Em razão das transformações enfrentadas pela sociedade, torna-se cada vez mais corriqueiro a ruptura dos vínculos conjugais, muitas vezes, abarcada por conflitos envolvendo mágoas e ressentimentos entre os cônjuges; entretanto, vale destacar que a separação refere-se apenas à conjugalidade e jamais à parentalidade. Assim sendo, a autoridade parental, que diz respeito aos direitos e deveres inerentes aos genitores em relação aos filhos, permanecerá com ambos os pais mesmo que algum destes não resida junto à prole. Diante destas situações, faz-se necessária a aplicação da guarda judicial que poderá ser unilateral, ou seja, é designado apenas um dos pais como guardião, que se responsabilizará pelo cotidiano dos filhos, residindo com eles; ou a guarda compartilhada, que consiste na responsabilização conjunta dos genitores para com seus filhos, mantendo a residência destes no lar que melhor lhes convier. Existem dificuldades na aplicação da guarda compartilhada, em especial, no que se refere à obrigatoriedade desta, após o advento da lei n. 13.058/2014. Para que ocorra a correta aplicabilidade da guarda conjunta é imperioso um mínimo de respeito e comunicação adequada entre os guardiões, pois, todas as decisões à respeito da prole deverão ser tomadas em conjunto. Ademais, as modificações conduzidas pela legislação provocaram diversidade de opiniões entre a doutrina e a jurisprudência, ao mencionar que o tempo de convívio entre pais e filhos deverá ser equilibrado, remetendo a uma confusão com a guarda alternada, em que ocorre a divisão da guarda física dos filhos, considerada perniciosa à criança/adolescente. Destarte, requer-se uma análise aprofundada do instituto da guarda compartilhada, buscando a sua aplicabilidade e efetividade, através da implementação e execução de políticas públicas na busca do consenso parental, tais como a mediação familiar, que procura transformar o conflito existente entre o casal conjugal, propiciando assim, o restabelecimento do diálogo entre eles. No mais, outros institutos também são merecedores de maior atenção, como a transmediação, a coordenação de parentalidade e as oficinas de parentalidade. Ressaltando que o princípio da proteção e melhor interesse dos filhos sempre deverá ser colocado em primeiro lugar. / The present study is based on the study of the shared guardianship of children in the light of the brazilian normative system in force, ascertaining its compatibility with the principle of the best interest of the child and the adolescent, as a way of providing a joint responsibility between the parents in the creation and education of minor and non-emancipated children. Due to the transformations faced by society, it is becoming increasingly common to break marital ties, often involving conflicts involving grievances and resentments between the spouses; however, it is worth noting that the separation refers only to conjugality and never to parenthood. Thus, parental authority, which concerns the rights and duties inherent to the parents in relation to the children, will remain with both parents even if one of them does not reside with the offspring. In view of these situations, it is necessary to apply the judicial custody that may be unilateral, that is, only one of the parents is designated as guardian, who will be responsible for the daily life of the children, residing with them; Or shared custody, which consists of the joint responsibility of the parents to their children, keeping their residence in the home that suits them best. There are difficulties in the application of shared custody, especially with regard to its obligation, after the advent of law n. 13.058/2014. In order for the correct application of joint custody to occur, a minimum of respect and proper communication among the guardians is imperative, since all decisions, regarding offspring must be taken together. In addition, the changes made by the legislation provoked a diversity of opinions between the doctrine and the jurisprudence, when mentioning that the time of conviviality between parents and children should be balanced, referring to a confusion with the alternating custody, in which division of the physical guard of children, considered harmful to the child/teenager. Therefore, an in-depth analysis of the shared custody institute is required, seeking its applicability and effectiveness, through the implementation and execution of public policies in the search for parental consent, such as family mediation, which seeks to transform the existing conflict between the couple marriage, thus facilitating the reestablishment of dialogue between them. No more, other institutes also deserve more attention, such as transmediation, parenting coordination, and parenting workshops. Emphasizing that the principle of protection and best interests of children should always be put first.

