L'appréhension juridique du risque inhérent aux espaces naturels littoraux / The legal understanding of the inherent risk in coastal natural spaces

Dans un contexte de socialisation des risques, les propriétaires et gestionnaires d’espaces naturels sont confrontés à un paradoxe opposant l’exigence croissante d’un aménagement des sites en vue de leur sécurisation, et la nécessité d’assurer leur préservation. Cette problématique revêt un relief particulier dans les espaces naturels littoraux, qui concentrent des sites d’exception en termes de biodiversité et de paysages, qui sont dans le même temps prisés des touristes et sportifs, et entourés par l’urbanisation. La gestion naturaliste de ces espaces génère des risques, voire des dommages, et donne lieu à des responsabilités qui s’entrecroisent, voire s’enchevêtrent. Les espaces littoraux sont également concernés par les risques d’érosion côtière et de submersion marine qui illustrent la situation paradoxale du souhait d’occuper un espace d’exception, sans être impacté par son évolution. Face aux faiblesses des stratégies de défense contre la mer, l’idée d’une acceptation de la mouvance du trait de côte, par anticipation ou déplacement des enjeux menacés, se fraie un chemin depuis une trentaine d’années et conduit à repenser l’aménagement des sites côtiers et des espaces rétro-littoraux. Ainsi, si les acteurs de la gestion des espaces naturels se heurtent aujourd’hui aux demandes d’indemnisation des victimes de risques naturels, ils se heurteront demain aux demandes de protection ou de relocalisation des personnes menacées par les risques côtiers. Dès lors, comment répondre à ces enjeux et contraintes ? La thèse étaye le postulat selon lequel la clef réside dans une meilleure appréhension juridique de la notion de risques inhérents aux espaces naturels / In a context of risks socialization, the owners and the administrators of natural spaces are confronted to a paradox bringing into conflict the increasing demand of security in natural sites, and the necessity to assure the preservation of those same sites. Coastal zone are particularly faced with this problem : in fact, this kind of territories are characterized by some remarkable natural spaces and landscapes, which are both crowed by tourists and outdoor sports enthusiasts, and landlocked by the urbanization. Today, the wilderness management of natural spaces generates risks and responsibilities which become muddled between the littoral actors. Coastal zones are also exposed to erosion and marine submersion, which illustrate the paradoxical situation of the wish to live in exceptional spaces without undergoing the natural dynamics of the coastal line. In front of the weakness of defense strategies, the idea of an acceptance of the natural movement of the coast line by anticipation or spatial reorganization of territories to protect the persons threatened by erosion or submersion, gained ground in the last thirty years. These news adaptation strategies lead up to reconsider the coastal zones management, but also the hinterland spatial planning. Thus, if the actors of the natural spaces management face with the compensation claims of natural risks victims today, they will collide with requests of protection or relocation of the people threatened by the coastal risks tomorrow. How to answer to these stakes and constraints ? This thesis supports the postulate that the key lies in a better legal apprehension of the notion of risks inherent in natural spaces

A task-specific approach to job accommodation in physically-demanding positions

Throughout the world, including South Africa, various approaches have been identified and implemented in an attempt to ensure that employees in physically-demanding positions are properly managed from a physical work capacity point of view, the primary goal always being to return the employee in need of assistance to full working capacity as soon as possible. The burning question has, however, always remained: “What happens to the employee in the meantime?” This study focused on exactly that question, the aim being to develop a comprehensive tool to assist all parties concerned in managing the affected employee through the application of task-specific job accommodation. The predetermined goal of the study was to develop a task-specific job accommodation tool for a physically-demanding position. This was achieved through a number of steps, which included an extensive literature review, a thorough job analysis, identification of a suitable test battery with related minimum physical requirements and cut scores, interviews, and the eventual development of the tool. Once the task-specific job accommodation tool was completed, the next step was to make use of three case studies to assist in illustrating the way the tool is to be implemented, as well as to show the potential value of its implementation. The information from three actual incapacity cases in the company concerned was used for these case studies. The results from this study are extremely positive and the three case studies have provided a glimpse of the potential value that could be added through the implementation of the job accommodation tool. The final product will greatly assist the company concerned in managing incapacitated employees in a manner that is beneficial to both the company and the individuals involved. Hopefully, this study will contribute to bring about a new era in the way South African companies and their occupational health departments approach the management of their incapacitated employees. Contribution to the modelling of the light field distribution within Synechocystis sp. PCC 6803 cultures and its influence on cellular photosynthesis processes

