A Content Analysis of the Counseling Sessions of Dyads with Breast and Prostate Cancer: Linguistic Predictors of Psychosocial Adjustment and Thematic Analysis of Key Concerns

The purpose of this investigation was to explore how participants' language use during counseling (overall emotional expression, positive emotional expression, and communal coping, or "we-talk") was associated with superior adjustment, as measured by four psychosocial outcome variables (depression, positive affect, negative affect, and relationship satisfaction); as well as to identify the key concerns of dyads with cancer, how concerns differed by role and sex, and if they were associated with participants' well-being. The present study was a content analysis of the counseling sessions of 43 dyads (N = 86) with breast and prostate cancer. Using a multi-method approach, the audio recordings of 228 counseling sessions were transcribed and analyzed linguistically (quantitatively) and thematically (qualitatively).Results of the linguistic analyses revealed that participant's use of "we-talk" had the most consistent and beneficial effect on outcomes; specifically improved depression, negative affect, and relationship satisfaction. These findings suggest that it might not be as important how much a person expresses themselves emotionally, but rather, whether they have a close relational partner that they see as an instrumental part of their coping process and significantly intertwined in their life, which is reflected in their language use of communal coping.Results of the thematic analyses revealed that survivors' concerns were more focused on cancer and treatment related issues, whereas partners' concerns centered on the well-being of their spouse/partner with cancer, and what they were doing to help their loved one cope with his/her illness. The overarching key concern that was intertwined in participants' discourse was frequent discussion of relationship maintenance, negotiation, and communication issues. In addition, discussion of these concerns showed greatest benefits for women with breast cancer.The findings of this study has implications for counselors and clinicians in that language use and topics discussed during counseling have the potential to increase psychosocial adjustment for dyads coping with cancer. The general discourse of survivors mirrored that of their partners, which indicates that helping to modify or change how one person speaks, has the potential to influence how their partner talks as well; which has implications for the well-being of both dyad members.

Le processus d'adaptation de conjoints dont la femme est atteinte d'un cancer de l'ovaire

Le but de cette étude est de cerner, à partir de leur propre point de vue, la trajectoire d’adaptation de conjoints dont l’épouse est atteinte d’un cancer de l’ovaire. Une approche qualitative, la théorisation ancrée, a été utilisée dans le cadre de cette recherche. Les données ont été recueillies à l’aide d'entretiens semi-structurés effectués auprès de neuf conjoints qui accompagnaient leur épouse lors de leurs traitements dans une unité montréalaise ultra-spécialisée de soins pour les cancers gynécologiques. Nos résultats font ressortir qu’une fois passé le choc de l’annonce du diagnostic, nos répondants se ressaisissent et élaborent toute une série de stratégies de protection pour leur épouse et eux-mêmes, puis d’attaque de la maladie. Au bilan, pour eux, le cancer se révèle une expérience « transformante» aux plans personnel, conjugal et social. Les contrastes observés entre nos résultats et ceux des études antérieures, qui insistent sur le désarroi de conjoints, peuvent être expliqués par la prise en charge efficace de la femme par le réseau de la santé, qui valorise le rôle du conjoint et qui l’outille pour accompagner son épouse. S’ajoutent à cela la force du lien conjugal, trempé par les épreuves passées, certains traits de personnalité des conjoints et l'action du réseau de soutien personnel. En regard de la pratique infirmière, notre recherche met en évidence le bien-fondé des politiques soutenant l’intégration des familles dans les plans de soins et les retombées positives d’une approche concertée entre tous les intervenants de la santé. Répéter une telle étude dans d'autres institutions du réseau de la santé permettrait de cerner encore plus finement son impact sur l’adaptation de conjoints à la maladie. / This research focuses on how nine men recall their adaptation trajectory to their spouses’ ovarian cancer. The qualitative analysis made use of the grounded theory approach; semistructured interviews were conducted with husbands accompanying their spouses during their treatments in an ultra-specialized unit for gynaecological cancers in a Montreal hospital. Our results show that after the initial shock initiated by the announcement, the respondents develop a set of strategies, first to protect their wives and themselves, and then to attack the illness. Accompanying their wives through the experience of cancer proves to be, for the husbands, a transformative experience at all levels: personal,conjugal, and social. The perceived efficacy of the health network and its preoccupation with the husband’s caretaker role may explain the sharp contrast we observe between results from the literature, insisting on the husbands’ helplessness in such a context, and our data, which underline their fighting spirit. Other factors identified are the strength of the conjugal link, forged in common ordeals, personality traits of both husbands and wives, and support from their personal network. Concerning nursing practice, this research suggests that the importance and the support given by the health professionals to the family caregivers is of utmost importance for the couple’s quality of life throughout this experience. Besides, the coordination of the health professionals, throughout the women’s illness, is crucial in diminishing the anxiety linked to the cancer diagnosis. The duplication of such a study in other cancer care units would allow a finer analysis of the impact the health network can have on the adaptation of both spouses to illness.

