The use of temporary employment services as a means to achieve flexibility in die labour market led to various complications due to a lack of proper regulation. The atypical formation of the triangular employment relationship, limited rights and less favourable employment conditions of the temporary employees, multiple authority figures and their liabilities under various circumstances and the impact thereof on such employee’ collective bargaining rights caused legal uncertainty in the absence of sufficient legislation to govern it. Temporary employment agencies developed certain methods in order to evade the restrictive labour legislation and employer duties imposed on them, namely by making use of automatic termination clauses (resolutive conditions) and by categorising the temporary employee as an independent contractor. Last mentioned would effectively exclude the temporary employee from labour legislation and the protection it provides. In reaction to abovementioned problems, trade unions have been objecting to the use of temporary employment agencies and went as far as demanding the total ban thereof. This raised the question in the South African Government whether said agencies should indeed be banned. The other option is a less restrictive approach and entails the attempt to regulate these agencies by amending the current labour legislation in order to accommodate temporary employment services. In light of the fact that various proposals to amend the current South African labour legislation (especially with regard to temporary employment services) have been published in the Government Gazette, it can be deduced that the social partners ultimately chose to regulate temporary employment agencies rather than ban them altogether. From an early stage the International Labour Organisation (ILO) provided rules and regulations for the management of employment agencies in general by way of conventions and recommendations. In 1997, in order to give effect to the labour standards identified by it, the ILO brought the Private Employment Agencies Convention into existence. This document could be applied to all temporary employment agencies on an international level. This document provides for administrative regulations, the duties of the agency and the client as well as the rights of the temporary employees concerned. The ILO recommends that all of its member states incorporate the principles contained within this document in their own legislation. Temporary employment services are also used in other legal systems. For purposes of this study, the English law (United Kingdom (UK)) and the Namibian law will be scrutinised. Similar issues to those recognised in the South African law have been identified in these countries. However, each has approached said problems in different ways. The Namibian Government banned the conducting and provision of these services by way of legislation in 2007. The constitutionality of the ban has however been questioned by the Supreme Court of Namibia, after which it had been found to infringe upon the fundamental freedom to carry on any business, trade or occupation. The ban was struck down as unconstitutional. The Namibian Government has since promulgated new legislation in which it removed the ban and replaced it with numerous amendments providing for the regulation of temporary employment services. Since 1973 the UK has been promulgating various instruments for the thorough regulation of temporary employment agencies. These instruments provide for the management of temporary employment agencies and the rights of the employees involved. The relevant legislative instruments have been updated regularly with the purpose of ensuring that the needs of all the parties concerned are met. The UK, as a member state of the European Union (EU), (which has also been providing for the regulation of temporary employment services in various directives), promulgated legislation specifically with the aim to give effect to the principles in the mentioned directives. By way of doctrines and the creation of a third category ―worker‖ the UK has been attempting to prevent any loopholes in their legal system with regard to temporary employment services and the rights of the employees involved. The aim of this study is to investigate all the important complications experienced with temporary employment agencies in order to indicate the impact the atypical circumstances have on the rights of the temporary employees. The degree to which, if at all, the South African law complies with the preferred labour standards identified by the ILO will be pointed out. A comparative study will be conducted, first by ascertaining in detail how the comparable issues in the UK and Namibian law are dealt with, and second by identifying which aspects in these legal systems could be of value to the South African law. Finally the potential effectiveness of the proposed amendments to the South African labour legislation will be analysed, during which recommendations for the unresolved issues will be provided. Afrikaans text / Suid-Afrika het ‘n ver pad gekom sedert die 16de eeu in die erkenning en ontwikkeling van kinderregte. Kinderregte word vandag ten volle erken in die Grondwet, wat die hoogste gesag in die land is. Hierdie studie het ten doel om die beskerming van kinderregte in die Suid-Afrikaanse Reg te ondersoek, met verwysing na die rol wat internasionale reg, soos die United