Le droit d'action individuelle sur le fondement des traités de promotion et de protection des investissements / The individual right of action based on investment promotion and protection treaties

Burriez, Delphine 03 July 2014 (has links)
The settlement of international disputes is classically studied thought the concepts of judicial power, jurisdiction and admissibility. However it is now common to find references to the notion of « right of action » or « right of claim » in decisions of international tribunals especially when individuals are involved. One might wonder whether this observation reveals an evolution in the concepts governing disputes settlement in international law. The study of the right of action in international investment law demonstrates the usefulness of the concept in explaining the applicable rules. First, as a key concept, it can be used to identify the rules that determine the possibility to obtain a decision of the tribunal as opposed to the rules governing the State’s responsibility. In practice, it appears that the tribunals do not always respect this distinction. Secondly, the right of action allows taking into account the legal consequences of the State’s consent to arbitration. In this case, the concept of judicial power is partly irrelevant as it is usually based on a consent agreement between the parties. It follows that the concept of right of action is relevant when the applicable rules deal with the possibility to invoke and to rely on the consent to jurisdiction expressed by the respondent State. The fact that it is the case in the settlement of disputes between a State and an investor does not mean that it can not be so in the context of a interstate dispute.

An evaluation of the isoniazid preventive therapy initiation in Limpopo province

Khota, Mmankhuma Joyce 11 1900 (has links)
The purpose of this study was to investigate the Isoniazid preventive therapy (IPT) initiation amongst eligible HIV positive patients at health facilities in the Polokwane subdistrict to identify key features in the knowledge and practice of health professionals as well as available resources at the health facilities. A quantitative non-experimental, descriptive, cross-sectional design was used to describe the practice of IPT initiation in health facilities. Data were collected using a structured questionnaire with medical doctors, operational managers and registered nurses from the district’s 34 health care facilities. The census sample was 124. Data were captured and analysed using Statistical Package for the Social Sciences (SPSS) Version 24. The results showed that the health care professionals knew the policy and procedures for the implementation of IPT but lacked knowledge on patient screening. The findings further suggest that record keeping and data capturing was not implemented sufficiently. Resources at the facilities were found to be sufficient. / Health Studies / M. P. H.

The development of housing by newly retired couples of Baby-Boomers : living the present, anticipating the future ?

Auger, Fanny 25 November 2016 (has links)
This thesis of qualitative sociology is about practices and meanings of home’s adaptations made by newly retired couples of Baby Boomers. It reports various dynamics – sociological, historical, physical or of identity, relationship and lifestyle - that shape the experience of "ageing" and the "housing" of these individuals, and this in two different time frames : in the present, through realized and /or short-term planned developments; in the future, through the developments made by anticipation of risks linked to the ageing and/or long-term projection. The results of this thesis show, first of all, that the adaptation of housing and related practices constitute some "supports" for this transition in the life course, and for "ageing but not old yet” people coming to retirement and entering the “last third of their life”. In the same time, they show how the relationships and the various activities of newly retired "generational pillars" shape their habitat and way of living in the early retirement period. On the other hand, the results of this thesis give to see an "endogenous" approach to adaptation of housing, at a time when this issue is a major challenge for governments and individuals. Regarding this point of view, this research demonstrates how Baby Boomers show, through the development of their habitat, a significant empowerment about their present and future ageing in order to live and age "good" and if possible, at home. The exposed results also suggest the potential of "comfort" in order to help Baby Boomers in the process of risk’s prevention, for the future and the preparation of their old years. At the same time, this research encourages to think about the obstacles that still exist on these questions, such as the deep negative perception of aging, that certain popular images and messages continue to feed.