Cartographie du réseau d'interactions protéiques de la machinerie de transcription dans les cellules humaines

Les protéines sont les macromolécules les plus polyvalentes de la cellule. Elles jouent un rôle fondamental dans la majorité des processus biologiques à travers la formation de complexes multi-protéiques. Durant la transcription, une multitude de facteurs sont impliquées dans le contrôle de l’activité des complexes ARN polymérases. Notre laboratoire s’est intéressé au réseau d’interaction de la machinerie de transcription des ARN polymérases nucléaires, dans le but de mieux comprendre leurs mécanismes de régulation. Pour ce faire, une procédure protéomique comprenant la purification de complexes protéiques par affinité couplée à la spectrométrie de masse et à l’analyse bioinformatique a été développée. La méthode de purification TAP (Tandem Affinity Purification) a été adaptée pour permettre la purification de complexes protéiques solubles assemblés in vivo à partir de cellules humaines. L’objectif de mon projet de maîtrise était de purifier le complexe de l’ARN Pol I ainsi que de poursuivre l’expansion du réseau d’interactions protéine-protéine de la machinerie de transcription de l’ARN Pol II humaine. À l’aide des protéines POLR1E, TWISTNB, POLR2E, PFDN4, MBD2, XPA, CAND1 et PDCD5 étiquetées (TAP-tag) exprimées dans des lignées cellulaires ECR-293, plusieurs complexes protéiques solubles ont été purifiés et analysés par spectrométrie de masse. Les interactions protéiques ont été triées et validées bioinformatiquement pour donner en final une liste d’interactions ayant un haut degré de confiance à partir de laquelle des réseaux d’interactions protéine-protéine ont été créés. Le réseau créé au cours de ce projet connecte plusieurs composantes de la machinerie transcriptionnelle tels que les ARN Pol I, II et III, les complexes RPAP3/R2TP/prefoldin-like, TRiC/CCT, Mi-2/NuRD et des facteurs de transcription et de réparation de l’ADN. Ce type d’analyse nous a permis d’identifier et de caractériser de nouveaux régulateurs de la machinerie de transcription de l’ARN Pol I et II et de mieux comprendre son fonctionnement. / Proteins are the most versatile macromolecules of the cell. They play a fundamental role in the majority of biological processes through the formation of multiprotein complexes. During transcription, a multitude of factors are involved in the control of activity of RNA polymerases. Our laboratory was interested in defining the nuclear RNA polymerases transcription machinery interaction network to better understand their regulatory mechanisms. To do so, a proteomic procedure that allows affinity purification of protein complexes coupled to mass spectrometry and computational data analysis was developed. The tandem affinity purification procedure has been adapted for the purification of soluble protein complexes as they likely exist in live mammalian cells. The aim of my master project was to purify the RNA Pol I complex as well as to further pursue the expansion of the protein-protein interaction network of the human RNA Pol II transcription machinery. By using POLR1E, TWISTNB, POLR2E, PFDN4, MBD2, XPA, CAND1 and PDCD5 TAP – tagged proteins expressed in EcR-293 cell lines, multiple soluble protein complexes were purified and analyzed by mass spectrometry. Protein interactions have been sorted and validated computationally. High-confidence dataset of interactions were used to build the protein-protein interaction networks. The network created for this project connects several components of the transcriptional machinery such as RNA Pol I, II and III, RPAP3/R2TP/prefoldin-like, TRiC/CTC, Mi-2/NuRD complexes and DNA repair and transcription factors. This type of analysis allowed us to identify and characterize new regulators of RNA Pol I and II transcription machinery and to better understand its functioning.