Nations Convention on the Rights of the Child (“die Konvensie”) en die African Charter on the Rights and Welfare of the Child 1990 (“Afrika Handves”) in die ontwikkeling van kinderregte gespeel het. Spesifieke voorskrifte ingevolge waarvan die regte van kinders beskerm word is ondersoek,insluitend artikel 28 van die Grondwet en sekere bepalings van die Kinderwet. Weens die beperkte omvang van hierdie verhandeling, is sekere afgebakende voorbeelde uit die Kinderwet ondersoek met spesifieke verwysing na kinders se regte en tradisionele waardes soos manlike besnydenis, vroulike besnydenis en maagdelikheidstoetse. Daar is gekyk of die praktiese probleme op regeringsvlak, byvoorbeeld die voorsiening en befondsing van maatskaplike dienste, die implementering van die bepalings van die Kinderwet vertraag. Skrywer kom tot die slotsom dat die bepalings van die Kinderwet alleenlik nie voldoende is om effektiewe beskerming aan sekere groepe kinders te verleen nie en hierdie probleme lei daartoe dat kinderregte nie behoorlik gerealiseer en geïmplementeer word nie, en dat daar nie ‘n behoorlike balans tussen die regte en verantwoordelikhede van die kind, die ouers en die staat bereik word nie. Moontlike oplossings vir die probleem en tekortkominge in die uitvoering van die Kinderwet word voorgestel in die slot hoofstuk. / South Africa has come a long way since the 16th century in the recognition and development of children's rights. Children's rights are now fully recognized in the Constitution, the supreme authority in the country. This study aims to investigate the protection of children's rights in South African law, with reference to the role of international law, such as the United Nations Convention on the Rights of the Child and the African Charter on the rights and Welfare of the child 1990, in the development of children's rights. Specific provisions under which the rights of children protected is examined, including Section 28 of the Constitution and certain provisions of the Children’s Act. Due to the limited scope of this paper, some designated examples from the Children’s Act are examined with particular reference to children's rights and traditional values such as male circumcision, female circumcision and virginity testing. It is looked at if whether the practical problems experienced on government level, the provision and funding of social services delay the implementation of the provisions of the Children's Act .Author comes to the conclusion that the provisions of the Children alone is not sufficient to ensure effective protection of the rights of certain groups of children and that these problems led to children's rights not properly realized and implemented, and that a proper balance between the rights and responsibilities of the child, the parents and the state is not reached. Regulating multinational enterprises (MNEs) transactions to minimise tax avoidance through transfer pricing : case of Zimbabwe

Abstract in English, Afrikaans and Zulu / In 2016, Zimbabwe introduced specific transfer pricing legislation to prevent abusive tax strategies by taxpayers. This study uses a qualitative interpretive inquiry to assess the adequacy of the new transfer pricing regime. This study contributes to the body of knowledge in that it explores transfer pricing as a tax avoidance tool, a concept that is at its nascent stage in academic taxation literature. Furthermore, it addresses a methodological gap by employing a qualitative inquiry in an area that is predominated by quantitative research. Indepth interviews and document review were used to gather data, and deductive content analysis was employed with the aid of ATLAS.ti 8™. This study confirms previous findings that tax consultants play a significant role in the compliance decisions of Multinational Enterprises (MNEs) through the examination of the exploitative strategies practiced by these MNEs. The comparison of the OECD and UN transfer pricing guidelines in search for the applicability of international guidelines to Zimbabwe’s specific needs helped uncover the contemporary dilemmas in global standards versus domestic standards. This study responds to the knowledge gap regarding the transfer pricing phenomenon in Zimbabwe through the lenses of an under-explored three-layered rationality concept; legal, implementation and exploitative rationality. The argument maintained in this study is that this rationality trichotomy is a useful lens to understand transfer pricing as a tax avoidance tool, and that international standards are not universal and so each country’s unique situation should be addressed at a domestic level. / Zimbabwe het in 2016 bepaalde oordragprysingswetgewing ingestel om onregmatige belastingstrategieë deur belastingbetalers te voorkom. Hierdie studie het ’n kwalitatief-interpretatiewe ondersoek gebruik om die toereikendheid van die nuwe oordragprysingsregime te assesseer. Die studie lewer ’n bydrae tot die kennismateriaal omdat dit oordragprysing as ’n belastingvermydingsinstrument ondersoek, ’n konsep wat in sy kinderskoene in akademiese belastingliteratuur staan. Dit verken ook ’n metodologiese gaping deur ’n kwalitatiewe ondersoek te gebruik op ’n gebied wat deur kwantitatiewe navorsing oorheers word. Hierdie proefskrif bied ʼn nie-empiriese ondersoek en ʼn konseptuele analise van die verhouding tussen ruimte en identiteit in Eben Venter (1954-) se oeuvre binne die konteks van ballingskapliteratuur