philosophy (PhD)

Étude philosophique du renversement juridique canadien concernant l'aide médicale à mourir, à la lumière du débat Hart-Dworkin

Le 6 février 2015, la Cour suprême du Canada a rendu un jugement historique, unanime et anonyme. Dans l'arrêt Carter c. Canada (Procureur général), la Cour reconnaît que l'interdiction mur à mur de l'aide médicale à mourir porte atteinte aux droits constitutionnels de certaines personnes. En effet, les adultes capables devraient pouvoir demander l'aide d'un médecin pour mettre fin à leur vie s'ils respectent deux critères : consentir clairement et de façon éclairée à quitter ce monde et être affecté de problèmes de santé graves et irrémédiables leur causant des souffrances persistantes et intolérables. Or, cette décision constitue un renversement juridique, car un jugement inverse avait été rendu en 1993. En effet, vingt-deux ans auparavant, la Cour suprême avait jugé à cinq contre quatre que l'interdiction du suicide assisté était constitutionnelle. Dans l'arrêt Rodriguez c. Colombie-Britannique, la majorité avait statué que la protection du caractère sacré de la vie dans toute circonstance, tant pour les personnes vulnérables que pour les adultes capables, était une raison suffisante pour ne pas accorder de dérogation aux articles du Code criminel qui concernent le suicide assisté. Les juges majoritaires craignent alors que toute ouverture à l’aide au suicide entraine un élargissement progressif des critères d’admissibilité, ce que plusieurs appellent l’argument du « doigt dans l’engrenage ». Dans le cadre de ce mémoire, le renversement juridique Rodriguez-Carter sera analysé à la lumière du débat entre H. L. A. Hart et Ronald Dworkin. Alors que le premier défend une nouvelle version du positivisme modéré, le second offre une théorie nouvelle et innovatrice, nommée l’interprétativisme. L’objectif est simple : déterminer laquelle de ces deux théories explique le mieux le renversement juridique canadien concernant l’aide médicale à mourir. L’hypothèse initiale soutient que les deux théories pourront expliquer ledit renversement, mais que l’une le fera mieux que l’autre. / On February 6th 2015, the Supreme Court of Canada issued an anonymous, unanimous landmark judgment. In Carter v. Canada (Attorney General), the Court recognized that a blanket prohibition of physician-assisted dying violates the constitutional rights of certain individuals. Indeed, a competent adult person should be allowed to seek help from a doctor to end her life if she meets two criteria: clearly consent to the termination of life and have a grievous and irremediable medical condition causing enduring suffering that is intolerable to the said individual. This legal decision constitutes an judicial overrule, because a reverse judgment was made in 1993. In fact, twenty-two years ago, the Supreme Court ruled five to four in favour of the ban on assisted suicide. In Rodriguez v. British Columbia (Attorney General), the majority ruled that the protection of the sanctity of life in all circumstances, both for vulnerable people for capable adults, was reason enough not to invalidate the sections of the Criminal Code concerned with assisted suicide. The majority then feared that any opening to assisted suicide would cause a gradual widening of the eligibility criteria, what many have called the argument of the “slippery slope”. As part of this thesis, the Rodriguez-Carter judicial overrule will be analyzed in light of the debate between H. L. A. Hart and Ronald Dworkin. While the former is known for his defence of a new version of soft positivism, the latter offers a new and innovative theory, named interpretivism. The goal is simple: to establish which of these two theories best explains the Canadian legal overrule regarding physician-assisted dying. The initial hypothesis is that both theories may explain said reversal, but one will do so better than the other.

