A produção desjudicializada da prova oral através de negócio processual: análise jurídica e econômica

Through a deductive method, the research confirms that the hypothesis follows the cooperative procedural model and the combination of two general rules found in the procedural statutes: one that allows the parties to celebrate procedural contracts on their procedural positions;; and the one that authorizes them to produce atypical evidence. The extrajudicial production of the oral evidences directly by the parties and without the participation of the judge, made possible when transaction costs allow and the balance between the benefits and disadvantages is better than when compared to the judicial model, is an efficient option to reduce the duration of proceedings, to stimulate settlement of disputes by agreement, to prevent litigation and to improve the quality of evidence / A presente tese versa sobre análise jurídica e econômica do negócio processual para a produção da prova oral fora do judiciário e sem a participação direta do juiz, permitindo-­lhes apresentar depoimentos escritos ou gravados de testemunhas. Por meio de método dedutivo, a pesquisa confirma que essa hipótese decorre do modelo cooperativo de processo e da combinação de duas cláusulas gerais previstas na legislação processual: a que possibilita às partes convencionar sobre situações processuais;; e a que lhes autoriza produzir provas atípicas. A produção da prova oral, diretamente pelas partes e sem a participação do juiz -­ viabilizada quando os custos de transação assim permitirem e o saldo entre os benefícios e desvantagens for melhor quando comparado ao modelo judicial -­, é opção eficiente para reduzir o tempo de duração dos processos, estimular a resolução dos litígios por acordo, prevenir litígios e aperfeiçoar a qualidade das provas
