The central task in this study is to discover and analyse the legal framework applicable to input errors in electronic contracts. The study analyses the law of South Africa, the Electronic Communications and Transactions Act 25 of 2002 (hereinafter referred to as the ECT Act) to be more specific, and the United Nations Convention on the Use of Electronic Communications in International Contracts (2005) (hereinafter referred to as the UNECIC).
The ECT Act is the statute regulating electronic communications and transactions in South Africa. It was passed by the South African parliament in 2002. Almost all provisions of the ECT Act are based on the United Nations Model Law on Electronic Commerce (1996) .However, section 20 thereof, which deals with input errors, was not based on the Model law, but on provisions from statutes of leading jurisdictions.1
The UNECIC is a new international convention by the United Nations Commission on International Trade Law (hereinafter referred to as UNCITRAL). The Convention came into operation on the 1st of March 2013,2 and is the first United Nations convention that deals with electronic communications. Article 12 thereof deals with automated transactions, and section 14 with input errors. These are the two provisions that shall be analysed in relation to the UNECIC in this work.
With the UNECIC having come into full operation, there is a real need to harmonise domestic laws with it. In various jurisdictions, including Singapore3 and Australia,4 the statutes governing electronic communications have been amended with some provisions of the UNECIC. Article 14 is one of the provisions of the UNECIC which have been domesticated in both jurisdictions. Judged against the UNECIC, a number of issues relating to input errors in the ECT Act are inconsistent with the new international standards embodied in the UNECIC. Evaluating reasoning heuristics for a hybrid theorem proving platformAckermann, Jacobus Gideon 06 1900 (has links)
Text in English with abstracts in English, Afrikaans and isiZulu / The formalisation of first-order logic and axiomatic set theory in the first half of the 20th century—along with the advent of the digital computer—paved the way for the development of automated theorem proving. In the 1950s, the automation of proof developed from proving elementary geometric problems and finding direct proofs for problems in Principia Mathematica by means of simple, human-oriented rules of inference. A major advance in the field of automated theorem proving occurred in 1965, with the formulation of the resolution inference mechanism. Today, powerful Satisfiability Modulo Theories (SMT) provers combine SAT solvers with sophisticated knowledge from various problem domains to prove increasingly complex theorems.
The combinatorial explosion of the search space is viewed as one of the major challenges to progress in the field of automated theorem proving. Pioneers from the 1950s and 1960s have already identified the need for heuristics to guide the proof search effort.
Despite theoretical advances in automated reasoning and technological advances in computing, the size of the search space remains problematic when increasingly complex proofs are attempted. Today, heuristics are still useful and necessary to discharge complex proof obligations.
In 2000, a number of heuristics was developed to aid the resolution-based prover OTTER in finding proofs for set-theoretic problems. The applicability of these heuristics to next-generation theorem provers were evaluated in 2009. The provers Vampire and Gandalf required respectively 90% and 80% of the applicable OTTER heuristics.