La presente tesis doctoral, titulada "Contribution to the modelling of the light field distribution within Synechocystis sp. PCC 6803 cultures and its influence on cellular photosynthesis processes", engloba diversos trabajos cuyo objetivo es avanzar en la compresión de la distribución lumínica en cultivos de cianobacterias y en los efectos de la luz sobre los mecanismos fotosintéticos de dichos microorganismos. Se trata, en definitiva, de otro paso hacia la integración de modelos matemáticos sobre la fotosíntesis a nivel celular y a escala de cultivo. En primer lugar, para comprender cómo se comporta un cultivo de bacterias fotosintéticas, es fundamental predecir la distribución del campo de luz a lo largo del perfil del biorreactor, tanto a nivel de intensidad total, como respecto a su distribución de flujo de fotones. La distribución de longitudes de onda presente en el medio es importante puesto que muchos procesos de la fotosíntesis están regulados por ciertas longitudes de onda y, por tanto, están modulados por la distribución espectral - el color - de la luz. Aprovechando las propiedades inherentes ópticas del cultivo, se desarrolló un modelo matemático basado en el concepto de campo auto-consistente. Este algoritmo, bautizado en la correspondiente publicación como Auto-consistent Field Approximation Algorithm (AFA), proporciona una predicción del campo lumínico, incluyendo la evolución espectral del mismo a lo largo del camino óptico, para cultivos aclimatados a distintos valores de radiación. Dicha investigación se publicó en la revista Algal Research mediante el artículo titulado "Light distribution and spectral composition within cultures of micro-algae: Quantitative modelling of the light field in photobioreactors", en el que se valida el algoritmo con datos experimentales de dos cepas de estudio de la cianobacteria Synechocystis. Si bien los resultados fueron satisfactorios, el empleo de la ley de Lambert-Beer con un valor constante de atenuación no permite modelizar la parte del campo de luz con menor intensidad, donde el coeficiente de atenuación deja de ser constante y el comportamiento se desvía del exponencial. Por ello, se decidió modelizar el campo de luz con una función que generaliza el caso exponencial mediante el uso de cálculo fraccionario. Se empleó una función de Mittag-Leffler que cumplía con los requisitos formales y ofrecía un ajuste de los datos mejor al obtenido mediante la ley de Lambert-Beer. Como un hallazgo notable, se determinó que el valor de dicho parámetro, que caracteriza la función de Mittag-Leffler, era el mismo para los datos empíricos de las dos cepas estudiadas. Este trabajo se publicó en la contribución llamada "Estimation of the light field inside photosynthetic microorganism cultures through Mittag-Leffler functions at depleted light conditions" en la revista Journal of Quantitative Spectroscopy & Radiative Transfer. Después se procedió a utilizar sendos trabajos de investigación para calcular el campo de luz en un cultivo de Synechocystis y relacionarlo con su productividad máxima. En concreto se ha estudiado, como indicador del rendimiento de la fotosíntesis, la producción de oxígeno y los mecanismos respiratorios asociados a distintas intensidades de luz. Esta investigación está en su fase final y se está ultimando la escritura del artículo para enviarlo a una revista científica próximamente. Dicho manuscrito se titula "Experimental characterisation of Synechocystis sp. PCC 6803 cultures productivity up on light conditions". Finalmente, se está desarrollando una cuarta contribución titulada "Individual pigment contribution to overall in vivo absorption in Synechocystis sp. PCC 6803 cells". Esta investigación estudia la cantidad de luz absorbida por los cromóforos de Synechocystis en función del tipo de iluminación utilizada y calcula la concentración de pigmentos presentes en la célula. / The present doctoral thesis, entitled "Contribution to the modelling of the light field distribution within Synechocystis sp PCC 6803 cultures and its influence on cellular photosynthesis processes", includes several works whose objective is to advance in the understanding of the light distribution