Mediace v ČR / Mediation in the Czech Republic

Mediation in the Czech Republic Abstract This thesis follows mediation as one of the methods of alternative dispute resolutions in the Czech Republic. The adoption of Act No. 202/2012 Coll., on Mediation and Change of Some Laws, which set the conditions for the performance of mediation in noncriminal matters, represents an important milestone in the development of mediation in the territory of the Czech Republic. This thesis is focused on the mediation process; its main aim is to define the phases through which the mediation passes and also the rights and duties of the mediator, their characteristics and their theoretical basis. This thesis is structured into an introduction, four chapters and a conclusion. The first chapter introduces the concepts of mediation and the parties of the conflict, the development of mediation abroad and in the Czech Republic, also defines the types of mediation and the areas of its application, with an emphasis on family mediation. This chapter is also devoted to the relationship between mediation and court proceedings. The end of the opening chapter offers a list of the advantages and the disadvantages of using mediation for settling conflicts, comparing mediation with court proceedings in some aspects and justifying why mediation can be a more attractive alternative for...

The thesis deals with finding out how three companies in Brno solve conflicts in their work teams and their comparison and whether they use mediation as a tool for conflict resolution. Then the thesis deals with overall satisfaction of workers with working conditions in the company. The finding itself is preceded by a theoretical overview of conflict resolution. The findings were carried out by means of conflict analysis and by means of a primary survey for which the technique of questionnaire survey and in-depth interviews were chosen. Subsequently, the results are processed and described at the end of the thesis.

This thesis deals with alternatives to unconditional imprisonment. Since this is a very extensive topic, I have focused only on alternative sentences in the narrower sense of the term, namely conditional conviction, conditional conviction with supervision, house arrest, community service and financial punishment. The aim of this thesis is to analyse the Czech lawful legislation of alternatives to unconditional imprisonment, to compare it with selected French alternative sentences and to propose changes de lege ferenda. The thesis consists of an introduction, five chapters and a conclusion. The first chapter deals with the concept of punishment and its purpose. At the same time, this chapter outlines a general introduction to alternative punishments in Czech and French legislation. The second chapter deals with institutes related to restorative justice, namely probation and mediation. This chapter also describes the organisation of the Probation and Mediation Service. The third chapter focuses on individual Czech alternative punishments in the narrower sense. Individual subchapters are ordered according to the systematic of law. The diploma thesis considers a topic "conflict", on which it is focused within the scope of work environment in social organizations. In a theoretical part there is predominatingly dealing with different types of conflict. Hereafter about their development and a cycle. Consequently there are mentioned possible approaches to conflict solutions and methods for their solving. In theoretical part there are also described terms related to the conflict as mobbing, manipulation, etc. The empirical part represents the real presence of conflict and mobbing in chosen social organizations functioning in Příbram. Hereafter it is focused on awareness of organizations on such situations, especially on a importance of managers during their elimination, eventually process in terms of another development. An emphasis is placed on recording of those situations both from the view of employees and on the part of manager. On the basis of findings that the development in this area of managing, in surveyed organizations, is not sufficient, the useful recommendation were suggested and a new instrument, allowing easier understanding of conflict and also more successful work with it, was created.