Exploring the Social Determinants of Sexually Transmitted Disease and High-Risk Sexual Behaviors

Abstract 1: A multi-level assessment of disproportionate population sex ratios and high-risk sexual behaviors among STD clinic patients Low male-to-female sex ratios in a population may influence high-risk sexual behaviors, such as multiple sex partners and inconsistent condom use, which facilitate the transmission of STDs. This study used multi-level modeling to assess whether population sex ratios were associated with these two individual-level behaviors. All analyses were stratified by gender. Interview data were collected from patients (N = 9,203, 48% male) attending participating STD clinics. Interviews included information on socio-demographics and sexual behavior, including number of sex partners in the previous 3 months and condom use at last sex. The sex ratio per census tract was obtained from the U.S. Census Bureau. There was no association between sex ratio and multiple sex partners or condom use for either men or women. That is, we found no evidence that a shortage of men in census tracts was associated with increased engagement in high-risk sexual behavior.   Abstract 2: A multi-level assessment of neighborhood vacancy rates and high-risk sexual behaviors among STD clinic patients The “broken windows” theory posits that physical neighborhood deterioration, and its association with reduced social cohesion, can lead to changes in individual behaviors. Thus individuals living in neighborhoods with high levels of deterioration may be more likely to engage in high-risk sexual behaviors. This study used multi-level modeling to evaluate the extent to which high residential vacancy rates increased the likelihood of individuals having multiple sex partners. Interview data, including data on patient demographics and sexual behaviors, were collected from patients (N = 6,347, 52% male) attending participating STD clinics in the Richmond, Virginia area from 2008-2010. Neighborhood vacancy rates were obtained from the U.S. Census Bureau. Fifty-one percent of men and 36% of women reported having 2 or more sex partners in the previous 3 months. Men who lived in census tracts with high vacancy rates were slightly more likely to report multiple sex partners (53.9%) compared to men who lived in low vacancy tracts (49.7%). In multi-level models, there was no association between high vacancy rates and having multiple sex partners among either women (OR = 0.98; 95% CI: 0.79, 1.20) or men (1.18; 95% CI: 0.99, 1.42). That is, we found no evidence that increased neighborhood deterioration, as measured by high residential vacancy rates, was associated with increased risk of having multiple sex partners among STD clinic patients.   Abstract 3: Residential segregation and gonorrhea rates in U.S. metropolitan statistical areas The residential segregation of black populations, often in areas of high economic disadvantage and low social status, may play a crucial role in the observed racial inequities in STD rates. An ecological analysis of 2005-2009 average gonorrhea rates was performed across 277 U.S. metropolitan statistical areas (MSAs). The black isolation index and Gini index of income inequality were used as proxy measures for racial and economic residential segregation respectively, derived from 2005-2009 U.S. Census estimates. We used logistic regression modeling to produce estimates of odds ratios (OR) and 95% confidence intervals (CI) for the association between a high black isolation index and Gini index, both independently and in combination, on gonorrhea rates in MSAs. Effect measure modification was assessed by calculating the relative excess risk due to interaction (RERI) between the two indices. Compared to MSAs with low levels of racial segregation, MSAs with high levels of racial segregation had increased odds of high gonorrhea rates (adjusted OR 5.54; 95% CI: 2.29-13.44). Adjustment for potential confounders did not noticeably impact the relationship between the Gini index and gonorrhea, with higher levels of income inequality predicting higher gonorrhea rates (adjusted OR = 2.47; 95% CI: 1.21-5.03). In combined models, the influence of racial residential segregation on gonorrhea rates was stronger than that of income inequality-based segregation; there was no evidence of additivity or a multiplicative interaction. Residential segregation by race or income equality may be a key component in the perpetuation of high rates of gonorrhea and other STDs among black populations in the U.S.

Étude d'un nouveau facteur impliqué dans la biosynthèse de la paroi bactérienne : le facteur ElyC