in cyanobacterial cultures and in the effects of light on the photosynthetic mechanisms of these microorganisms. It is, ultimately, another step towards the integration of mathematical models on photosynthesis at the cellular level and at the scale of culture. First, to understand how a culture of photosynthetic bacteria behaves, it is essential to predict the distribution of the light field along the bioreactor profile, both at the level of total intensity and with respect to its photon flux distribution. The distribution of wavelengths present in the medium is important since many processes of photosynthesis are regulated by certain wavelengths and are therefore modulated by the spectral distribution - the colour - of the light. Taking advantage of the inherent optical properties of the culture, a mathematical model based on the self-consistent field concept was developed. This algorithm, named in the corresponding publication as Auto-consistent Field Approximation Algorithm (AFA), provides an estimation of the light field, including the spectral evolution thereof along the optical path-length, for acclimated cultures to different radiation values. This research was published in the journal Algal Research through the article entitled "Light distribution and spectral composition within cultures of micro-algae: Quantitative modelling of the light field in photobioreactors", in which the algorithm is validated with experimental data of two strains of study of the cyanobacterium Synechocystis. Although the results were satisfactory, the use of the Lambert-Beer Law with a constant attenuation value, cannot correctly model the part of the light field with less intensity, where the attenuation coefficient ceases to be constant and the behaviour deviates from the exponential. Therefore, it was decided to model the light field with a function that generalizes the exponential case through the use of fractional calculus. A Mittag-Leffler function was used that fulfilled the formal requirements and offered a better data fit than that obtained with the Lambert-Beer law. As a remarkable finding, it was determined that the value of this parameter, which characterises the Mittag-Leffler function, was the same for the empirical data of both studied strains. This work was published in the contribution called "Estimation of the light field in photosynthetic microorganism cultures through Mittag-Leffler functions at depleted light conditions" in the journal Journal of Quantitative Spectroscopy & Radiative Transfer. Thereafter we proceeded to use both research works to calculate the light field within Synechocystis cultures and relate it to its maximum productivity. Specifically, it has been studied, as an indicator of the performance of photosynthesis, the production of oxygen and the associated respiratory mechanisms under different light intensities. This research is in its final phase and the writing of the article is being finalised to submit it to a scientific journal soon. This manuscript is entitled "Experimental characterization of Synechocystis sp. PCC 6803 cultures productivity up on light conditions". Finally, a fourth contribution entitled "Individual pigment contribution to overall in vivo absorption in Synechocystis sp. PCC 6803 cells" is under development. This research studies the amount of light absorbed by Synechocystis chromophores according to the type of employed illumination and calculates the concentration of pigments present in the cell. / La present tesi doctoral, titulada "Contribution to the modelling of the light field distribution within Synechocystis sp. Tato diplomová práce uvádí dynamiku klikového mechanismu šestiválcového řadového motoru za účelem návrhu klikového hřídele v CAD programu Pro/Engineer. Následuje popis vibrací klikového mechanismu a analytický výpočet jeho torzních vibrací. Hlavní část diplomové práce se pak zabývá konverzí hřídele do konečno-prvkového modelu v programu ANSYS a jeho importem do prostředí Adams/Engine. V tom je provedena modální analýza klikového ústrojí pro získání vlastních frekvencí a tvarů. Na konec práce je porovnán výstup z analytického řešení a výsledky z multi-body systému.

