Regulation of slavery in current international law Abstract: This diploma thesis deals with the adjustment of slavery in international law at present. Although slavery could seem like an extinct institute at present, the opposite is true. Slavery is developing more than ever before. But it does not appear in its traditional forms. Detection is much more demanding. The aim of this thesis is to provide a comprehensive overview of international regulation of slavery and evaluate efficiency of this regulation including control mechanisms, which are enshrined in various treaties. The first part is dedicated to the prohibition of slavery as a peremptory norm. I deal with individual characters which peremtory norm has to fulfill and then derive inclusion of slavery as a peremptory norm. The other part is focused on the definition of criteria which will be used to study individual conventions. These criteria are relevant to the assessment whether specific conventions and their control mechanisms are effective. The main part of the thesis is the part in which I am focusing on the definition of conventions which regulate the slavery. The work deals with the system of slavery in ancient Israel. The first part describes the history of this country and development of its society including specific categories of slaves that used to be part of it. It deals with the houshold slaves in the possession of their owners, as well as slaves-for-debts. In connection with a debt slavery the thesis also elaborates on the Old Testament Israel loan system. The next part concerns a detailed analysis of various regulations for treating slaves, which are divided according to the particular books of the Old Testament where they can be found. The results are then summarized in the conclusion.

Forced Labour in the Czech Republic Abstract The submitted dissertation thesis examines so far neglected issue of forced labour in the Czech Republic in its complexity, i.e. both its lawful (e.g. work performed by imprisoned persons) and unlawful forms. It seeks to discover whether the present law (and extra-legal regulation) on this topic is sufficient. For this purpose it examines not only the corresponding law across individual branches of law, but also its place in the historical and moral- philosophical context. In the first parts, the submitted thesis deals with the existence of free will as a precondition of considering a work freely chosen and with the existence and content of objective morality as a precondition of considering anything morally right. Special attention is dedicated to forced labour during Protectorate and communist regime in Czechoslovakia. This master‘s thesis focuses on the issue of trafficking in persons in Thailand in the period of 2002-2017. The thesis answers research questions about the causes, size and consequences of trafficking in the country, as well as the impact of trafficking on the country’s security situation. The work presents approaches to assesing trafficking in persons and explores the most common forms of exploitation. The thesis also focuses on trafficking in persons within the Association of Southeast Asian Nations (ASEAN), of which Thailand is a member. The 3P index will be used to gain some deeper understanding of the situation in Thailand and to compare selected ASEAN countries. Due to the specificity of data collecting the thesis uses among literature particularly the reports about trafficking in persons from the US Department of State and other reports from international organizations dealing with this issues and which regularly monitor the situation.

When observing the values which repeatedly appear in early American literature, we encounter ideas such as liberty, freedom, or the importance of the individual, but while property and ownership are often also core ideas and motivations for many Americans, their appearance is much more limited and excluded from certain contexts. However, property was always a key issue and economic profitability was always considered as foremost both on political and individual level. This can be seen all throughout American history since its beginning until the present, yet there is the curious trend of downplaying the importance of property in politically oriented text. While no one questioned its value in the past, Americans outwardly replaced property with liberty. Nevertheless, its importance cannot be hidden so easily and through careful examination it is shown as being understood as a pre-requisite of freedom and security, even as it is never the central focus of any major early American political text. 1 COMPARISON OF CERTAIN ASPECTS OF LEGAL REGULATION OF SLAVERY AND ITS ABOLITION IN THE USA AND IN GREAT BRITAIN Resumé This thesis deals with legal regulation of slavery in Great Britain and the United states of America and also with its abolition. The first part of the thesis is theoretical. At the beginning, it describes the concepts of "slavery", "slave society" and "abolition". This is followed by the brief history of slavery, from the ancient society, through the Middle Ages, to slavery in North America. The end of this chapter briefly discusses the legal aspects of slavery in general, and the influence of the Enlightenment and Christianity on the perception of slavery. The second part focuses on situation in various geographic regions and some legal phenomena relating to slavery. The regions covered include England, specific for fact that slavery was abandoned there as early as in the 12th century and has never had any legislative background, together with India and the Caribbean as two examples of the opposite ends of the spectrum - while in the Caribbean slavery still constitutes a determining social element, in India the effects of slavery are surprisingly "negligible". in English The aim of this MA thesis is to bring new perspectives on the genre of the African-American slave narrative. Therefore, its wider historical, socio-political and gender contexts are considered and the circumstances surrounding its development and current criticism are briefly outlined. The point of departure is a discussion of definitions that vary among the scholars who select different criteria for the subject of definition. The existing diversity of the texts and voices is discussed in connection to Moses Grandy's Narrative of the Life of Moses Grandy, Late a Slave in the United States of America. Grandy's narrative, an account of the maritime slave life, is analyzed. Its traditional, uniform narrative structures are juxtaposed with passages where some aspects of his masculine identity, problematized by the institution of slavery, can be traced. Ultimately, the thesis attempts to show that while the conventionalized framework pre-defining the narrative outline and themes is delineated by James Olney, any generally recognized definition of the genre does not exist. 81 Abstract This thesis argues that motherhood as depicted in Toni Morrison's novels Song of Solomon, Beloved and A Mercy is a site of female empowerment. Its emancipating potential is set against the context of slavery and patriarchy found in the narratives and shows how mothers are able to resist oppressive structures and secure their children's well-being. Slavery practices severed family ties and caused its dismemberment by separating parents from their children. In the novels under study the recovery of those ties happens in an imaginative re-writing of history. Mother figures, such as Beloved's Sethe, come to terms with the re-embodiment of a painful familial past and deal with its traumatizing effects to be able to renounce it and move on. Others like Song of Solomon's Pilate cling to their past and act as mediators between the community's history and its descendants. A re-writing of history is urgent for African American writers and peoples who share slavery pasts, and who thus need to deal with their lasting legacies in the present. Motherhood is thus identified in several recurring patterns. Toni Morrison describes physical aspects of mothering from the point of view of the mother and uses the female body as a life-giving source that cancels the objectification of female slave bodies....

1 Abstract Slavery and its modern aspects This diploma thesis deals with the current and controversial topic. Aim of this thesis is to put attention to the speeches, forms and incredible frequency of modern slavery - phenomenon that would be at first glance wrongly seen as just historical issue. First chapter of the thesis speaks about historical excursion of slavery. Because of the limited scope is history focused on the main areas of ancient Greece and Rome, the area of the American continent with its huge business of African slaves, the period of Second World War and finally on the brief history at Czech territory. After the historical chapter is focus stressed on theoretical presentation of the problem - the nature of this phenomenon. Slavery is especially considered as part of International Guardianship of Human Rights. Theoretical part is followed by examples of most frequent real forms of modern slavery. This thesis is concerned with literature connected with the abolition of slavery in British colonies. The thesis will treat the topic of the abolitionist movement from the perspective of social, cultural and literary history from the beginnings until the abolition of slavery in British colonies in the Caribbean in 1833 with the Slavery Abolition Act. The thesis will focus on the discourse of race and slavery. The chosen authors represent different opinions and perspectives as the discussion will focus on sentimental poetry, travel writings as well as slave narratives. The chief aim is to identify and define the strategies of abolitionist discourse and the rhetorical practices which it employed especially in shaping the image of Africans and how the hegemonic discourse of sentimentalism influenced their writing.
