Trust laws of Jersey and Malta : a civilian interpretationGalea, Patrick Joseph January 2016 (has links)
This thesis attempts to identify the philosophy, key questions and priorities behind the trust laws of Jersey and Malta. By wide accord, the Jersey law has served as a model in many ways to its later Maltese counterpart. This affinity is placed against the similar background of either jurisdiction, which embraced, to varying degrees, both the Civil Law tradition and Common Law influence. The analysis is advanced through the different moments of the trust, from its creation to termination. Nevertheless, the underpinning focus and thrust is on the civilian identity of either trust. It considers whether, and how far, the fundamental Civil Law concepts and language play a defining role in their civilian configuration. The question is asked whether the creation of the trust and the duties of a trustee can possibly be classified as obligational or contractual, or maybe something else. The nature and character of the beneficiary’s rights are also reviewed. The overarching role of good faith and civil responsibility, along with their extent of interaction with traditional Equity fiduciary duties, are weighed, an assessment naturally following from the civilian flavour attributed to the trusts. The conceptual overlapping between the Roman-Civil law fiducia, and related figures such as the mandat prêt-nom, with the Equity fiduciary duties, is assessed. The role, even if subsidiary, of civilian unjustified enrichment, remains an ever-present relevant factor. Sham trusts and simulatio, the Pauline fraud and legitim are considered in the context of the civilian identity of these trusts. The discussion then engages with the other strand of the thesis, being the role of the governing law, as the ‘mind’ behind the trust legislations assessed. The discussion engages with the question whether the trusts fall on the side of respect for the ‘autonomie de la volonté des parties’ or on other policy determinants behind the law.

O trabalho foi realizado de agosto a novembro de 2006, em uma propriedade leiteira no município de Pelotas - Região Sul do RS, com o objetivo de quantificar o efeito do uso de suplementação sobre a produção corrigida a 4%, a composição e a contagem de células somáticas (CCS) do leite, o peso vivo, o escore de condição corporal e o hematócrito de vacas Jersey, conduzidas em pastagem cultivada constituída por Avena strigosa (aveia preta), Lolium multiflorum (azévem anual) e Vicia sativa L. (ervilhaca). Para isto, foram utilizadas oito vacas da raça Jersey distribuído após estratificação por produção de leite, período de lactação e peso corporal em dois grupos homogêneos, num delineamento experimental completamente casualizado. Os dois grupos foram mantidos em piquetes separados em pastagens de azevém, aveia e ervilhaca por, utilizando um sistema de pastejo rotativo em faixas, com período de ocupação de um dia. Na caracterização dos tratamentos o grupo SUPL recebia diariamente 8 kg de suplemento e o grupo PAST não recebia nenhum tipo de suplemento. As medições de escore corporal e produção de leite e a amostragem para determinação da composição química (gordura, proteína, lactose e sólidos totais), CCS e hematócrito foram realizadas em avaliações quinzenais, procedendo-se controles leiteiros e coletas de amostras individuais dos animais. Os resultados evidenciaram diferenças significativas entre os dois tratamentos, para a variável condição de escore corporal, produção de leite corrigido a 4% de gordura, sólidos totais, gordura, proteína e CCS do leite indicando que a utilização do suplemento, permitiu a manutenção de percentuais mais elevados de sólidos, proteína e gordura do leite. / The work was performed from August to November of 2006 in Pelotas- country south region of RS, and aimed to quantify supplementation effect on themilk yield composition and the somatic cells count (SCC), body weight, body condition score and the hematocrito of Jersey cows, kept on cultivated pasture constituted by Avena strigosa (black oats), Lolium multiflorum (ryegrass) and Vicia sativa (common vetch). The results evidenciated significant differences between treatments, for body condition score, milk yeld, total solids, fat and crude protein and milk yeld.

