Ochrana designu / Design protection

This paper discusses the design and the possibilities of its legal protection at national, European and international level. The first section defines the concept of design, its role in today's world, its characteristics and the different kinds of design. The recently adopted Civil Code expanded the definition of things in the legal sense by including into this category also intangible assets. Thus, the paper deals further on with the change in the legal concept of design newly considered to be an intangible thing. In the following paragraphs the focus is on intellectual property rights and its individual components. Briefly defines the scope of copyright, industrial property rights and their differences and principles. A substantial part of the work focuses on design protection. The first part of this chapter deals with the possibilities of legal protection in the Czech legal order. Mentions protection through institutes of copyright, trademark, unfair competition and industrial designs, compares the relationship of these institutes and their concurrence. The legislation of industrial designs is then analyzed in detail, both in terms of the Czech Act no. 207/2000 Coll., On protection of industrial designs, and in terms of international treaties. This thesis on the theme Protection of a domain name in relation to other industrial rights strives to provide a comprehensive image of domain names protection in relation to the relevant objects of industrial property, respectively in relation to industrial rights related to these objects, as well as to provide a summary of the interpretative practice to this topic of the courts in the Czech Republic and of the Arbitration Court attached to the Economic Chamber of the Czech Republic and Agricultural Chamber of the Czech Republic with regards to top level domain .cz. For this purpose, the first part of the thesis introduces a basic technical and descriptive introduction to domain names containing a general and comprehensible extract of technical solution and significance of domain names, which are also used in other chapters of this thesis. The following third chapter defines the basic definition of the domain names anchoring in the law in the Czech Republic, including current theoretical and legal concepts of domain names. The fourth chapter introduces the basic characteristic of industrial rights that are compared in contrast to domain names. The thesis is focused on a specific area of intellectual property field, namely the system of protection of Intellectual property whose current form has been shaped by the international organizations, especially by the World Intellectual Property Organization (WIPO) and the World Trade Organization (WTO). There has therefore been allocated extra space in the thesis to make the reader familiar with these respective organizations, especially with their organizational structure, decision-making procedures and activities. Important part of the thesis is analysis of current relations between WIPO and WTO, including its negative aspects. The thesis also contains section devoted to possible future development of the relations between WIPO and WTO.
