Kreativa lösningar : En kvalitativ undersökning om att polisanmäla hedersrelaterat våld mot barn inom socialtjänsten

The purpose of this study has been to investigate how socialworkers describe their attitudes towards reporting childabuse to the police and if they make different decisions when they believe the violence to be honour related and how they handle these questions. The main questions are; How does socialworkers describe their and their colleagues attitudes towards reporting childabuse to the police and when do they believe they should report? Do they describe honourviolence as a specific kind of violence that should be lifted and in what way does it affect their work? The study is written from a legal sociologist perspective with a qualitative approach. Four socialworkers were interviewed and the interviews were analyzed with an anti-racist theory and with the theory about freedom of action. The conclusions is that the socialworkers mostly report childabuse to the police when the violence is physical. This means that children who describes to be subjected to psychological violence, including honourviolence, has poor legal security. Socialworkers describes honourviolence as a specific kind of violence that has to be lifted. Without knowledge they wont be able to help. They feel limited by the legislation and have invented creative solutions that focuses on the child’s best interest.

Socialtjänsten och barn till irreguljära immigranter : en rättsvetenskaplig undersökning

The aim of this study was to examine how the social services could investigate and support children of irregular immigrants within the boundaries of the law. More specifically it aimed to examine the legal possibilities and obstacles for the social services to support irregular immigrants, how the officials at the social services act considering the legal aspects, and how they reason morally and ethically when dealing with irregular immigrants. To answer the aim of the study the theory of positive law was used combined with qualitative interviews with two officials at the social services. Moreover a small quantitative telephone study with officials in the social services and with voluntary organizations was made. The study has used theories of sociology of law, law and ethics, and professional (civil) disobedience. The conclusions were that children of irregular immigrants are included by the Swedish law for social services, but are hindered from getting support by the legal obligation to inform the police authorities when the social services are dealing with foreigners who did not apply for a residence permit. There is a need for the officials to be extra committed in such cases and they break the obligation to inform to be able to support the children.

Syftet med studien är att utifrån fem fäders berättelser undersöka effekten av rättstillämpning vid tvist om vårdnad, boende och umgänge. Genom detta har fäders situation utifrån rådande normers påverkan i socialtjänstens och rättsväsendets agerande synliggjorts. Vi kommer att följa fem fädernas berättelser om hur deras vårdnadstvist ser ut och hur de upplever bemötande, agerande och rättstillämpning från professionella aktörer. Enligt fäderna sker detta på ett icke tillfredsställande sätt då utredningarna ofta får dem att framstå som otillräckliga föräldrar och i vissa fall även farliga för sina barn. Studien är uppbyggd av semistrukturerade intervjuer med fäder vilka samtliga varit i tvist i tingsrätt och/eller hovrätt gällande barnets vårdnad, boende eller umgänge. Med innehållsanalys, socialkonstruktivism och en rättssociologisk ansats lyfts faktorer vilka kan påverka synen på rättstillämpning och rättssäkerhet utifrån bland annat normföreställningar. Dessa faktorer speglas ur fädernas berättelser. Studiens resultat visar att normföreställningar enligt informanterna kan påverka myndigheternas bemötande och bedömning. Studiens slutsats är att i det fall fädernas berättelser speglar verkligheten talar det för att det kan finnas brister i rättstillämpningen vid utredning och bedömning i fråga om vårdnad, boende och umgänge.

The Law BusinessmanTM : Five Essays on Legal Self-efficacy and Business Risk

The thesis challenges the notion of effectiveness of law as being based on the formal institutions of courts, law enforcement and written law. It argues that the best way to measure the effectiveness of law is the legal self-efficacy of laymen who are the end users of law.  It presents a new perspective on the effectiveness of law. It turns the traditional perspective of studying the effects of legal institutions around and instead studies the effect of how individuals perceive their own ability to use law. This self-reflexive ability - legal self-efficacy -  is the answer to the question “How comfortable are with communicating with legal terminology?”. The thesis makes several comparisons using the traditional perspective and legal self-efficacy and finds that legal self-efficacy is a better measure of legal effectiveness. This thesis analyzes 246 businesspeople in Russia and their risk behavior  with regards to economic transactions in relation to legal self-efficacy.  The theory behind legal self-efficacy is a combination of Luhmann’s theory of law as communication and Bandura’s concept of self-efficacy.  The first paper applies the traditional approach. It analyzes the effect of legal efficiency on leverage and debt maturity for listed and non-listed companies. The second paper is describes the conceptual foundation of the legal effectiveness based on the individual. The third paper compares the effect of private order (including legal self-efficacy) and public order institutions on the granting of trade credit.  The fourth paper analyzes the impact of legal self-efficacy and formal legal institutions on sanctions against clients in a comparative perspective. The final paper seeks out possible sources of legal self-efficacy. Legal self-efficacy can be used to better understand the interaction of individuals and law including such fields of research as behavioral accounting, behavioral law and finance, legal sociology and legal studies.
