Problematika soudnictví v trestním řízení nad mládeží / The issue of juvenile criminal justice

Salmonová, Tereza January 2013 (has links)
This thesis mainly deals with the procedures concerning the youth and children under fifteen years old, including the procedural status of subjects according to Act No. 218/2003 Coll. Youth on liability for unlawful acts of Juvenile Justice and amending certain acts (Act on Juvenile Justice), but the Act No. 40/2009 Coll., Penal Code. Introduction of this thesis is the historical development, both within Austria-Hungary or the Czech Republic after 2003. Its cross section is the interpretation of certain key concepts and principles that are essential to the interpretation and practical application of the Act itself. The chapter on the Institute diversions could not be omitted in this thesis. Using detours is still a new phenomenon for Czech criminal law and in the practice of law is still used less (unlike the penalties associated with imprisonment). It is mentioned both in the general characteristics of control over juveniles and children under fifteen years old, protection of private adolescents with an emphasis on the provision of information in cases, where the perpetrator or victim of the offense is a person under the age of fifteen years old. Here the emphasis is on whether such a procedure does not violate the constitutional right to a public hearing. The thesis is also devoted to the...

Autonomie vůle v soukromém právu / Autonomy of will in private law

Schubertová, Zuzana January 2013 (has links)
68 Abstract The principle of autonomy of will is a fundamental principle of private law. It is impossible to imagine the functioning of private law without it. The principle is primarily based on the principles of equality and freedom, the key principles on which the foundations of a democratic legal system and free society are built. The aim of my thesis is to define the autonomy of will, compare the principle of autonomy of will with other fundamental doctrines and principles from which it arises and/or principles which are closely related to. I believe that most of the legal relationships based on private law are founded on the principle of autonomy of will, therefore, I decided to describe some of these institutes in more detail in my dissertation as well. The thesis is divided into a general part and a specific part. In the general part I deal predominantly with the inclusion of the principle of autonomy of will into the principles of private law. This part also contains some theoretical concepts and is closely linked to constitutional law, the Bill of Fundamental Rights and Freedoms and the principles on which the Civil Code is built. I further deal with the interpretation of certain terms, then the principle of autonomy of will itself and how it is perceived by several authors. In addition to that, I...

Práva a povinnosti osob zúčastněných na správě daní ve vztahu k základním zásadám správy daní / Rights and Duties of Persons Participating in Administration of Taxes in Relation to Basic Principles of Tax Administration

Lebeda, Alan January 2016 (has links)
The present diploma thesis is focused on the analysis and the assessment of the state of the art of legal regulations of rights and duties of the persons who participate in the administration of taxes in relation to basic principles of tax administration. The core legal regulation which is relevant for the theme under study is the tax rules that comprise a basic survey of principles applicable by the entities of the administration of taxes in practice. The tax rules is thus a main source of the findings for the enforcement of individual as well as partial rights and duties by tax payers and third persons that participate in the administration of taxes, and at the same time it determines the scope of the powers of the administrator of the tax which he administers against these. Basic principles of tax administration, together with the other legal principles which could also be applied at the administration of taxes, are main principles of the tax procedural law, for which they have significant importance in the form of constitutionally and legally regulated correctives. In contrast to the previous legal regulation contained in the Act to Administer Taxes and Charges, better systematization of principles, and consequently more effective use in contact especially of tax payers with the tax...

Constraints on the adoption of Adaptive Water Management principles : the case of Greater Tehran

Delavari Edalat, Farideh January 2014 (has links)
Continued water scarcity, flooding, pollution and urbanisation, especially in developing countries, have signified the necessity of renewed exploration of the most appropriate approach to water management. This approach should aim to meet the water requirements in the changing world in a sustainable way. Reviewing the different water approaches that have emerged in the developed countries during the last decades suggests that Adaptive Water Management (AWM) could provide a sustainable route to address the existing complex problems of urban water management through the future. The purpose of this study was to determine whether AWM could be applied to Greater Tehran in order to maximise sustainability and deal with the future uncertainties. The AWM characteristics of polycentric governance, institutional flexibility, and public participation were used to assess the adaptability of the existing water management. The research findings showed that, despite the lack of adaptability in the current Greater Tehran water management, there are positive attitudes towards adaptability among water professionals and the public. The research findings emphasised that the AWM application could be promoted by more participation in various levels of institutional structure. This thesis suggests that if the concept of AWM is applied to Iran, it has the potential to have a significant influence in the current/future water management by promoting technical and institutional performances simultaneously.