La résistance bactérienne aux antibiotiques est de nos jours une préoccupation majeure aux acteurs du monde de la santé publique. L’identification de nouvelles cibles bactériennes en vue de développer de nouveaux antibiotiques est donc nécessaire. La paroi bactérienne est une bonne cible car l’inhibition de sa biosynthèse cause la mort des bactéries. De récents travaux de notre laboratoire ont identifié de nombreux nouveaux facteurs importants pour la biosynthèse de la paroi chez Escherichia coli. L’un de ces facteurs renommé ElyC a un domaine DUF218 extrêmement conservé à travers les espèces bactériennes. L’absence du gène elyC entraîne la lyse bactérienne à température pièce. Des études bioinformatiques indiquent qu’ElyC est une protéine membranaire avec deux domaines transmembranaires et un domaine conservé DUF218 de fonction inconnue. Étant donné que les protéines agissent souvent en complexes, nous avons émis l’hypothèse qu’ElyC interagit avec d’autres protéines afin d'exécuter sa fonction biologique. Le but de mon projet est de déterminer la topologie d’ElyC et d’identifier ses partenaires protéiques. L’étude de la topologie a été faite par l’essai de modification de cystéine sur des souches exprimant individuellement le facteur ElyC avec un résidu cystéine en position N-terminale, dans la boucle ou en position C-terminale. Les partenaires protéiques d’ElyC ont été isolés par immuno-précipitation et identifiés par spectrométrie de masse. Les résultats obtenus ont révélé qu’ElyC est une protéine membranaire chez E. coli et est impliquée dans l'assemblage de l'enveloppe bactérienne, dans la chaîne de transport d'électrons et la phosphorylation oxydative. Ils ont permis aussi de confirmer l’existence d’un lien entre ElyC et le stress oxydatif. Cependant les résultats pour la détermination de la topologie restent à être clarifiés. / Bacterial resistance to antibiotics is a major concern for public health. The identification of new bacterial targets for the development of new antibiotics is required. The bacterial cell wall is a good target because the inhibition of its biosynthesis causes the death of bacterial cells. Recent studies from our laboratory have identified many new important factors for cell wall biosynthesis in Escherichia coli. One of these factors renamed ElyC has a DUF218 domain highly conserved across bacterial species. The absence of elyC leads to bacterial lysis at room temperature. Bioinformatic studies indicate that ElyC is a membrane protein with two transmembrane domains and a conserved domain of unknown function DUF218. Given that proteins often act in complexes, we formulated the hypothesis that ElyC interacts with other proteins to play its biological role. The goal of my project is to determine the topology of ElyC and identify its protein partners. The study of the topology has been done by the cysteine modification assay with strains individually expressing ElyC with a cysteine residue at the N-terminal position, in the loop or at the C-terminal position. ElyC protein partners have been isolated by immuno-precipitation and identified by mass spectrometry. The results obtained revealed that ElyC is a membrane protein in E. coli and that it is involved in the bacterial envelope assembling, in the electron transport chain and in the oxidative phosphorylation. They also confirmed the existence of a link between ElyC and oxidative stress. However, the results for the determination of the topology remain to be clarified.

O companheiro na qualidade de herdeiro necessário e seu direito à legítima / The partner as a necessary heir and his right to legitime

Esta tese tem por objeto o estudo do direito sucessório dos companheiros na união estável, tema que, cada vez mais, tem despertado grande interesse da sociedade. O ser humano, em decorrência de sua falibilidade e suscetibilidade a doenças, ferimentos e velhice, está sujeito à morte, fim inexorável de sua existência. A pessoa fenece, enquanto seus bens remanescem, sendo transmitidos a seus herdeiros, legítimos ou testamentários, e legatários. A sucessão legítima é aquela que se dá de acordo com a ordem preferencial estabelecida na lei; a testamentária, a que ocorre de acordo com a declaração de última vontade do falecido, expressa em testamento. Os herdeiros legítimos podem ser necessários ou facultativos: estes podem ser afastados da herança pelo fato de o falecido dispor de seus bens sem contemplá-los; aqueles, entretanto, não podem ser privados de parcela mínima da herança, a que têm direito, chamada de legítima, a não ser que sejam excluídos da sucessão por ato de indignidade ou deserdados pelo testador, em decorrência de ato atentatório à sua pessoa, nas hipóteses previstas em lei. O Código Civil de 2002 modificou profundamente a sucessão decorrente dos vínculos conjugal e convivencial. O cônjuge passou a concorrer não só com os descendentes do autor da herança, dependendo do regime de bens, mas também com os ascendentes, neste caso independentemente do estatuto patrimonial adotado. Ademais, foi elevado à categoria de herdeiro necessário, à qual antes só pertenciam os descendentes e ascendentes do de cujus. O companheiro supérstite, por outro lado, não foi declarado expressamente herdeiro necessário, embora também concorra à herança com os descendentes e ascendentes do morto. A presente pesquisa examina a posição sucessória daqueles que vivem em união estável, considerada entidade familiar pela Constituição da República Federativa do Brasil, em contraste com a sucessão do cônjuge, a fim de perscrutar, por meio de ampla investigação bibliográfica, legal e jurisprudencial, se o companheiro deve ou não ser considerado herdeiro necessário, do que dependerá seu direito à legítima. / The objective of this thesis is to examine succession law in connection with common law marriage (stable union), an issue that has garnered increasing public attention. Due to their intrinsic fallibility and vulnerability to disease, injury, and old age, human beings are subject to death, to the inexorable end of their existence. Yet while human beings are destined to meet their end, their property and assets remain behind, transferred to their heirs, either legitimate or testamentary, and legatees. Legitimate succession is based on the order of preference, as prescribed in law; testamentary succession is based on a statement of last wishes by the deceased, as expressed in a will. Legitimate heirs may be necessary or optional: although the latter may be left out of the inheritance by the deceased upon disposition of his or her property and assets, the former may not be deprived of a minimum share of the inheritance, to which they have a right, also known as legitime, unless they are excluded as a consequence of an act of indignity or disinherited by the testator by virtue of an offense against such person, as provided for by law. The 2002 Brazilian Civil Code significantly modified succession for cases of marriage and cohabitation. The spouse may now claim a share of the inheritance alongside the testators descendants, depending on the particular marital property system applied, and ascendants as well, in this case irrespective of the specific property division system invoked. In addition, spouses are now classified as necessary heirs, a category previously reserved for descendants and ascendants of the deceased. However, the Civil Code does not expressly include surviving partners as necessary heirs, although they are entitled to claim a share of the inheritance alongside the ascendants and descendants of the deceased. This study considers the succession rights of individuals in common law marriage, considered a family entity under the Constitution of the Federative Republic of Brazil, in contrast to spousal succession, with a view to examining, through a detailed investigation of the existing legal literature and jurisprudence, if partners should or should not be deemed necessary heirs, a determination on which their right to legitime largely depends.

