Records in the Land Register This diploma thesis deals with the institute of records in the Land Register, which, due to Act No. 89/2012 Coll., the Civil Code, underwent numerous changes that needed to be reflected in legal regulation of the Land Register. At the time of writing this thesis, it has already been 6 years since the recodification of the Civil Code and changes associated therewith. Thus, it is possible to evaluate the legal regulation of records in the Land Register in its whole complexity. The thesis is divided in five parts that analyse different aspects of this legal institute. The first part of the diploma thesis outlines the historical evolution of the evidence of real estate itself for better understanding of current legal regulation. The second part of the thesis is focused on current legal regulation of the Land Register, its essential principles of holding the Register and extracts from the Land Register providing information about the state of real estate. The third part deals with the subject of evidence, as not all real property is being registered in the Land Register. Regardless the general description, the contentious part of the issue based on legal regulation is being involved in the description of each real estate as well. TŮMOVÁ, M., The town of Opočno in topographic sources of the 18. and 19. centuries, diploma thesis, The Faculty of Arts of Charles University in Prague, 2014, 191 p., 11 app. The topic of the diploma thesis is to capture the town of Opočno and its landscape in selected significant topographic sources of the 18th and 19th century. The main aim is to compare relevance and value of the selected significant sources and to assemble a picture of the town's landscape in the past. An introduction integrates the topic of the diploma into various historic regionality and covers a brief history and description of a state of the town of Opočno. The thesis is divided into several chapters according to the selected sources. We paid particular attention to cadastral documentation of the first Military Survey and to Stable cadaster that includes written and cartographical materials of the town. These sources are comparable because of the diverse time interval and the different purposes of origin. In order to provide thorough understanding of the studied sources and the region, the thesis includes picture elements, supplements and samples of historic and contemporary maps. The topic of this thesis is the return of the legal principle of superficies solo cedit into the Czech legal order. The thesis aims at the comprehensive overview and the analysis of the issue of this principle based on its inclusion both in the historical and contemporary context. Another objective of this thesis is to look at the registration of the principle, including related institutes, into the public register - the cadastre of real estates. This thesis is divided into three parts. The first part of this thesis follows the development of the superficial principle across the history, including the comparison of its use in given legal orders. This section begins with a glance at Roman private law and its selected institutes which have been incorporated into modern Czech private law by the reception of Roman law. The room will be also given to the law of the Habsburg monarchy and the provisions of the ABGB, civil code that has been valid on our territory until the 1950. The last chapters of this part are devoted to land law in the socialist Czechoslovakia and, in particular, to the 1964 Civil Code. The following section is the core chapter of this thesis. This thesis deals with the evaluation of land cover changes in twelve cadastral areas in the central part of the Bohemian Forest. This area was gradually abandoned due to political changes in the 20th century. For the purpose of this study, the historical Stabile Cadastre maps from 1837 and aerial photographs from 1949 and 2008 are used. The work follows both the development of the area as a whole and the development of the individual segments around the "Iron Curtain ", built after the World War II. Another aim of this work is to determine the spatial distribution of trees in an open countryside. Field data are supplemented with the features calculated from the digital elevation model and the distances of each species to man-made landscape elements present in the area around the time of displacement (aerial photos from 1949).

The aim of the diploma thesis is to find out and evaluate the influences affecting the price of building land in the city of Brno. The theoretical part of the thesis defines the concepts of laws relating to building land. Selected land is located in the city of Brno, which also analyzes the market of building plots. In addition, the aspects that influence the price of the building land in the valuation according to the price regulation are summarized. The analytical part is focused on the land to which the price data was published in the cadastre of real estate, which are then confronted with the valuation decree. In the end, the informations obtained are evaluated.

Zásady vedení katastru nemovitostí / Principles of the Land Register Keeping

This master’s thesis deals with the basic principles of the Land Register. It compares establishment of principles in the previous legal regulation in effect until the end of year 2013 with the new legislation effective from the 1st of January 2014, when the new Civil Code No. 89/2012 Coll. and the new Cadastral Law No. 256/2013 Coll. entered into force. The new Civil Code brings large changes in the recodification of private law. Some important changes are related to the topic of this thesis, it changes the definition of immovable property, expands the range of rights registered in the cadastre and significantly affects the principles of the Land Register. The thesis explains the principles and searches for the most significant changes brought by the new legislation. Furthermore the thesis also discusses the status of the property owner. So it focuses mainly on the principle of material publicity related to the protection of good faith. The conclusion summarizes the most important changes in legislation that significantly affected the principles of the Land Register and assurance of the correct acquisition of property rights.