Thesis (MA)--Stellenbosch University, 2002. / ENGLISH ABSTRACT: This thesis contains the results of an investigation into the elements of the horror story and the Gothic novel in three contemporary works. The investigation was conducted within the theoretical framework of the original historical Gothic novel of the eighteenth century, in comparison with contemporary theorization on the Gothic, with specific reference to the study of Eddy Bertin, and to some extent Hendrik van Gorp and Fred Botting. Four conventions of the Gothic genre were identified, and were applied to an Afrikaans novel and drama, as well as a Dutch novel, to establish to which extent the Gothic manifests itself in these contemporary texts. The study focussed on The night only has one eye (1991) by Francois Bloemhof, Crossing/ Passion (1994) by Reza de Wet and A heart of stone (1999) by Renate Dorrestein. From these texts, which were read within a Gothic framework, it could be deduced that there is a deviation from the conventional Gothic texts within both the Afrikaans and the Dutch texts. This deviation especially occurs with regard to characterization, with specific reference to the female character. The authors use the traditional Gothic characters as a point of departure, but bring about renewal in the texts by making them part of a wider philosophical field. The portrayal of the themes of good versus evil, space and tension, also shows a deviation from the Gothic conventions. An important finding in this study is that the Gothic genre in its pure form can not successfully be traced in contemporary literature. The three texts under discussion show the occurrence of allogamy between the different sub-categories of horror. A further important conclusion is that these three texts cannot be merely categorized as Popular literature because of the renewal it brings regarding the traditional Gothic conventions. / AFRIKAANSE OPSOMMING: Hierdie tesis bevat die resultate van 'n ondersoek na elemente van die gruwelverhaal en die Gotiese roman in drie kontemporêre tekste. Die ondersoek is gedoen binne die teoretiese raamwerk oor die genre van die oorspronklike historiese Gotiese roman van die agtiende eeu, in vergelyking met die hedendaagse teoretisering oor die Gotiek, met spesifieke verwysing na die navorsing van Eddy Bertin, en in 'n mindere mate Hendrik van Gorp en Fred Botting. Vier konvensies van die Gotiese verhaaltipe is geïdentifiseer en toegepas op 'n Afrikaanse roman en drama, asook 'n Nederlandse roman, om vas te stel in watter mate en op watter wyse die Gotiek gemanifesteer word in dié hedendaagse tekste. Die navorsing fokus op Die nag het net een oog (1991) van Francios Bloemhof, Drif (1994) van Reza de Wet en Een hart van steen (1999) van Renate Dorrestein. 'n Belangrik aspek wat in die ondersoek na vore kom, is dat die Gotiek as verhaaltipe selde nog in sy suiwer vorm in literatuur aangetref word. Die drie tekste onder bespreking toon in watter aansienlike mate kruisbestuiwing plaasvind tussen die onderskeie sub-kategorieë van die riller. Laastens word daar aangevoer dat die Gotiese en gruwel-elemente binne dié drie tekste op so 'n vernuwende wyse geproblematiseer en uitgedaag word, dat dit nie sonder meer as triviaalliteratuur beskou kan word nie.

A Comparison of the Singing Activity of Carolina Wrens <i>(Thryothorus Ludovicianus)</i>) in Urban and Rural Settings

As the earth’s landscape becomes increasingly urbanized, local wildlife must adapt to urban conditions or migrate to areas that are more rural. Urban wildlife face challenges such as direct loss of habitat, competition with non-native species, disturbance due to anthropogenic noise, and micro-climatic changes. Factors such as temperature, relative humidity, and noise affect the acoustical environment and may affect the ability of many animals, including birds, to communicate. Understanding how urbanization affects birds’ singing behavior is critical because singing often plays a vital role in attracting mates and defending territories. In addition, as global climate change occurs it will become increasingly important to understand the influence of abiotic factors such as temperature on the singing behavior of birds. Developing a deeper understanding of how those abiotic factors affect singing and other associated behaviors may help guide future conservation actions. Carolina Wrens are often used to study the role of singing in defending territories. They are also a common subject for ranging studies. However, surprisingly little research has been conducted on the factors influencing Carolina Wren song activity over the course of a day. No studies have compared the singing activity of Carolina Wrens in urban and rural environments. The purpose of this study was to compare the singing activity of Carolina Wrens in urban and rural areas. Specifically, this study looked for patterns in the timing of songs throughout the day and examined the effects of season, temperature, and anthropogenic noise on singing activity in urban and rural settings. I analyzed data from 4 SongMeter© SM2 data loggers (2 located at an urban park in Bowling Green, KY and 2 located at a rural preserve in Hart County, KY). The data loggers were programmed to record ambient sound for 3 minutes at the beginning of every hour. A Hobo® data logger was deployed with each SongMeter© SM2 data logger to record temperature and relative humidity at 15-minute intervals. One week of data in May and one week of data in July were analyzed. Both weeks had similar photoperiods, temperatures, and amounts of precipitation. For each recording, I documented the number of Carolina Wren songs I heard and a categorical assessment of the precipitation and anthropogenic noise due to traffic or machinery. I conducted Chi-square analyses to compare the seasonal or site-based observed frequencies of singing activity to the corresponding expected frequencies. In May, Carolina Wrens at the urban site sang more than their rural counterparts. Daily activity patterns were visually analyzed using the average number of songs detected for each hour’s sampling period. No Carolina Wrens were heard singing the hour before sunrise or the hour after sunset. In May, the dawn chorus lasted nearly twice as long as in July. Zero-inflated Poisson regressions were used to determine the correlations between Carolina Wren singing activity and temperature or anthropogenic noise. Carolina Wren singing activity had significant correlations with both variables.