A dissertação examina o regime jurídico do direito de retirada de sócios de sociedade simples e de sociedade limitada a partir da vigência do CC/2002. Para tanto, parte do estudo de sua natureza jurídica e de uma releitura dos fundamentos jurídicos deste instituto. Serve-se, ainda, de considerações sobre a evolução histórica do direito de retirada tanto no direito nacional quanto em ordenamentos estrangeiros (Alemanha, Espanha, França, Itália e Portugal). Assume especial relevo neste percurso o tratamento dado ao direito de retirada de sócio de sociedade limitada e a construção pela doutrina e pela jurisprudência do instituto da dissolução parcial stricto sensu sob a vigência do Decreto n° 3.708/1919 e do Código Comercial de 1850, respectivamente. Com base nos pressupostos acima, a dissertação passa a abordar de forma pormenorizada o direito de retirada de sócios de sociedade simples e sociedade limitada previsto no CC/2002, identificando as hipóteses em que é legalmente autorizada e aprofundando-se no exame do seu regime jurídico em cada tipo societário. Por fim, analisando as hipóteses de dissolução total de sociedades previstas pelo CC/2002, procura definir se e em quais hipóteses o instituto da dissolução parcial stricto sensu ainda é aplicável. / This dissertation examines the legal framework of the right of partners to withdraw from a simple company (sociedade simples) and from a limited liability company (sociedade limitada) under the current Brazilian Civil Code (CC/2002). For such purposes, the dissertation starts by studying its legal nature and revisits its legal basis. It also considers the historical development of the right to withdraw under Brazilian law and that of certain other jurisdictions (Germany, Spain, France, Italy and Portugal). In the context of this historical analysis, it assumes special importance the right of partners to withdraw from a limited liability company (sociedade limitada) and the doctrinal and case law creation of the institute of partial dissolution (dissolução parcial stricto sensu) under Decree No 3,708/1919 and the Commercial Code of 1850, respectively. Having regard such review, the dissertation addresses, in detail, the right of partners to withdraw from a simple company (sociedade simples) and a limited liability company (sociedade limitada), as contemplated by the current Brazilian Civil Code (CC/2002), thereby also identifying when the same is authorized in each type of corporate vehicle and each applicable legal framework. Finally, by analyzing the scenarios for dissolution of companies contemplated by the current Brazilian Civil Code (CC/2002), it seeks to identify whether and in which scenarios the partial dissolution (dissolução parcial stricto sensu) is still applicable.

