The present study intends to verify if the achievements in the legislative plane allow the access and permanence of the young person in conflict with the law in the school; understanding how the relationship between this subject and the school environment occurs; as well as whether the school as a fundamental institution in the process of the full exercise of citizenship has represented a privileged place for the human formation and socialization of this individual. For the accomplishment of this research, 63 young people in conflict with the law that fulfill socioeducative measure in open surroundings in the municipality of Goiânia collaborated answering questionnaires. Also participating in the research were 8 teachers of the modality of Education of Adolescents, Young and Adults - EAJA who answered semi-structured interviews. It is a qualitative research that has developed in different stages: documentary analysis of the guiding texts, analysis of medical records of the young people who comply with the socio-educational measure of open means in Goiânia; application of questionnaires to young people; conducting interviews with teachers and analyzing and discussing the results obtained. Knowing the profile of the young person in conflict with the law and the schooling processes in which they are involved, allows us to verify that there is a delicate relationship between the young person and the school, which is materialized in the high rates of disapproval, in the discontinuity of the young person's school trajectory and school dropout. However, it is still considered that the school represents for young people a privileged place for the formation of identity and sociability. The final considerations point out that, even though, since the last decades, there has been a greater emphasis and visibility both for the young person who complies with socio-educational measures and for the field of activity of EAJA, it is necessary that the articulation and intersectoriality in addition to what is proposed in legislation and what efforts are made for this individual and for the space in which he occupies in a specific way, since it is possible to notice that the way the school is organized nowadays, have not contributed as expected, for inclusion , protagonism and success of the young person in the institution. / Analisando os documentos legais referentes à juventude e ao jovem em conflito com a lei, é possível observar que este saiu de um espaço histórico marcado por processos de negligência e/ou exclusão para adentrar em um período de garantias de direito com políticas públicas vigentes. O presente estudo se propõe verificar se as conquistas no plano legislativo possibilitam o acesso e a permanência do jovem em conflito com a lei na escola; compreendendo como se dá a relação entre este sujeito e o ambiente escolar; indagando ainda se a escola, como instituição fundamental no processo do exercício pleno da cidadania tem representado um lugar privilegiado para a formação humana e socialização desse indivíduo. Para a realização desta pesquisa, 63 jovens em conflito com a lei que cumprem medida socioeducativa em meio aberto no município de Goiânia colaboraram respondendo questionários. Participaram ainda da pesquisa, 8 professores da modalidade de Educação de Adolescentes, Jovens e Adultos – EAJA que responderam a entrevistas semiestruturadas. Trata-se de uma pesquisa de caráter qualitativo que se desenvolveu em etapas distintas: análise documental dos textos norteadores, análise de prontuários dos jovens que cumprem medida socioeducativa de meio aberto em Goiânia; aplicação de questionários aos jovens; realização de entrevistas com os professores e análise e discussão dos resultados obtidos. Conhecer o perfil do jovem em conflito com a lei e os processos de escolarização nos quais está envolvido, nos permite verificar que existe entre o jovem e a escola uma relação delicada que se concretiza nos altos índices de reprovação, na descontinuidade da trajetória escolar do jovem e na evasão escolar. Entretanto, se considera ainda que a escola, representa para os jovens um local privilegiado para a formação da identidade e a socibilidade. As considerações finais, apontam que mesmo tendo sido dado, desde as últimas décadas, maior destaque e visibilidade tanto para o jovem que cumpre medida socioeducativa, quanto para o campo de atuação da EAJA, é necessário que a articulação e a intersetorialidade se efetivem, para além do proposto na legislação e que esforços sejam destinados para esse indivíduo e para o espaço em que ele ocupa de maneira específica, pois é possível notar que a forma como a escola se organiza na atualidade, não têm contribuído como se espera, para a inclusão, protagonismo e sucesso do jovem na instituição.