The analysis of bank account statements to establish evidence of illicit financial activity is an established financial investigation methodology in countries such as the United States and the United Kingdom, but it is still in its infancy in South Africa. This is further highlighted by virtue of the fact that no uniform analysis methodology is used in South Africa for the analysis of bank account statements. The purpose of the research was to explore the role of such analysis, and the current practises in South Africa and New Jersey in the United States. This was to determine a practical model for the analysis of bank account statements in the South African context. Empirical research led to a proposed process model for such analysis, which was synthesised from current practises in South Africa and New Jersey in the United States. This model is proposed as the basis for the development of a uniform analysis methodology for the examination of bank account statements. / Die analise van bankrekeningstate om bewys van onwettige finasiële aktiwiteite te bepaal is 'n vasgestelde finansiële ondersoek metode in lande soos die Verenigde State en die Verenigde Koningkryk, maar in Suid-Afrika is dit steeds in die begin stadium. Dit is verder beklemtoon deur die feit dat daar geen eenvormige analise metode in Suid-Afrika in gebruik is vir die analise van bankrekeningstate. Die doel van die navorsing was om die rol van hierdie tipe analise, en die huidige praktyk in Suid-Afrika en New Jersey in die Verenigde State te bepaal. Dit was om 'n praktiese model vir die analise van bankrekeningstate in Suid-Afrika te bepaal. Empiriese navorsing het gelui tot 'n voorgestelde proses model vir hierdie tipe analise, wat 'n samesmelting van die huidige Suid-Afrikaanse en New Jersey in die Verenigde State praktyk is. Lucerne hay supplementation to Jersey cows grazing kikuyu/ryegrass pasturesMuller, Louise 09 November 2012 (has links)
During spring kikuyu-ryegrass pasture has a low dry matter (DM) content (10-12%), is highly digestible and has high levels of soluble carbohydrates. Low rumen pH values have been recorded for cows grazing these pastures even when supplemented with low levels of concentrate. The rumen environment and extent of rumination may therefore be sub-optimal. Supplementation of the pasture with dry roughage may improve rumination, the rumen environment and therefore also milk production performance. The aim of the study was to determine if strategic supplementation of lucerne hay will improve milk production, milk composition and the rumen environment of cows grazing high quality kikuyu/ryegrass during spring and receiving low levels of concentrate. Forty eight high producing Jersey cows were blocked and randomly allocated to one of the following treatments: control (no supplemental roughage), supplementation of 1.0 kg lucerne hay and supplementation of 2.0 kg lucerne hay after morning milking. Cows received 5 kg of dairy concentrate per day during milking. Cows grazed as one group and pasture was allocated to ensure a post grazing height of 10-12 on the rising plate meter (5-6 cm). The average post grazing pasture height for the experimental period was 10.83±1.68 (n=73) on the RPM (5.42 cm). There were no differences (P >0.10) between the treatments for 4% fat corrected milk production, which were 22.2 kg/d for the control, and 22.5 kg/d and 22.9 kg/d for the 1 kg and 2 kg lucerne treatments respectively. Milk fat and protein percentage was not affected (P >0.10) by supplementation of lucerne hay. The milk lactose content of cows receiving the control and 1 kg lucerne hay treatments were higher (P <0.05) than those of cows receiving the 2 kg lucerne hay treatment. Eight rumen cannulated Jersey cows were randomly allocated to either the control or the 2 kg lucerne hay treatment in a cross-over design. These cows grazed together with the cows of the production study and received the same dairy concentrate. Rumen pH was measured for 48 hours with 10 minute intervals using an automated pH logging system. Rumen samples were taken at 08:00, 14:00, 20:00 and 02:00 and were analysed for ammonia-nitrogen (NH3-N), volatile fatty acids (VFA) and pH. An in sacco study was conducted to determine DM and neutral detergent fibre (NDF) disappearance of ryegrass. There were no differences (P >0.10) between treatments in overall mean pH, measured with either the logging systems or with the portable pH meters averaging 6.18 and 6.11 for cows receiving the control and the 2 kg lucerne treatment respectively. The mean rumen NH3-N did not differ (P >0.10) between treatments. The mean concentration of acetic acid and the total VFA concentration was higher (P <0.05) for cows receiving the 2 kg lucerne treatment compared to the control. There were no differences (P >0.10) between treatments in the DM or NDF disappearance of ryegrass after 24 hours. Supplementation of lucerne hay to cows grazing well managed kikuyu-ryegrass pasture during spring did not improve milk production, milk composition, rumen pH or in situ NDF disappearance of ryegrass Results suggest that cows grazing kikuyu/ryegrass pastures supplemented with low levels of concentrate consume sufficient eNDF to maintain a favourable rumen environment and normal milk composition.