Tenue à Barcelone les 27-28 novembre 1995, la Conférence euro-méditerranéenne des ministres des Affaires étrangères a marqué le début d’un Partenariat nouveau entre l’Union européenne, ses 15 Etats membres (désormais 27 Etats membres) et leurs 12 Partenaires Méditerranéens (désormais 10). Ce Partenariat comprend une coopération bilatérale (conclusion d’un accord d’association qui couvre les trois objectifs fixés par la Déclaration de Barcelone entre l’Union européenne et chaque pays partenaire), d’une part, une coopération régionale, d’autre part. Le Partenariat euro-méditerranéen repose sur la conviction commune qu’il est souhaitable de développer une politique globale axée sur l’association étroite, dans un large éventail de domaines présentant un intérêt commun, du fait de la proximité des deux régions. La Déclaration de Barcelone, adoptée lors de la Conférence de Barcelone, a établi les trois objectifs essentiels du Partenariat : 1- la définition d’un espace euro-méditerranéen de paix et de stabilité par le renforcement du dialogue politique et de sécurité (partenariat politique et de sécurité) ; 2- le rapprochement entre les peuples au moyen d’un partenariat social, culturel et humain qui vise à favoriser la compréhension des cultures et les échanges entre les sociétés civiles (partenariat social, culturel et humain) ; 3- la construction d’une zone de prospérité partagée et l’instauration d’une zone de libre-échange (partenariat économique et financier), fondée sur l’économie de marché et l’initiative privée dans le respect des règles de l’Organisation Mondiale du Commerce. La mise en place de la zone de libre-échange prévoit l’élimination des barrières douanières (et des taxes d’effet équivalent) et de toute entrave à la libre circulation des marchandises entre les pays de l’Union européenne et les pays du sud et de l’est de la Méditerranée. Or, dans le cadre du Partenariat euro-méditerranéen, les pays arabes partenaires sont confrontés à la nécessaire conciliation de deux impératifs majeurs : -d’une part, la demande sociale, liée à l’exigence du développement économique, entraîne un fort besoin de recettes publiques ; d’autre part, le désarmement tarifaire, résultant de l’instauration progressive de la zone de libre-échange euro-méditerranéenne, se traduit par une baisse significative de recettes douanières et entraîne de ce fait la nécessité de mobiliser plus largement la fiscalité interne. Quels sont les défis auxquels les partenaires arabes méditerranéens sont désormais confrontés en matière de finances publiques ? Du Processus de Barcelone, découle une nécessaire prise de conscience par les Etats arabes méditerranéens de l’exigence d’une réforme de leurs finances publiques. / Held in Barcelona November on 27 and 28 1995, the euro-Mediterranean Conference of ministers of Foreign Affairs marked the kick-off of a new Partnership between the European Union, its 15 member states (from now on 27 member states) and their 12 Mediterranean Partners (from now on 10). This Partnership includes on the one hand a bilateral cooperation (conclusion of an association agreement which covers the three objectives set out in the Barcelona Declaration between the European Union and each partner country), on the other hand, a regional cooperation. The euro-Mediterranean Partnership is founded on the mutual recognition of the value of developing a comprehensive policy of close association in a large number of sectors of common interest resulting from the proximity of the two regions. The Barcelona Declaration, adopted at the Barcelona Conference, has established the three key objectives of the Partnership : 1- the definition of a euro-Mediterranean area of peace and stability by strengthening the policy dialogue and the security (political and security partnership) ; 2- the rapprochement of peoples by means of a social, cultural and human partnership which aims at promoting understanding between cultures and exchanges between civil societies (social, cultural and human partnership) ; 3 – the creation of an area of shared prosperity and the establishment of free-trade area (economic and financial partnership), based on the market economy and private initiative in line with World Trade Organization standards. The establishment of a free trade area provides for the elimination of customs barriers (and of equivalent effect taxes) and of any obstacle to the free movement of goods between the European Union countries and South and East Mediterranean countries. However, in the framework of the euro-Mediterranean Partnership, the Arab partners countries are confronted with the necessary conciliation of two majors imperatives : - on the one hand, the social demand, linked to the requirement of economic development, involves a strong need for public receipts ; - in addition, tariff dismantling, resulting from the progressive establishment of a euro-Mediterranean free trade area, results in a significant decrease in the customs returns and thus caused the need to mobilize more broadly the internal taxation. So what about the economic and financial dimension and the underlying public financial implications of the Partnership ? What are the public finance challenges facing Arab Mediterranean partners ? Arising from Barcelona process, the necessary awareness by member states of the need for their public finances reforms.