"Jag har bara sagt det så, för att andra inte ska skratta åt mig" : En kvalitativ ämnesdidaktisk studie om traditionella könsroller ur ett elevperspektiv

Djeordjic, Tijana January 2017 (has links)
The purpose of this study is to find out from a didactic perspective, how traditional gender roles emerge in the classroom and the conceptions of traditional gender roles. This is explored from a student’s perspective. The theoretical frame of this study is gender system, which consists of the principles of separation and hierarchy. The survey is conducted in two classes in third grade. This study answers following questions: How do traditional gender roles appear in the classroom from a student´s perspective? Which conception exist about traditional gender roles from a student's perspective? The study is based on observations and interviews, which is analysed of the gender system theory and the theoretical concept traditional gender roles. The results of this study show that the students' behavior in the classroom and their thinking are mostly based on the traditional gender roles, which is characterized mostly by the principles of separation and hierarchy.  However, some situations and statements show a change, in which the principles of separation and hierarchy are questioned. The individual situations reflect that the transfer of the gender contract is minimized from one generation to another.

A Foundation for Sustainable Product Development

Hallstedt, Sophie January 2008 (has links)
Product development is a particularly critical intervention point for the transformation of society towards sustainability. Current socio-ecological impacts over product life-cycles are evidence that current practices are insufficient. The aim of this thesis is to form a foundation for sustainable product development through the integration of a sustainability perspective into product development procedures and processes. Literature reviews and theoretical considerations as well as interviews, questionnaires, observations, testing and action research through case studies in various companies have indicated gaps in current methodology and have guided the development of a new general Method for Sustainable Product Development (MSPD). This method combines a framework for strategic sustainable development based on backcasting from basic sustainability principles with a standard concurrent engineering development model. A modular system of guiding questions, derived by considering the sustainability principles and the product life-cycle, is the key feature. Initial testing indicates that this MSPD works well for identification of sustainability problems as well as for generation of possible solutions. However, these tests also indicate that there is sometimes a desire for a quick overview of the sustainability performance of a specific product category. This is to guide early strategic decisions before the more comprehensive and detailed work with the MSPD is undertaken, or, alternatively, when an overview is sufficient to make decisions. In response, a Template for Sustainable Product Development (TSPD) approach is presented as a supplement to the MSPD. To generate products that support sustainable development of society it is necessary to combine sustainability assessments with improvements of technical product properties. An introductory procedure for such sustainability-driven design optimization is suggested based on a case study. For maximum efficiency of a company in finding viable pathways towards sustainability, it is also necessary to coordinate different methods and tools that are useful for sustainable product development and integrate them into the overall decision-making processes at different levels in companies. To find gaps in the sustainability integration in a company’s decision system, an assessment approach is suggested based on case studies. A general conclusion from this research is that the support needed for making sustainability-related decisions are not systematically integrated in companies today. However, this thesis also indicates that it is possible to create generic methods and tools that aid the integration of sustainability aspects in companies’ strategic decision-making and product development. These methods and tools can be used to guide the prioritization of investments and technical optimization on the increasingly sustainability-driven market, thus providing a foundation for competitive sustainable product development.

DEMOKRATINS GODA HUMÖR, NERVER AV STÅL OCH GNUTTA TUR -En kvantitativ studie om demokratiska principer och dess relation till mänsklig utveckling.

Byrskog, Bruce, Hedlund, Tomas January 2019 (has links)
The United Nation has declared a number of articles that protect human rights and with those articles imposing special obligations on the state to enforce these requirements. With this in mind it's not too hard to understand the democratic triumph over other regimes. The democratic regime has great theoretical and empirical support for its ability to bring higher levels of human development to citizens. This could be one of the reasons why democracy has spread over the world since the 19th century. But in recent years the importance of democracy has been questioned. The purpose of this paper is therefore to examine the connection of various democratic principles to human development. We are particularly interested in analyzing 1) if dissimilar democratic principle have any relation to human development and 2) if there are any democratic principles that tends to have a distinguishable relation to human development over recent decades. In this paper we use correlation- and regression analysis to analyze this relationship. The democratic principles are measured with the democratic components created by the V-Dem institute while human development is measured with the Human Development Index. Our findings give support to the existence of a relation between all measured democratic principles and human development. According to our findings, the democratic principle of equality has a distinguishable relationship to human development that runs over recent decades. This paper concludes the several shapes of relationships that occur between democratic principles and human development.