Authenticity, performance and the construction of self : a journey through the terrestrial and digital landscapes of men's tailored dress

Bluteau, Joshua Max January 2018 (has links)
This thesis explores high-end and bespoke menswear, tailoring and fashion, asking the question - why do some men choose to spend large sums of money to have clothes made for them? Using tailors and high-end menswear as a lens, this thesis unpacks how men construct their notion of self in the digital and terrestrial worlds through the clothes that they wear and the identities they perform. Based on twelve months' terrestrial fieldwork in London and twenty-four months' concurrent digital fieldwork with Instagram, this thesis examines notions of dress, performance and the individual across a multi-dimensional fieldsite set within a blended digital and terrestrial landscape. The fieldwork comprised visiting and interviewing tailors, and observing inside their workshops and at their fashion shows. In addition, the analyst-as-client built relationships with tailors, and constructed a digital self within Instagram through the publication of self-portraits and images of clothing. This thesis is presented in four chapters, flanked by an Introduction and Conclusion. These chapters move from an exploration of terrestrial research in the first two, to an analysis of digital research in the latter two. Five major motifs emerge in this thesis: the importance of the anthropology of clothing and adornment within western society; the nature of the individual in a digitised world; the difficulty in conducting western-centric fieldwork without an element of digital analysis; a methodological restructuring of digital anthropology; and the idea that a digital self can acquire agency. This thesis employs a pioneering blended methodology which brings together the fields of digital anthropology, visual anthropology and material culture to question how selves are constructed in a rapidly changing and increasingly digitised modernity. In conclusion, the thesis argues that individuals construct multiple digital selves and a sense of identity (around the notion of 'authentic individualism') that is illusory.

This study investigates the acquisition of front rounded vowels [y], [q], and [E] of French by adult female speakers who are proficient in French (L2). According to the literature (ALCÂNTARA, 1998; RESTREPO, 2011), the acquisition of front rounded vowels of French by Brazilian adult learners is a complex challenge, either in terms of perception or in terms of production. From this point, in this study we sought to contribute to the understanding of this complexity and develop the not many Brazilian studies involving individuals with proficiency in French language (L2) and the acquisition of its sounds. Thus, our challenge was to answer in what way adult Brazilian speakers, with proficiency in French (L2), deal with foreign sounds, different from the ones of their ML phonology, when it comes to their perception and production. Therefore, we aimed to detect, specifically, the level of perceptiveness with which the target vowels are identified and distinguished by the considered participants, as well as defining the acoustic behaviour of these sounds in their speaking, in a possible way to explain a probable authentic production of the investigated French segments according to the identification, distinction, and articulation of the participants. Then, two groups of volunteers participated in this research: one counts with the presence of three Brazilian women, professors and researchers of FFL in superior public education, residents in Pelotas/RS; the second group is formed by a native French speaker from Parisian region, who participates of the control group, which data is added to the one available in literature. For the collecting of data of production in both groups, four experiments were elaborated, three involving French oral vowels, and the last one involving oral vowels of BP, which were found in words and non-words from French and BP, produced inside of carrier sentences. For the collecting of information of perception related to the French vowels, four experiments were formed, two tests of identification, and two tests of distinction. The methodology used in the construction of these experiments was based on the one elaborated by Restrepo (2011), with adaptions to attend to the specific objectives of this study. The collection of the material occurred in a controlled acoustic environment (acoustic compartment), with the use of a digital recorder Zoom H4N and a pair of earphones model AKG K 44. The collected data was analysed acoustically and statistically with the softwares Praat (6.0.08 and 6.0.10 versions) and SPSS Statistics (17.0 version), respectively. The results achieved were interpreted with the HipCort model (MCCLELLAND et al, 1995), a dynamic model of formation of memory and learning. They confirmed our thesis of the potential outcome of our participants in the acquisition of the investigated sounds, because they could identify, distinguish, and produce accurately the front rounded vowels of French, demonstrating the distance of a possible influence from their ML. The results contribute, so, to refute the existence of an operation of biological restrictions connected to a conception of acquisition of language based on the presupposition of the symbolic paradigm, which meets the studies that evince the possibility of late learners to present a level of phonetic and phonologic competences in L2 comparable to the native speaker.