According to this approach, the way we choose our reproductive partners is based on the different selective pressures our ancestors had to face during the evolutionary process of natural and sexual selection, as well as on the view that each one of us represent products in a market of desirable attributes that are more or less available in different potential partners. Our sample was composed of students from the two largest Universities in Goiânia, with a total of 422 subject, most of them having 18-25 years of age. Each subject answered a questionnaire about his/her own characteristics (sex, age, financial situation, etc) and to questions about how important are 10 characteristics of a potential partner in two situations: ideal partner (no restrictions of points), and with a restriction of points (lesser power of choice). The results were consistent with those presented in previous studies, where beauty was more valued by male subjects, and characteristics linked to a good provider by female subjects. These characteristics also gained value for long term relationships when the subject had less power to choose (budget restriction). / Nosso estudo levou em consideração previsões da psicologia evolucionista, associada com a teoria de valor de mercado, para estudar como homens e mulheres escolhem seus parceiros. De acordo com esta abordagem nossa forma de escolher parceiros está embasada nas diferentes pressões que nossos antepassados sofreram durante o processo de seleção natural e sexual, como também pela visão que cada um de nós representamos produtos de troca e associação, no mercado de atributos disponíveis e desejáveis de potenciais parceiro. Testamos hipóteses já estudadas em outras culturas, como também em Goiânia-GO, onde já havia sido realizado outro estudo semelhante, porém estudamos também o efeito da restrição orçamentária (pouco poder de escolha) na forma com que homens e mulheres valorizam diferentes características de seus parceiros. Nossa amostra foi composta por universitários das duas maiores instituições de ensino superior de Goiânia, com um total de 422 sujeitos, a maioria na faixa etária de 18-25 anos. Cada sujeito respondeu um questionário sobre suas características (sexo, idade, poder aquisitivo, etc), além de perguntas sobre o grau de importância de 10 características de um possível parceiro em duas situações: parceiro ideal (sem restrição de pontos), e com restrição de pontos (pouco poder de escolha). Os resultados foram consistentes com estudos anteriores, onde as características corpo bonito e rosto bonito sobressaíram para o gênero masculino, e o padrão de bom provedor sobressaiu para o padrão feminino. Estas características também tiveram um acréscimo como atributos valorizados para relacionamento em longo prazo quando o poder de escolha era menor (restrição de pontos).

Os mútuos dos sócios e acionistas na falência das sociedades limitadas e anônimas / The loans of partners and shareholders in the bankruptcy proceedings of limited liability partnerships and corporations