EUROPEAN TRENDS IN JUDICIAL MEDIATION AND THEIR USE IN THE CZECH REPUBLIC Abstract This dissertation deals with the phenomenon of judicial mediation. In the first part, it defines the term of mediation as such and determines its essential and additional elements. Further, the text looks into the wide spectrum of cases in which this method of alternative dispute resolution can be applied. The author specifically points out that limiting its use to family matters is rather inappropriate. The following section systematically identifies the individual types, forms and methods of mediation so that each mediation can be customized for the respective case. Finally, the first part ends with a reflection on the current issues connected to criticism of mediation. These are the enforcement of international mediated settlement agreements, the potential conflict with access to justice and the binding nature as well as enforceability of mediation clauses including their stipulation in general terms and conditions. The second part is an analysis of the use of judicial mediation in selected European countries - Italy, Germany, the Netherlands, Poland, Slovenia and Spain. 1 Mediation as a Mean of International Commercial Dispute Resolution Abstract The subject of this dissertation is the topic of mediation in solving international commercial disputes. At the outset, the author focuses on the general theory of dispute and argues that the main psychological features of thinking about conflicts are inherent in virtually all types of social relations, regardless of their specific nature. It is therefore useful to recall the knowledge about the psychology of conflict in the context of research on the resolution of international commercial disputes, as this initial line of reasoning is also present. In the first part of the dissertation, the author defines the position of mediation within the spectrum of the dispute resolution and identifies its relationship with other ADR methods. She is particularly concerned with the recent change in the ADR area, particularly as regards the shift of arbitration towards judicial proceedings and convergence of mediation with arbitration in certain respects. The master's thesis Czech Radio Dvojka - building contact with the audience analyses the instruments, which is this station used to address listeners, respectively the recipients of media content. The thesis is based on the theoretical framework which is postulated by the sociologist John B. Thompson in the book The Media and Modernity, on his triad of interactions, which characterizes the effect of communication media. Whereas the first type "mediated quasi- interaction" characterizes unidirectional transmission of the radio station to a listener, the other two types - "mediated interaction" and "face to face interaction" characterize ways how the medium could overcome this unidirectional communication. Therefore this master's thesis analyses the selected programs of the station Czech Radio Dvojka, which represent these mentioned types. Thereafter the qualitative analysis analyses especially the instruments of moderators with use of the triple coding's type (open coding, axial coding, selective coding), because the moderators represent the station and substantially determine its communicative style. The theoretic part of my dissertation is devoted to the management by crisis and the integrated salvage system, their organization, single components and system of their management. Farther I occupy here with the chapter of supervision, namely with its function, course, role and position of supervisor and supervider. In the first part of my dissertation I mention a mediation and debriefing too as the possible options of supervision. The research objective in the practical part of my work is characterize the possibilities of a participation of supervisor or supervision into the system of the management by crisis. This part of my dissertation was worked up both by the quantitative and qualitative method. I have chosen data collection for the anonymous interrogatory. The workers of IZS in the South Bohemian Region formed the target group. 82 informants formed the total research set. The data processing was by the qualitative method by means of SWOT analysis. I surveyed two hypotheses. Hypothesis No.1 {--} The IZS workers have poor awareness of the supervision advantages and risk of its absence. In Hypothesis No.2 {--} I presumed that according to the IZS workers the supervision in the workplace is not important.

The number of divorced families has been continually increasing and the Czech society accepts such families with dependent children tolerantly. Nowadays we know that a family with both parents but full of violence is much worse for children than living with a single parent. Psychosocial development of children growing in incomplete families thus does not have to be marked negatively. Despite that, in most cases a breakdown of a marriage with children is perceived as a hard and frustrating situation. And all the involved parties need to cope, particularly with the failure and loss in their lives. The objective of the thesis was to map attitudes of workers of the department of social and legal protection of children, marriage and family counselors, crisis and emergency centers and other professionals to the divorce situation of families with children in school age. Partial objectives of the thesis included mapping of opinions of the workers about the shared custody, experience of professionals with family mediation and determination whether the professionals are offered possibilities of further education. The views of the professionals were collected by means of a questionnaire survey conducted in January, February and March. 415 questionnaires were distributed at random. The research group consisted of 99 returned questionnaires. The individual categories of professionals did not demonstrate any significant differences in their attitudes to the shared custody. Divorce mediation was viewed as a suitable method for resolution of family disputes. The research has also shown that the professional community is offered sufficient opportunities of further education. According to the responding professionals, incomplete (divorced) families are capable of ensuring successful development of the children. The professionals concurred particularly on the opinion that each divorce situation needs to be approached individually.