An Innovative Business Model for Security Exchange Market of Personal Future Income

LI, Qing Nan Unknown Date (has links)
As more and more Chinese students go abroad for education, there exits two main tough problems: firstly, the students from low-income families almost cannot get enough fund for abroad studying although they do have strong intention to go abroad under the present financial system in China ;secondly ,part of the students ,who invest their own human capital so much for receiving higher education ,face the dilemma that the actual salary after graduation may be under their previous expectation ,which means that the risk of investing their own education cannot be diversified and the investment may not get paid back as expectation. Through literature discussion, this research found two important concepts: individual future income ownership, which can be divided ,priced ,sold ,transferred ,and redeemed ;individual future income ownership share exchange market ,which can help the individuals issue and trade future income shares .But we have to ask that why there did not emerge such exchange market in history ?This research suggests that it's because the transaction cost ,which contains searching cost ,negotiating cost ,contracting cost, supervising cost and defaulting cost ,is too high in history .According to the recent paper published ,this research found that as the emergency of internet ,especially the social networks can cut down the transaction cost greatly in commercial activities .As the internet technological tools can reduce the transaction cost, this research suppose that the individual future income share (human capital share exchange) can come true in our generation and the exchange market needs to rely on the social networks. This research proposed business solutions ,which suggests that the individuals can issue future income shares to investors through a social network-style stock exchange market, to such problems so that it can enable the disadvantaged students go abroad and diversify part of the students' human capital investment risk ;the disadvantaged students are quite similar to the start-up companies ,which usually do not have too much assets and unlikely to get loan from bank ,so the disadvantaged students can issue future income shares (human capital shares) to investors to get fund and also the students who worry about their future career development risk can share both the risk and income with the investors by issuing shares to them ;moreover ,this research had verified the business model adequately through mixed research method ,which contains qualitative and quantitative methods .The business model that this research proposed can achieve human capital securitization low costly and it can be not only applied in individual education funding but also can extend to start up funding ,athlete training funding and actor funding. This research also found some new phenomenon and human behaviors under the context the individuals issue shares to investors and investors invest the shares .These new findings worth further deep researching in the social science discipline in the future.

Decisions from experience: Time delays, complexity and illusions of control

Lejarraga, Tomás 09 July 2009 (has links)
This thesis includes three chapters that study different aspects of the distinction between decisions from description and decisions from experience. Chapter 1 studies choice when decision makers have both information from description and information from experience. Results suggest that experience is disregarded in the face of description. Individual differences with respect to rational ability are also explored. Participants with higher rational ability draw larger samples than participants with lower rational ability. Chapter 2 examines situations in which information from experience is a better source of information than information from description. Complex scenarios and delayed judgmental tasks favor experience over description as source of information. Moreover, there were no individual differences due to numerical/rational abilities. Additional evidence was found that relates higher rational ability to larger samples. Finally, chapter 3 explores how illusion of control interacts with the source of information in a lottery task.

Building families through Assisted Reproductive Technologies in South Africa: a critical legal analysis

Mande, Ntumba 02 1900 (has links)
The advent of ARTs has enabled many individuals to have children and build families. Although ARTs have from the start been designated to serve as alternative way for heterosexual infertile individuals and couples to have genetically related children, ARTs are nowadays widely used by gays and lesbians to have even genetically unrelated children and build their families. This study addresses the well-being of children born as a result of ARTs and growing up in homosexual families in South Africa. South Africa has legalised homosexual unions, granting gays and lesbians several rights, including the right to marry, use ARTs to reproduce, and build families in which they raise their children. South Africa has also provided constitutional and statutory protection of children’s rights and has further required that the child’s best interests be considered as paramount in every matter concerning the child. Although ARTs may have allowed people to have children, they have proven to put the child’s interests at risk. ARTs are associated with several physical and psychological problems for resulting children. The legal protection provided for those children seems to be inadequate in respect of their best interests. Unlike Australian statutes that have provided strong protection for the child’s best interests, South African legislations regulating ARTs are far from protecting ART-born children’s interests. The application of the child’s best interests criterion to ART procedures has revealed that in the USA and Australia efforts of the state, ART providers and parents have been centred on the transfer of the custody of the ART-born child to the commissioning parent(s). Although in South Africa the application of the child’s best interests in the context of surrogacy procedures has revealed the protection of the child’s interests, it should be noted that that protection seems to focus on the child’s post-birth period. This situation leaves ART-born children without any protection, especially before their birth. In order to give effect to section 28 of the Constitution of the Republic of South Africa, 1996 and protect ART-born children’s interests, I make certain proposals for law reform in the final chapter of this thesis. / Private Law / LL.
