Přepracování katastrálního operátu v katastrálním území Zakřany / Creation of Digitalized Cadastral Map in Cadastral District Zakřany

This thesis deals with renewal of cadastral documentation in cadastral area of Zakřany. The area of interest is only the urban part of village of Zakřany. The documentation of non-urban areas was renewed based on complex land adjustment resulting in a digital cadastral map valid from October 8, 2012. In the urban area the original analog cadastral map in scale 1:2000 is still valid. This map was created based on results of technical-economical mapping in 1969. Parcels still registered in so called simplified register will be removed based on maps of former land cadastre. The result of the master's thesis will be draft of digital cadastral map created in MicroGEOS Nautil program.

The introductory part of the thesis deals with the overall issue of valuation, explaining the basic concepts that are necessary for the valuation. Then followed the analysis of market with the real estates and characteristic description of the specified location. For the purposes of the valuation was selected 10 real estates of type garage, which are valued at cost and comparative manner according to the announcement and comparative manner with the database. The real estates were selected around the city Protivin. A local investigation was carried out and the documentation was made for the each garage. The acquired data are evaluated and the result describes the effect of the location on the price of the property.

Subject of this thesis is the valuation of golf courses with the verification of possible application of Naegeli class method. The solution includes a description of individual objects located on golf courses used for this sport. Application of Naegeli class method will be carried out in both theoretical and practical way. Result will be compared with the use of other conventional valuation methods, eventually estimate as well. According to the achieved results, a standard expert valuation process using Naegeli class method will be proposed.

This dissertation deals wtih a problematice of easements of real estates in Czech Republic.The main goal of the dissertation is to estimate the value of considered easement and value of the family house burdened with the easements, consider and give reasons for possible devaluation of the real estate by making the easements. In the theoretical part are defined the terms connected with the real estate business, methods of valuation of the real estates and terms from land registry. Legislation of easements, methods and proceduresof valuation of easementsand valuationof real estates with easements follows. Practical part is about valuation of easements. Municipakl authority in Vyškov reallized construction of sewers in local parts Lhota and Rychtářov. The sewers goes through lands thats why the easements are established for the land owners. The easements are provided with conrtracts. The final part of the dissertation includes the summary and comparison of easements in 2011 and 2014, example of valuation of family house in local part Rychtářov and valuation of the influence of easement on the real estate.

The topic of the diploma thesis is the legal principle superficies solo cedit and its return into the Czech law. The main aim of this thesis was to give a comprehensive view of this issue, especially how the return of the principle has changed land law relations. The first part of the thesis describe the division of the law to private law and public law. The first part is followed by the historical excursion which describes how the principle originated and how and whether it was part of the legal order in the past. The next chapters of the thesis are the main part of the work and describes the principle in todays law. Firstly the incorporation of the principle into the Civil Code is described and then individual paragraphs governing the principle follows. The definition of the basic terms as land, construction and temporary construction which are used by Civil Code but not described in it are the topic of next chapter. Next, relatively extensive chapter named line constructions describes exceptions to the principle. The basic definition of exceptions can be found in the Civil Code but more detailed regulation is contained in public acts, therefore private and public law is intertwined in this area. There is an analog cadastral map scale 1:2 880 in the cadastre unit Vilantice currently. Review and completion of the positional point field was done by technology of global navigation satellite system and terrestrial methods. Result of this master`s thesis were the documentation of the review and completion of the positional point field, mapping sketches and vector file of a digital cadastral map.

Problematika dědického řízení v ČR / Problems associated with the Inheritance Procedure in the Czech Republic

This master dissertation (diploma) is committed to inheritance, inheritance law and inheritance with a focus on properties and also inheritance with international subject in the inheritance procedure. The goal of this work is to give sufficient information so that even the uninformed reader will know what is associated with inheritance, what are the basic terms from this area of law and also the questions of inheritance's inter-family relations because inheritance will be a subject everyone deals with eventually. The subject of this dissertation is inheritance throughout history to its current legal regulation. At the same time it is also mentioned inheritance as a change of ownership law and concepts that are related with this part of civil law. In the introduction is explained the terms of inheritance and inheritance law are explained with the view to the history of Roman law and to the Middle Ages. Next is an explanation of the basic law terms through to our current law regulation. There is also a focus on inheritance procedures including the change of the ownership rights and then will be the process of the registration of the ownership right to the real estate cadastre. With this topic is also connected a possibility of inheritance procedure with properties. At the end this work is included practices of case with international subject in the inheritance procedure. Because of the focus on the inheritance of properties, the last chapter is about the valuation of properties in the course of the inheritance procedure.
