THE PROTECTION AGAINST CORRUPTION AND BRIBERY AND THEIR PREVENTION The purpose of my thesis is to analyse basic instruments provided by the criminal law for investigation and prosecution of bribery and find out how they are applied in everyday practice within criminal proceeding. The main reason why I chose this topic is frequent complaining of the public, blaming the law enforcement authorities from dismal state of corruption in the Czech Republic. The motive was to find out whether these complaints are legitimate or the criminal law does not provide sufficient means for effective regulation of the corruption. The main aim of the thesis is therefore to answer the question, whether the instruments provided by the criminal law are sufficient for effective regulation of bribery and corruption in the Czech Republic. The thesis is composed of five chapters. Chapter one is devoted to the brief explanation of historical development of the phenomenon of corruption. Aim of this chapter is to show the issue of corruption as never-ending struggle which was present in the society since its very beginning. Chapter two is introductory and defines basic terminology. Title: Protection against corruption and bribery and their prevention Abstract My diploma thesis should describe the contemporary issues of corruption and then it should show us the differences between corruption and lobbying. After that I would like to focus on the current legislation which mentions corruption. Finally, I would highlight the necessity of prevention. Initially, I would try to define corruption, describe the origin reasons of corruption and its dividing. The next part of the first chapter includes the methods of measurement, which are used for taking an imagination about the extent of the corruption in this age. The following chapter describes lobbying and the other terms which belong to it. The main goal is an effort to distinguish the situation when it is still lobbying and the situation when the legal line of lobbying is already broke. The next chapter includes current legislation which concerns the problem of corruption. Because of the quite extensive legislation I try to focus on the regulation in the criminal law and in the business law. Dopady korupce a fiskálních úniků na vybraná odvětví ekonomiky / Impacts of corruption and fiscal evasion on selected sectors of the economy

Corruption is one of the most famous and also the most serious problems of the contemporary world. The aim of the processing of the dissertation is to create the actual characteristics of corruption and fiscal evasion, both from theoretical and practical point of view, specify their manifestations in economies of Georgia and Czech Republic in conditions of contemporary globalization, as well as to express the effects of corruption and fiscal evasion on selected sectors of the economy. The international organization Transparency International compared corruption in different countries based on the values of the Corruption Perception Index (CPI), which measures the degree of corruption perception from a subjective point of view. Every year the index captures the current view on corruption in the public sector and surveys used for the compilation include issues related to the misuse of public power for private benefit. The Czech Republic has 51 points and is on the 53th position in the rankings, right behind her at the 54th position ranked Slovakia with 50 points. This placement reflects very bad situation in the state administration, poor functioning of political parties and the lack of anti-corruption policy of the state. From the collected data and time series was concluded a conclusion about the high correlation and the correlated indicators of corruption CPI and GDP per capita in PPP. Although among the least corrupt countries in the world in 2014 ranks developed economies such as Denmark, New Zealand and Finland, less sophisticated Georgia was able to stay 50th position ahead of Czech Republic and Slovakia. It is due to the fact that with the advent of the Governments of President Saakashvili and Prime Minister Ivanishvili underwent a major reform of the state administration, including the security forces. This testifies to the fact that the underdevelopment of the economy is far from being the main factor for the elimination of corruption and fiscal evasion in a particular country. Reducing scope of tax evasions and departures of companies to tax havens are aims of the electronic records of sales and changes in the procurement system. Transparency of decisions on the allocation of public contracts should be solved and carry out an inspection utilization of public funds. Limitation of the influence of officials in the public service would undoubtedly help to eliminate small (petty) corruption. More than the total elimination of corruption endeavour currently states on its reduction or elimination of its consequences.

The problem of Czech society today is foremost the part of corruption that can be labeled as systemic, large scale or political corruption; and its causes, demonstrations, and therefore also possible solutions differ significantly from those for individual bribery. The public still holds very distorted opinions about the causes and therefore also possible solutions of large scale corruption. The most significant is the idea of political corruption as a personal ethical failure of an individual. The solution to this is their replacement. However, past experiences prove that political corruption is a systemic problem and replacement of individuals does not bring a substantial change. To understand how large scale political corruption functions, it is important to know the point of view of politicians who are its direct participants or encounter it. It is established that a significant motivational factor for corruption is an effort of politicians to keep their power and prestige, and with it the need of raising funds for re- election.