Střídavá péče a její vliv na školní úspěšnost dítěte v primární škole / Shared custody and its influence on a child's success in primary school

This diploma thesis deals with the problem of shared custody of children at primary school in relation to their school success. The issue is viewed from the perspective of primary school teachers and from the perspective of a school psychologist. The theoretical part deals with a child at primary school and also with child, who has special educational needs. It also deals with family, parental responsibility, discusses divorce, shared custody, school success and failure. The empirical part, through empirical research, aims to answer the question: "How does shared custody affect the school success of a child at primary school?"It examines the manifestations of children in shared custody, it looks for specific causes of problems of these children or specific factors ensuring smooth course of shared custody. It collects recommendations from teachers and school psychologist on how to work with and help these children. It also provides recommendations on who to work with and how - including cooperation with parents. It shows the level of teachers' awareness of this issue and their personal views on the issue. Propuesta de modificatorias de la Ley n° 31590 a fin de prevenir la vulneración del derecho alimentario del menor

La presente investigación tiene como objetivo general proponer modificatorias a la Ley N° 31590 con el fin de prevenir la vulneración del derecho alimentario del menor en casos de tenencia compartida. Para alcanzar este objetivo, se han planteado objetivos específicos que involucran analizar las implicancias de los derechos del menor en situaciones de tenencia compartida, identificar los problemas derivados de la aplicación de la Ley N° 31590 en los derechos del menor y su derecho alimentario, y explicar la necesidad de incorporar mejoras a dicha ley. La metodología utilizada se enmarca en un enfoque cualitativo y se basa en la investigación documental, con la técnica de fichaje para sintetizar la información relevante. Uno de los resultados más destacados es que la Ley N° 31590 promueve la tenencia compartida como opción generalizada en casos de separación o divorcio, pero carece de criterios específicos para distribuir los recursos económicos destinados al bienestar de los hijos en estas situaciones. Además, no aborda adecuadamente el principio del interés superior del niño. El propósito central es analizar este vacío legal y proponer enmiendas que consideren el principio del interés superior del niño, contribuyendo así a una regulación más equitativa y justa de la tenencia compartida en el sistema legal peruano. / The general objective of this research is to propose amendments to Law No. 31590 in order to prevent the violation of the child's right to food in cases of shared custody. In order to achieve this objective, specific objectives have been proposed that involve analyzing the implications of the rights of the minor in situations of shared custody, identifying the problems derived from the application of Law No. 31590 on the rights of the minor and his or her right to food, and explaining the need to incorporate improvements to said law. The methodology used is framed within a qualitative approach and is based on documentary research, with the fiching technique to synthesize relevant information. One of the most outstanding results is that Law No. 31590 promotes shared custody as a generalized option in cases of separation or divorce, but lacks specific criteria for distributing economic resources for the welfare of children in these situations. Furthermore, it does not adequately address the principle of the best interest of the child. The central purpose is to analyze this legal vacuum and propose amendments that consider the principle of the best interests of the child, thus contributing to a more equitable and fairer regulation of shared custody in the Peruvian legal system.

AREAS OF CONFLICT, COPING, AND SERVICE NEEDS AMONG CO-PARENTING PERSONS IN SAN BERNARDINO COUNTY

This study was conducted in San Bernardino County, California. Participants completed a questionnaire regarding conflicts that arise between co-parents, levels of stress from conflicts, how parts negotiate, cooperate, collaborate and communicate and the types of coping skills that participants use when stressed. The purpose of this study was to examine conflicts between parents and caregivers who share the custody of their children with another parent or caregiver. This study also assessed coping skills and co-parenting resources that are available in San Bernardino County. Twenty-two participants completed the study, 19 were female and 3 were male. Most of the participants were Latino. Over 77% of participants reported having conflicts with the other parent or caregiver. Nearly 73% of participants reported high levels of stress when having conflicts with the other parent or caregiver. However, participants reported being able to negotiate, cooperate, collaborate and communicate appropriately with the other parent or caregiver. Participants reported that they used a variety of primitive, less primitive and mature coping mechanism when dealing with conflicts with the other parent or giver. The results also showed that few participants had engaged in co-parenting interventions that were provided in San Bernardino County.