This dissertation investigates the applicability of the OTTER heuristics to theorem proving in the hybrid theorem proving environment Rodin—a system modelling tool suite for the Event-B formal method. We show that only 2 of the 10 applicable OTTER heuristics were useful when discharging proof obligations in Rodin. Even though we argue that the OTTER heuristics were largely ineffective when applied to Rodin proofs, heuristics were still needed when proof obligations could not be discharged automatically. Therefore, we
propose a number of our own heuristics targeted at theorem proving in the Rodin tool suite. / Die formalisering van eerste-orde-logika en aksiomatiese versamelingsteorie in die eerste helfte van die 20ste eeu, tesame met die koms van die digitale rekenaar, het die weg vir die ontwikkeling van geoutomatiseerde bewysvoering gebaan. Spoken language identification in resource-scarce environmentsPeche, Marius 24 August 2010 (has links)
South Africa has eleven official languages, ten of which are considered “resource-scarce”. For these languages, even basic linguistic resources required for the development of speech technology systems can be difficult or impossible to obtain. In this thesis, the process of developing Spoken Language Identification (S-LID) systems in resource-scarce environments is investigated. A Parallel Phoneme Recognition followed by Language Modeling (PPR-LM) architecture is utilized and three specific scenarios are investigated: (1) incomplete resources, including the lack of audio transcriptions and/or pronunciation dictionaries; (2) inconsistent resources, including the use of speech corpora that are unmatched with regard to domain or channel characteristics; and (3) poor quality resources, such as wrongly labeled or poorly transcribed data. Each situation is analysed, techniques defined to mitigate the effect of limited or poor quality resources, and the effectiveness of these techniques evaluated experimentally. Techniques evaluated include the development of orthographic tokenizers, bootstrapping of transcriptions, filtering of low quality audio, diarization and channel normalization techniques, and the human verification of miss-classified utterances. The knowledge gained from this research is used to develop the first S-LID system able to distinguish between all South African languages. The system performs well, able to differentiate among the eleven languages with an accuracy of above 67%, and among the six primary South African language families with an accuracy of higher than 80%, on segments of speech of between 2s and 10s in length. Tegnieke wat ontwikkel word sluit die ontwikkeling van ortografiese ontleders, die outomatiese ontwikkeling van nuwe transkripsies, die filtrering van swak kwaliteit klank-data, klank-verdeling en kanaal normalisering tegnieke, en menslike verifikasie van verkeerd geklassifiseerde uitsprake in. Die kennis wat deur hierdie navorsing bekom word, word gebruik om die eerste Gesproke Taal Identifisering stelsel wat tussen al die tale van Suid-Afrika kan onderskei, te ontwikkel. Hierdie stelsel vaar relatief goed, en kan die elf tale met ‘n akkuraatheid van meer as 67% identifiseer. Indien daar op die ses taal families gefokus word, verbeter die persentasie tot meer as 80% vir segmente wat tussen 2 en 10 sekondes lank. The use of temporary employment services as a means to achieve flexibility in die labour market led to various complications due to a lack of proper regulation. The atypical formation of the triangular employment relationship, limited rights and less favourable employment conditions of the temporary employees, multiple authority figures and their liabilities under various circumstances and the impact thereof on such employee’ collective bargaining rights caused legal uncertainty in the absence of sufficient legislation to govern it. Temporary employment agencies developed certain methods in order to evade the restrictive labour legislation and employer duties imposed on them, namely by making use of automatic termination clauses (resolutive conditions) and by categorising the temporary employee as an independent contractor. Last mentioned would effectively exclude the temporary employee from labour legislation and the protection it provides.
In reaction to abovementioned problems, trade unions have been objecting to the use of temporary employment agencies and went as far as demanding the total ban thereof. This raised the question in the South African Government whether said agencies should indeed be banned. The other option is a less restrictive approach and entails the attempt to regulate these agencies by amending the current labour legislation in order to accommodate temporary employment services. In light of the fact that various proposals to amend the current South African labour legislation (especially with regard to temporary employment services) have been published in the Government Gazette, it can be deduced that the social partners ultimately chose to regulate temporary employment agencies rather than ban them altogether.
From an early stage the International Labour Organisation (ILO) provided rules and regulations for the management of employment agencies in general by way of conventions and recommendations. In 1997, in order to give effect to the labour standards identified by it, the ILO brought the Private Employment Agencies Convention into existence. This document could be applied to all temporary employment agencies on an international level. This document provides for administrative regulations, the duties of the agency and the client as well as the rights of the temporary employees concerned. The ILO recommends that all of its member states incorporate the principles contained within this document in their own legislation.