Social workers' conceptualizations of spirituality as lived experience in professional practice

This doctoral study explores social workers’ shared understandings of spirituality as lived experience in their personal lives and professional practice. It examines Canadian social workers’ shared conceptualizations of spirituality as lived experience, what it entails, its role and purpose (why), and how it informs professional practice. Data collection involved three steps: a national publicity led to 24 completed self-screening questionnaires (SSQ); 14 in-depth interviews conducted through constructivist grounded theory’s theoretical sampling and; the preliminary findings were validated by the 24 SSQ participants. This study generated two key findings. The central concepts category of the conceptual schema of spirituality as lived experience emerged as Transcendent Life Energy (TLE) as Unconditional Love (UL) in Transformative Relationships (TR) With Self (WS) in Support of Wellbeing (SW)- i.e. TLE-UL-TR-WS-SW. Second, the conceptual schema analyzed through Self as body-mind-emotions-spirit-social (B-M-E-S-S) being—the social work practitioners—illuminated that spirituality as lived experience is about inherent, interconnected, transformative relationships that involve individuation as a life-long process that support healing, development of personal values, growth, and wellbeing in participants’ lives, their clients’ and social life. These findings unveiled interrelated discoveries of significance in social work practice. The wellbeing of Self is inherently interconnected with practitioners’ professional practice, their clients’ and others’ wellbeing. This confirmation is consistent with the concerns about the use of Self in countertransference and religion/culture. However, the personal values that participants developed through the conceptual schema were consistent with human rights and social work values; they included: respect for inherent dignity and worth of persons, self-determination, personal and professional integrity, do no harm, and social justice. Participants’ process of developing personal values exposed a distinction between beliefs and values acquired through socialization and those developed through the conceptual schema. These findings illuminate the function of social work as catalyst for transformative relationships and clarify the role of individuation as directly related to wellbeing, in the midst of cultural and embodied hegemony. Furthermore, the findings illuminate how, why, and what spirituality as lived experience entails and; highlight the multidisciplinary nature of social work practice and theory as inherently interconnected, encompassing human, natural, and social sciences. / October 2016

Biodegradable Composites : Processing of thermoplastic polymers for medical applications.

Despite the recent development in PLA and PLGA based medical devices, there are still needs to further improve the mechanical performance of bioresorbable medical implants and their bioactivity. This is normally done by optimizing the filler compositions in selected groups ofbiodegradable polymer matrices. In this study, the effects of various filler levels on mechanical strength and thermal properties of PLA and PLGA composites were investigated. Composites containing different dosage of osteoconductive HAp with various particles size (0-5μm, 0-50 μm, nano size), β-TCP, bioactive glass and biodegradable Poly-L-lactide and Polylactide-glycolic acid was manufactured with melt blending, using a twin-screw extruder.The samples were investigated by Differential Scanning Calorimetry (DSC), thermo gravimetric analysis (TGA), Scanning Electron Microscopy (SEM), viscometer, three points bending machine, and Optical Microscopy (OM). The Extruder produced a porous profile. The result from TGA and SEM indicated that there was homogenous filler dispersion in the matrix after compounding.The result from DSC and Viscometer shows that there was some degradation duringcompounding. Mechanical properties of composites were modified by adding filler to matrix. The addition of Bioactive glass, as a filler, increases the degradation of the polymer matrix. The best filler that was applied is 0-5μm and nano HAp. Also in in-vitro degradation part of this thesis work, the effects of calcium phosphate materialsare investigated on degradation process.

Přístupy k zajištění jaderné bezpečnosti u reaktorů 3. generace / Approach to the nuclaer safety of the 3rd generation nuclear reactors

The main target of the master´s thesis is reviewing the generation III nuclear reactors in term of the nuclear safety. At first we have to learn some theory of the nuclear safety in order to understand safety systems of the generation III nuclear reactors. Therefore the thesis is divided into two parts. Legislative and technical approaches to nuclear safety are mentioned in the first part. Regulatory bodies, whose task is to supervise nuclear safety in the nuclear power plants, belongs to the legislative approaches. There are defined terms such as defence in depth, redundancy, diversity, etc. There are mentioned methods to assessing nuclear safety – deterministic and probabilistic methods, especially probabilistic methods, for which a simple example is provided. There are also mentioned active and passive safety systems and their significance for nuclear safety and inherent safety too. There is an example of the function of the active and passive safety systems of the EDU nuclear power plant in conclusion of this issue. The second part deals with description of the selected nuclear reactors in context of the construction of the new units of nuclear power plant in Temelín. The nuclear reactors from companies, which applied for the public tender opened by ČEZ, a. s., for the construction of the ETE 3+4. Thus, the nuclear reactor MIR-1200 by ATOMSTROYEXPORT (Russian Federation), the nuclear reactor AP1000 by WESTINGHOUSE (USA) and the nuclear reactor EPR by AREVA (France) are taken into account . Comparison of the generation II and these generation III+ nuclear reactors necessarily belongs to this master´s thesis. These the generation III+ nuclear reactors are compared with the nuclear reactor VVER 440 (EDU) and in particular with the nuclear reactor VVER 1000, which is operated in the nuclear power plant Temelín. The final chapter contains generally appraisal of the whole problem.