die postkoloniale diskoers. Die manifestasie van die ruimte- identiteitdialektiek, soos wat dit uitgebeeld word in Venter se skryfkuns, word beskryf aan die hand van postkoloniale teorieë en insigte wat verband hou met aspekte soos ruimte, plek, ballingskap, diaspora, ruimtelike verplasing, seksuele migrasie, intra-nasionale migrasie, internasionale migrasie, empiriese en kulturele landskappe, identiteit as sosio-kulturele konstruksie en Suid-Afrikaanse outobiografieë. Vir die doel van hierdie ondersoek is die volgende vertellings geselekteer: Ek stamel ek sterwe (1996), Twaalf (2000), Horrelpoot(2006) en Brouhaha (2010). The manifestation of the space-identity dialectic, as portrayed in Venter’s writing, is described on the basis of postcolonial theories and insights related to terms and concepts like space, place, exile, diaspora, spatial displacement, sexual migration, intra-national migration, international migration, empirical and cultural landscapes and identity as a social-cultural construction. For the purpose of this study the following narratives were selected: Ek stamel ek sterwe (1996), Twaalf (2000), Horrelpoot en Brouhaha (2010). At a juncture of mass migration, global uncertainty, transnational capitalism and radical decolonization in the form of violent crime, violent protests at universities, hate speech, farm murders, land reform, labour unrest, xenophobia and the dismantling of minority rights, Venter addresses an assortment of social issues. This include: the aftermath of apartheid, the Afrikaner-diaspora, landownership, the ideological appropriation of land, racism, homophobia, queer-migration, the viability of an inclusive African-identity and the altered role, place and identity of Afrikaners since 1994. The autobiographical element is evident in Venter’s writing and is discussed by referring to the relationship between fictional and real spaces and to autobiography as a hybrid genre and creative project. This study also presents a critical-analytical reflection of Venter’s involvement with writing topics such as self-imposed exile, estrangement between place and self, global displacement/non-belongingness and “exile as a discontinuous state of being” (Said: 2000: 177). One of the key insights Venter demonstrates in his writing, is that space, like identity, is not an essentialist concept, but an incomplete and diffuse construction that is constantly changing depending on socio-political interventions, international migration patterns and the individual's subjective perception of places. / Afrikaans and Theory of Literature / D. Summaries in English, Afrikaans and Southern Sotho / The aim of this study was to assess the suitability of International Financial Reporting Standards (IFRS) adoption in Ethiopia. To this effect, the study focused on examining the key factors that would influence IFRS adoption in the context of Ethiopia, namely economic growth, economic openness, capital market development, level of accounting education as well as legal systems and government policies. The study used a mixed-method approach, which involved a survey and content analysis. While the survey was the primary research approach in this study, the secondary data analysis was used to obtain additional evidence to corroborate the information gathered through the survey. Descriptive statistics was used to analyse and interpret the data. The study results show that the aforementioned factors examined were not conducive to adopting IFRS, and thus IFRS was not regarded as suitable in Ethiopia at the time of this study. The study also revealed an absence of a single set of accounting standards in Ethiopia. / Die doel van hierdie studie was om die geskiktheid van Internasionale Finansiële Verslagdoeningstandaarde-aanneming (IFRS-aanneming) in Ethiopië te assesseer. Die studie het derhalwe daarop gefokus om die sleutelfaktore te ondersoek wat die IFRS-aanneming in die konteks van Ethiopië sal beïnvloed, naamlik ekonomiese groei, ekonomiese oopheid, kapitaalmarkontwikkeling, vlak van rekeningkundeopvoeding, asook regstelsels en regeringsbeleide. An e-learning instructional design framework for mobile devices in Africa

English text, with summaries in English, Afrikaans and Zulu / This study aims to propose an e-learning framework for mobile devices in Africa to help improve enrolment rates and education standards in the FET (Further Education and Training) phase. The study is qualitative in nature and employs document analysis as main research method. An overview of the South African education context with supporting statistical data to motivate why an e-learning alternative is crucial for improving South African and African education is provided. The literature review includes a descriptive analysis of 7 existing e- and m-learning frameworks, with key features highlighted for possible adaptation or incorporation into an e-learning framework for Africa. Behaviourism, Constructivism and Connectivism are discussed as applicable learning theories to pedagogically underpin this proposed e-learning framework. Thereafter, a critical evaluation of current South African education policy documents (White Papers, the Norms and Standards for Educators and the Draft Policy for the Provision and Management of Learning Teaching and Support Materials) is conducted to determine whether these policies support and enable e-learning effectively. Part 2 of Chapter 5 comprises a critical