Temporary employment services are also used in other legal systems. For purposes of this study, the English law (United Kingdom (UK)) and the Namibian law will be scrutinised. Similar issues to those recognised in the South African law have been identified in these countries. However, each has approached said problems in different ways. The Namibian Government banned the conducting and provision of these services by way of legislation in 2007. The constitutionality of the ban has however been questioned by the Supreme Court of Namibia, after which it had been found to infringe upon the fundamental freedom to carry on any business, trade or occupation. The ban was struck down as unconstitutional. The Namibian Government has since promulgated new legislation in which it removed the ban and replaced it with numerous amendments providing for the regulation of temporary employment services.
Since 1973 the UK has been promulgating various instruments for the thorough regulation of temporary employment agencies. These instruments provide for the management of temporary employment agencies and the rights of the employees involved. The relevant legislative instruments have been updated regularly with the purpose of ensuring that the needs of all the parties concerned are met. The UK, as a member state of the European Union (EU), (which has also been providing for the regulation of temporary employment services in various directives), promulgated legislation specifically with the aim to give effect to the principles in the mentioned directives. By way of doctrines and the creation of a third category ―worker‖ the UK has been attempting to prevent any loopholes in their legal system with regard to temporary employment services and the rights of the employees involved.
The aim of this study is to investigate all the important complications experienced with temporary employment agencies in order to indicate the impact the atypical circumstances have on the rights of the temporary employees. The degree to which, if at all, the South African law complies with the preferred labour standards identified by the ILO will be pointed out. A comparative study will be conducted, first by ascertaining in detail how the comparable issues in the UK and Namibian law are dealt with, and second by identifying which aspects in these legal systems could be of value to the South African law. Finally the potential effectiveness of the proposed amendments to the South African labour legislation will be analysed, during which recommendations for the unresolved issues will be provided. adolessente-fase, bring by baie adolessente depressiewe gevoelens mee. Ten spyte van hierdie
omstandighede is daar egter ook baie adolessente wat hierdie fase van ontwikkeling sonder enige
noemenswaardige probleme deurloop.
Aaron Beck is van mening dat dit nie die omstandighede opsigself is wat tot depressie aanleiding
gee nie, maar wel die betekenis wat individue aan omstandighede gee. Beck noem dat depressiewe
persone tot irrasionele oortuigings, foutiewe inligting-prosessering en disfunksionele outomatiese
gedagtes geneig is.
Om hierdie probleem aan te spreek is ses adolessente, wat subkliniese depressie ervaar, aan Beck se
kognitiewe terapie onderwerp. Die primere doel van Beck se terapie is die regstelling van
bogenoemde disfunksionele kognisies.

Aaron Beck is of opinion that it is not the circumstances in and of itself that lead to depression but

people are inclined to irrational beliefs, erroneous information-processing and dysfunctional
automatic thoughts.
To address this problem, six adolescents who experience subclinical depression, were subjected to
Beck's cognitive therapy. The primary target of Beck's therapy is the correction of above
mentioned dysfunctional cognitions.
The conclusion is that when the dysfunctional cognitions of adolescents who experience subclinical

Text in Afrikaans / Uit 'n literatuurstudie en empiriese ondersoek wat onderneem is, blyk dit dat 15-40% van alle
adolessente subkliniese depressie ervaar. Veranderinge en toenemende druk en eise eie aan die
adolessente-fase, bring by baie adolessente depressiewe gevoelens mee. Ten spyte van hierdie
omstandighede is daar egter ook baie adolessente wat hierdie fase van ontwikkeling sonder enige
noemenswaardige probleme deurloop.
Aaron Beck is van mening dat dit nie die omstandighede opsigself is wat tot depressie aanleiding
gee nie, maar wel die betekenis wat individue aan omstandighede gee. Beck noem dat depressiewe
persone tot irrasionele oortuigings, foutiewe inligting-prosessering en disfunksionele outomatiese
gedagtes geneig is.
Om hierdie probleem aan te spreek is ses adolessente, wat subkliniese depressie ervaar, aan Beck se
kognitiewe terapie onderwerp. Die primere doel van Beck se terapie is die regstelling van
bogenoemde disfunksionele kognisies.
