Defendemos a vigência e aplicabilidade da Convenção 158 da OIT; o reconhecimento do artigo 7º, I, da Constituição Federal como direito fundamental de aplicação imediata, eficácia subjetiva e horizontal; e a incidência do princípio da função social do trabalho e da boa-fé objetiva e seus deveres anexos de conduta como dever de colaboração, lealdade, solidariedade e informação como fundamentos para a motivação patronal quando da rescisão contratual trabalhista.Decorrente desta hermenêutica, defendemos que não mais subsiste o direito potestativo de dispensar do empregador mas ao reverso, na ponderação entre livre iniciativa e propriedade privada versus valor social do trabalho, da propriedade e do contrato, dentre outros; a prevalência do direito fundamental do trabalhador à motivação de sua rescisão contratual.

Environmentální migrace v Ústeckém kraji: percepce životního prostředí a potenciální migrace / Environmental migration in the Ústí region: perception of the environment and potential migration

The diploma thesis analyses environmental migration, that is, the human migration as a result of environmental change. The aim of the thesis is to assess and explain this trend in the Ústí region in Czechia, a region with an extensive experience of environmentally induced migration due to the deteriorating conditions of the local environment. Special attention was paid to potential migration and the perception of the environment by young people aged 15-29 years. A questionnaire survey was used as the main research method, covering questions about the environment and migration (including the perception of the environment, migration motivation or the character and preference of potential migration). The results suggest, for example, that young people living in an area with deteriorated environment perceive it in a relatively positive way. Most importantly, environmental conditions are not the primary factor leading to the decision to migrate, but a secondary one. Economic factors are becoming more significant when choosing the ideal place to live, rather than non-economic factors. The articles were chosen in relation to the unauthorised Pussy Riot protest in the Cathedral in Moscow back in February 2012, and the societal changes that have taken place thereafter. The analysed articles have been written and published between February 2012 and January 2014. The aim with the study is to see how media sources from different geographical backgrounds described the same events and news.

Generalized Analytic Signal Construction and Modulation Analysis

This thesis deals with generalizations of the analytic signal (AS) construction proposed by Gabor. Functional extensions of the fractional Hilbert Transform (FrHT) are proposed using which families of analytic signals are obtained. The construction is further applied in the design of a secure communication scheme. A demodulation scheme is developed based on the generalized AS, motivated by perceptual experiments in binaural hearing. Demodulation is achieved using a signal and its arbitrary phase-shifted version which, in turn translated to demodulation using a pair of flat-top bandpass filters that form an FrHT parir. A new family of wavelets based on the popular Gammatone auditory model is proposed and is shown to lead to a good characterization of singularities/transients in a signal. Allied problems of computing smooth amplitude, phase, and frequency modulations from the AS. Construction of FrHT pair of wavelets, and temporal envelope fit of transient audio signals are also addressed.

De nos jours, la restructuration est une réalité incontournable qui contribue audéveloppement et à la compétitivité des sociétés in bonis. En général, elle résulte d’une décisionprise par les dirigeants sociaux. Toutefois, sa réalisation peut contrevenir à l’exécution des droits descréanciers antérieurs des sociétés concernées par l’opération. Pour préserver leurs droits, cescréanciers disposent de nombreuses mesures de protection issues aussi bien du droit commun quedu droit spécial. L’identification du fondement de cette protection, à savoir la force obligatoire desengagements pris avant la restructuration de la société débitrice, permet de vérifier l’efficacité decette protection. / Restructuring is a reality that contributes to the development and competitiveness ofcompanies in bonuses. It usually results from a decision taken by the companies executives. Itsimplementation, however, may undermine the enforcement of former creditors’ rights by thecompanies involved in the transaction. To preserve their claims, those creditors have manysafeguards from both the common law and the special law. The identification of the basis of suchprotection, namely the binding commitments made before the restructuring of the debtorcompanies, enable the verification of this protection’s effectiveness.

Belief in Karma and Political Attitudes

Many scholars have discussed the sociopolitical consequences of belief in karma but few have investigated such relationships quantitatively. This study aims to establish empirical patterns concerning the connection between karmic beliefs and attitudes related to (i) political ideology, (ii) ableism, and (iii) views on the death penalty. The study’s theoretical framework is based on a Weberian approach to the study of beliefs (viewing beliefs as having attitudinal implications) and the theory of motivated social cognition. It uses original survey data from an MTurk sample of 330 Indians, which is analyzed through a series of regression models. When using demographic variables as controls, karmic beliefs are shown to correlate significantly (p<0.001) with three conservative dispositions (status quo conservatism, laissez-faire conservatism, authoritarianism); political approval of the Hindu nationalist Bharatiya Janata Party; ideological self-placement; ableist attitudes, and with disapproval of the death penalty. Karmic beliefs are also shown to correlate significantly with social class, and with right-wing views across both social classes and castes. Given these findings, I argue that karmic beliefs are likely to affect various political outcomes in India via their role in shaping the moral and political frameworks of the Indian population.

UTILIZATION OF WIND POWER IN RWANDA : Design and Production Option

This Master Thesis is the research done in the country of Rwanda. The project leads to study the climate of this country in order to establish whether this climate could be used to produce energy from air and to implement the first wind turbine for serving the nation.   After an introduction about the historical background of wind power, the thesis work deals with assessment of wind energy potential of Rwanda in focusing of the most suitable place for wind power plants. The best location with annual mean wind speed, the rate of use of turbine with hub height for an annual production per year, the mean wind speeds for 6 sites of Rwanda based on ECMWF for climatic data for one year at relief of altitude of 100m and coordinates are reported too.   The result of energy produced and calculations were done based on power hitting wind turbine generator in order to calculate Kinetic energy and power available at the best location to the measurement over the period of 12 months, that could be hoped for long term.   With help of logarithmic law, where wind speed usually increases with increasing in elevation and the desired wind speeds at all 6 sites were used. The annual energy production was taken into account at the best site with desired wind speed at the initial cost of turbine as well as the cost of energy (COE).However, with comparison of the tariff of EWSA, the price of Wind designed in this Research per kWh is cheaper and suitable for people of Rwanda. / <p><em>Rwanda has considerable opportunities development energy from hydro sources, methane gas, solar and peat deposits. Most of these energy sources have not been fully exploited, such as solar, wind and geothermal. As such wood is still being the major source of energy for 94 per cent of the population and imported petroleum products consume more than 40 per cent of foreign exchange. Energy is a key component of the Rwandan economy. It is thus recognized that the current inadequate and expensive energy supply constitutes a limiting factor to sustainable development. Rwanda’s Vision 2020 emphasizes the need for economic growth, private investment and economic transformation supported by a reliable and affordable energy supply as a key factor for the development process. To achieve this transformation, the country will need to increase energy production and diversify into alternative energy sources. Rwandan nations don’t have small-scale solar, wind, and geothermal devices in operation providing energy to urban and rural areas. These types of energy production are especially useful in remote locations because of the excessive cost of transporting electricity from large-scale power plants. The application of renewable energy technology has the potential to alleviate many of the problems that face the people of Rwanda every day, especially if done so in a sustainable manner that prioritizes human rights.</em></p>