analysis and comparison of education systems and applicable legislation in the USA, Finland and Malawi to establish how education is structured and how e-learning is administered in these countries to make relevant recommendations for South Africa and to inform the design of an e-learning framework for Africa. Research findings are presented as answers to the research questions posed and the proposed e-learning framework with further recommendations are presented to the South African Department of Basic Education, teachers and researchers. / Die doel van hierdie studie is om ‘n e-onderrig-en-leer raamwerk vir mobiele toestelle vir Afrika voor te stel, sodat inskrywingsgetalle en onderrig- en leerstandaarde in die Verdere Onderrig en Opleidings (VOO) fase verbeter kan word. External risks impacting on the scuba diving industry in the East African Marine Ecoregion

Abstract in English, Afrikaans and Sesotho / Scuba diving is a popular marine recreational activity along the eastern and southern coast of Africa. This region is characterised as the East African Marine Ecoregion (EAME) and is known for its richness in marine fauna and flora, including some of the Indian Ocean‟s most diverse and abundant coral reef ecosystems, making it a popular destination for scuba divers. The future of the scuba diving industry has come under threat as a result of environmental, social, political and economic impacts, and there is a need to better understand how these external risks impact on scuba diving tourism businesses in the EAME. Empirical evidence suggests that external risks, both international and domestic, have an effect on the tourism industry as a whole. However, limited research has been conducted on the impact of such external risks on the dive tourism industry specifically. Existing research has also focused extensively on environmental risks rather than on how external risks of a political, economic and social nature affect dive operator sustainability in the EAME. Most studies have also focused on the demand side (divers) as opposed to the supply side (dive operators). In addition, as dive tourists have greater flexibility to change their destination should risks arise, this threatens the success of dive operators in higher risk areas. To address these problems, the primary objective of the research undertaken sought to comprehensively identify the impact of external risks (environmental, economic, social and political) on dive operators in four countries within the EAME from a supply-side perspective. In order to achieve the primary objective, the following secondary objectives were achieved: 1. Identified scuba diving tourism operators in the EAME and their scope of operation. 2. Determined the external risks most relevant to dive operators in the EAME and assessed their level of impact. 3. Compared the individual external risks experienced by each of the countries in the EAME (Kenya, Tanzania, Mozambique and South Africa) using a cross-case analysis. 4. Assessed the perception of dive operators regarding whether external risks would influence a dive tourists decision to travel to the dive operators area of operation in the EAME ii The study consisted of two phases. Phase 1 comprised structured interviews with a select group of dive operators to gain insight into the external risks most prevalent in the scuba diving industry, as well as to assist in developing a quantitative structured survey (Phase 2), which was subsequently completed by dive operators in Kenya, Tanzania, Mozambique and South Africa. Data was imported into SPSS for quantitative statistical analysis. From the primary data collected, the major findings from this study determined that current economic and political risks have the greatest impact on dive operators in the EAME, and this trend is expected to continue. Environmental degradation of coral reefs, while not seen as a threat at present, constitutes a key threat for the near future. The greatest influences expressed in terms of risk categories impacting on dive tourism are domestic economic risks, international economic risks, domestic political risks and international political risks. A cross-case analysis conducted on the four countries concluded that external risks have varying effects within the different countries. Finally, the results indicated that external risks significantly influence a dive tourist's decision to travel to the EAME. By identifying and assessing the external risks that have an impact on dive operators in the EAME, this research contributes to knowledge on the dive tourism industry in the EAME, as well as dive tourism further afield and the wider field of tourism management. The study's findings create awareness of the effect that external risks have on dive operators in the region. A conceptual framework was developed which encompasses external risks in the scuba diving industry. Risk radars, risk maps and colour-coded tables were further outputs this study which can assist businesses, society and economies in responding to current and future threats and crises in a more informative and intuitive way. This can be achieved by implementing risk management strategies to mitigate or reduce exposure to external risks; strengthening stakeholder involvement along the tourism value chain; and stressing the need for government involvement towards the protection of the environment and promotion of small business growth in the region.