Este trabalho propõe-se a analisar os mútuos como direitos creditórios dos sócios das sociedades limitadas e dos acionistas das sociedades anônimas na legislação nacional e o tratamento dado pela legislação falimentar brasileira a esses direitos de crédito, à luz dos mesmos conceitos existentes no Direito Comparado, especificamente na Alemanha e nos Estados Unidos da América. A eleição dos referidos dois países para a análise do Direito alienígena justifica-se porque: (i) a Lei de Insolvência Alemã (Insolvenzordnung InsO), de 5.10.1994, em vigor desde 1.1.1999 e editada em substituição à antiga legislação datada de 1877, que previa os institutos da falência e concordata de forma muito semelhante ao sistema falimentar brasileiro do Decreto-lei nº 7.661, de 21.6.1945 (Decreto-lei 7.661/45), veio a regulamentar os institutos da recuperação e liquidação de empresas, com objetivos também muito semelhantes aos da Lei nº 11.101, de 9.2.2005 (Lei de Recuperação de Empresas e Falências), tendo ainda passado por recente reforma em novembro de 2008; (ii) o Bankruptcy Code, que compõe o Título 11 do United States Code, em vigor desde a reforma inserida no sistema concursal norte-americano por meio do Bankruptcy Reform Act of 1978, foi utilizado como base para muitos dos dispositivos da Lei de Recuperação de Empresas e Falências, seja quanto ao instituto da recuperação extrajudicial, da recuperação judicial ou da falência. Para o estudo do Direito Comparado elegeu-se, assim, um país do direito continental, com legislação bastante avançada e aproximada da nossa; e um país do common law, que foi pioneiro em vários aspectos do direito falimentar, sobretudo na concepção de reorganização de empresas em crise, tendo sua legislação servido de modelo para diversos outros países, além de para o Brasil. Os tipos de sociedades eleitos - sociedades anônimas e limitadas - justificam-se por serem os tipos societários mais utilizados no Brasil e, resguardadas algumas características específicas que assumem em cada ordenamento jurídico, pode-se dizer que são os tipos societários mais utilizados mundialmente; seja sob a denominação, respectivamente, de limited liability partnership e corporation, nos Estados Unidos da América; Gesellschaft mit beschränkter Haftung (GmbH) e Aktiengesellschaft (AktG), na Alemanha; e denominações diversas em outros países. O trabalho (i) busca a intersecção dos seguintes temas: direitos creditórios dos sócios das sociedades limitadas e dos acionistas das sociedades anônimas, direitos patrimoniais dos sócios das sociedades limitadas e dos acionistas das sociedades anônimas, capital social, subcapitalização e, finalmente, direitos creditórios dos sócios e acionistas na falência das sociedades limitadas e anônimas, dentre estes especialmente os contratos de mútuo entre sócios ou acionistas e a sociedade falida; e (ii) estuda os mencionados temas à luz do Direito pátrio e do Direito comparado. Com base nos conceitos acima, este trabalho pretende contribuir para a interpretação das normas que dispõem sobre os direitos creditórios dos sócios e acionistas na falência das sociedades limitas e anônimas, tendo por princípio a adequação da cifra do capital social à realização do objeto social (em oposição à subcapitalização das sociedades), e visando à concessão de crédito, sobretudo mútuos, à prestação de serviços e ao fornecimento de bens à sociedade por seus próprios sócios e acionistas, estes na qualidade de terceiros perante a sociedade, respeitando-se o princípio da separação da personalidade jurídica. / The purpose of this study is to analyze loans as credits rights of partners of limited liability partnerships (sociedades limitadas) and shareholders of corporations (sociedades anônimas) under Brazilian law and the treatment granted by the Brazilian bankruptcy law to those credits rights, in view of the same concepts existing under foreign Law, specifically in Germany and in the United States of America. Both countries were chosen for the analysis of the foreign Law due to the facts that: (i) the Insolvency German Law (Insolvenzordnung InsO), as of 10.5.1994, in effect since 1.1.1999 and edited to replace the former legislation of 1877, which foresaw the bankruptcy and concordata institutes in a very similar way to the Brazilian bankruptcy system of Decree-law No. 7.661, of 6.21.1945 (Decree-law 7.661/45), came into force to regulate the institutes of business reorganization and liquidation of companies, also with similar objectives to the ones of the Law No. 11.101, of 2.9.2005 (Business Reorganization and Bankruptcy Law), having passed through a recent reform in November 2008; (ii) the Bankruptcy Code, which composes Title 11 of the United States Code, in effect since the reform brought into effect in the North-American bankruptcy system by means of the Bankruptcy Reform Act of 1978, and which has been used as basis for many rules of the Brazilian Business Reorganization and Bankruptcy Law, regarding the institutes of out-of-court business reorganization, judicial business reorganization and bankruptcy. Thus, for the study of the foreign Law, two countries were elected: one of continental right, with a very advanced legislation and very similar to ours; and the other of common law, pioneer in many aspects of the bankruptcy law, especially with regard to the concept of business reorganization of companies in financial distress, having its legislation as standard for many other countries besides Brazil. The types of companies corporations (sociedades anônimas) and limited liability partnerships (limitadas) were chosen due to the fact that they are the corporate types more used under Brazilian law and, besides some specific features that they assume under each legal system, some may say that they are the corporate types more used worldwide being nominated, respectively, as limited liability partnership and corporation, in the United States of America, or Gesellschaft mit beschränkter Haftung (GmbH) and Aktiengesellschaft (AktG) in Germany; or with other nominations in other countries. This study (i) searches the intersection of the following subjects: credits rights of partners of limited liability partnerships (sociedades limitadas) and shareholders of corporations (sociedades anônimas), patrimonial rights of partners of limited liability partnerships (sociedades limitadas) and shareholders of corporations (sociedades anônimas), corporate capital, undercapitalization/thin-capitalization and, finally, credits rights of partners of limited liability partnerships (sociedades limitadas) and shareholders of corporations (sociedades anônimas) in bankruptcy proceedings, especially with regard to loans granted by partners or shareholders to the bankrupt company; and (ii) studies the referred subjects in view of the national Law and the foreign Law. With basis on the concepts referred above, the study intends to contribute with the interpretation of the rules about credits rights of partners and shareholders in bankruptcy proceedings of limited liability partnerships (sociedades limitadas) and corporations (sociedades anônimas), having as principle the adequacy of the amount of the corporate capital to the accomplishment of the corporate subject (opposed to the undercapitalization of companies), and aiming the granting of credit, the granting of services and the supply of goods to the company by its own partners or shareholders in the capacity of third parties before the company, in accordance with the principle of separation of the corporate entity from its partners or shareholders.