La cession de créance en droit français et en droit colombien

La cession de créance est un mécanisme consacré tant en droit commun français qu’en droit commun colombien. Conformément à l’analyse classique dans ces deux systèmes juridiques, la cession de créance est un contrat translatif d’obligation envisagée activement. Ainsi, l’obligation passerait, telle qu’elle est, du patrimoine du cédant à celui du cessionnaire. Le débiteur de la créance cédée n’aurait donc rien à craindre, car l’obligation ne subirait aucune modification du fait de la cession. Il resterait tenu envers le cessionnaire dans les mêmes termes qu’il l’était envers son créancier initial : le cédant. La cession de créance opérerait donc un banal transfert d’un bien incorporel. Malgré le caractère ancré de cette conception, elle est critiquable. L’obligation reste avant toute chose un lien juridique de sorte que l’idée de sa transmissibilité, au moins par acte entre vifs, n’est pas convaincante. En réalité, on s’aperçoit que la cession de créance opère une modification de l’obligation par changement de créancier, et cela sans le consentement du débiteur, sujet passif du lien juridique. Le débiteur subit donc une telle modification, laquelle n’est jamais sans conséquence sur sa situation juridique, ce qui explique qu’il mérite une protection spéciale. C’est pourquoi les tentatives classiques de qualification du débiteur de partie ou de tiers à la cession et, par conséquent, la question de savoir si la cession produit à son égard un effet relatif ou un effet d’opposabilité se révèlent inopportunes.Cependant, cette analyse ne doit pas cacher une autre vérité : la cession de créance est également un acte translatif de créance, bien incorporel qui ne se confond pas avec l’obligation, même si les rapports entretenus entre la créance et l’obligation sont étroits. En tant qu’acte translatif de créance -bien incorporel-, la cession présente des spécificités qui empêchent de la cantonner à un acte juridique déterminé. En effet, la cession permet la réalisation de différentes opérations juridiques, ce qui explique sa nature polyvalente. En outre, la nature incorporelle de la créance explique la spécificité de certaines règles régissant le rapport entre les parties et la cession et celui concernant les tiers et la cession ; notamment celles relatives à l’étendue du transfert et à la garantie due par le cédant au cessionnaire, ainsi que celles portant sur l’opposabilité du transfert aux tiers. / The assignment of claims is a mechanism enshrined in both French ordinary law and Colombian ordinary law. According to the classical analysis in these two legal systems, the assignment of claims is a contract transferring the obligation considered active. Thus, the obligation would pass as it is from the patrimony of the assignor to that of the assignee. The debtor of the assigned claim would therefore have nothing to fear as the obligation would not be affected by the assignment. He would remain liable to the assignee in the same terms as he was to his original creditor: the assignor. The assignment of a claim would thus operate a mere transfer of an intangible property. Despite the anchored nature of this conception, it is open to criticism. The obligation remains above all a legal bond so that the idea of its transmissibility, at least by inter vivos transaction, is not convincing. In fact, we can notice that the assignment of claim creates a modification in the obligation by change of creditor, without the debtor's consent, the passive subject of the legal bond. The debtor thus undergoes such a modification, which is never without consequence on his legal situation, which explains why he deserves special protection. Hence the classical attempts to qualify the debtor of a party or third party in the assignment and, consequently, the question whether the assignment produces a relative effect or an enforceability effect in his regard is undesirable.However, this analysis must not hide this other truth: the assignment of a claim is also an act transferring of the claim, which is intangible property, not to be confused with the obligation, even if the relationship between the claim and the obligation is narrow. As an act transferring of the assignment, intangible property, the assignment presents specificities which prevent it from being framed in a particular legal act. Indeed, the assignment allows the realization of different legal operations, which explains its versatile nature. Moreover, the intangible nature of the claim explains the specificity of certain rules governing the relationship between the parties and the assignment and that relating to third parties and assignment, in particular, those relating to the extent of the transfer and the guarantee owed by the assignor to the assignee as well as those concerning the effectiveness of the transfer to third parties.
