With the dawn of democracy, the South African social security system was in dire need
of change. The right of access to social security was for the first time entrenched as a
fundamental right in the 1995 Constitution. Since then, many changes have been effected
to the present formal social security system, but these were mostly ad hoc and lacked a
comprehensive approach. The past history of the country led to the exclusion of the
majority of the population from formal social security protection. The excluded and
marginalised had to rely on informal social security measures to provide social
protection. This resulted in a system of co-existence between formal and informal social
security. Although informal social security is increasingly recognised as part of the social
security landscape, the role and importance of informal social security have largely been
ignored in all reforms to improve the protective scope of the present social security
system. The thesis aims to change this. Informal social security has been denied a rightful
place in the South African social security landscape. The thesis recommends a model as
to how the divide between formal and informal social security can be bridged. This
model will, it is hoped, serve as a baseline for stimulating debate and generating new
innovative ideas as to how to improve the present social security system in South Africa. / Jurisprudence / LLD

Developing an adjudicative institutional framework for effective social security provisioning in South Africa entails the establishment of a system that gives effect to the rights (of access) to social security and to justice. These rights are protected in the Constitution and in various international law instruments. In the Constitution, the Bill of Rights guarantees everyone the right to have access to social security, including appropriate social assistance for persons who are unable to support themselves and their dependants. It further requires the State to take reasonable legislative and other measures, within its available resources, to achieve the progressive realisation of the right to access to social security. Since a dispute resolution (adjudication) framework is an integral part of any comprehensive social security system, it is included in the constitutional obligation of the State. The establishment of a social security adjudication system is an intersection of the right of access to social security and the right of access to justice. The Constitution states that everyone has the right to have any dispute that can be resolved by the application of law decided in a fair public hearing before a court or, where appropriate, another independent and impartial tribunal or forum.
In addition, other rights protected in the Constitution have a bearing on the realisation of the rights of access to social security and to justice. There is a close correlation between all the rights in the Bill of Rights, as they are interrelated, interdependent and mutually supporting. They must all be read together in the setting of the Constitution as a whole and their interconnectedness must be taken into account in interpreting rights; and in determining whether the State has met its obligations in terms of any one of them. These rights, which include the right to equality (section 9), the right to human dignity (section 10) and the right to just administrative action (section 33) must thus be considered in establishing a social security adjudication system. Also to be considered are other constitutional prerequisites for the establishment of a social security adjudication system, such as the limitation and enforcement of rights (sections 36 and 38 respectively); principles relating to courts and the administration of justice (Chapter 8) and basic values and principles governing public administration (Chapter 10).
In establishing a social security adjudication system in South Africa, international law standards and developments in comparative systems must also be taken into account. The Constitution adopts an international law- and comparative law-friendly approach. It states that when interpreting fundamental rights, international law must be considered while foreign law may be considered (section 39).
This thesis aims to develop an adjudicative and institutional framework for effective social security provisioning in South Africa that realises the rights of access to social security and to justice in the South African social security system. This is achieved by exploring the concept of access to justice, and its application in the social security adjudication system. The current social security adjudication system is evaluated against the concept of access to justice applicable in international and regional law instruments, comparable South African (non-social security) systems and comparative international jurisdictions. Principles and standards on the establishment of a social security adjudication system are distilled; and a reformed system for South Africa is proposed. / Mercantile Law / LL.D.

Previous issue date: 2012-10-24 / Conselho Nacional de Desenvolvimento Científico e Tecnológico / This study sought to present the social work with families from a program in the city of
Suzano called PROASF - Social-Family Guidance and Support Network Program, and
PAIF - Program of Comprehensive Care to Family, from the point of view of municipal
management.
In the course of the research it was presented the historical, economic, social and
demographic aspects of Suzano, in particular, the trajectory and the management of
social care in the municipality.
For the analysis of such programs it was made a historical rescue of most relevant
experiments in social work with families, which happened at the federal, state and
municipal scope, noting similarities and differences between these experiments. As the
implementation of the social work with families was performed by professionals of an
entity contracted with the city of Suzano, under the supervision of professionals from
government, it was analyzed the relationship between State and Civil Society,
presenting the weaknesses and strengths of this partnership.
The city of Suzano, while establishing the PROASF, creates a parallelism of actions in
social work, with families using resources of the PAIF, without, however, informing
families about the existence of the federal program, leading to tensions in the
relationship between levels of governmentwork. / Neste estudo, apresenta-se o trabalho social com famílias a partir da existência de um
programa municipal, na cidade de Suzano, denominado Programa em Rede de
Orientação e Apoio Sociofamiliar (Proasf) e o Programa de Atenção Integral à Família
(Paif), sob o ponto de vista da gestão local. No percurso da pesquisa, apresentam-se os
aspectos históricos, econômicos, sociais e demográficos de Suzano, em especial, a
trajetória e a gestão da assistência social no município. Para a análise dos respectivos
programas, faz-se o resgate histórico de experiências mais relevantes, no trabalho
social com famílias, que aconteceram nos âmbitos federal, estadual e municipal,
constatando o que tais experiências tinham de comum e de diferente. Como o trabalho
social com famílias é realizado por profissionais de entidade conveniada com a
Prefeitura de Suzano, sob a supervisão dos profissionais do Poder Público, são
analisadas as relações entre Estado e sociedade civil, e apresentadas as fragilidades e
potencialidades dessa parceria. A Prefeitura de Suzano, ao mesmo tempo em que cria
o Proasf, gera um paralelismo de ações no trabalho social com famílias utilizando
recursos do Paif sem, contudo, informar as famílias sobre a existência do programa
federal, levando a tensões na relação entre as esferas de governo

Previous issue date: 2009-05-18 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / This research tried to highlight the inauguratory character of the Benefício de Prestação Continuada - BPC (Cash Transfer Program) as a no-contributory social right in a country which historically had as its mark a regulated citizenship and therefore waged work and social protection for its population were never made universal. The analysis made located the historical movement of the conquest of this right in the cultural, political and social Brazilian dynamic that displaces the poor from their citizenship condition, struggled to approve the BPC in the Constitutional Convention, from which the 1988 Federal Constitution was originated, as well as discussed thoroughly the ambiguities that pass throughout the very own history of the social work in the Brazilian society. In the perspective to discuss thoroughly and contribute to the BPC consolidation, this study analyzed the support and resistance power in the process of the BPC constitution, discussed the nature of this benefit in the bounds of social work and identified the attempts of dismemberment and retrocession that surrounded its definition and implementation. It was also possible to think about BPC in its articulation with Unified System for Social Assistance - SUAS, its challenges and possibilities to include its beneficiaries in programs, projects and social work services. It's assumed that the social work is bound to social protection fields as one of the social politics that constitutes the Brazilian Social Security. Being so, to assume that the social protection as a right to all citizens expresses a rupture of a culture that forwards social rights to waged work, defining a new relation between the state and the society based on the conception of universal citizenship. From Campinas, SP, focusing on the BPC beneficiaries - elderly and disabled people and their interlocutors; this study tried to demonstrate the BPC perception as a social assistance right, highlighting the conditions of access and maintenance of this benefit, an identification of its expenses by the beneficiaries, its articulation with CRAS (Social Reference of Social Assistance Center), the social control and its interfaces with INSS (Social Security) related to its operationalization. As well as methodological procedures, documental and bibliographic research, this essay was based on empiric research with a qualitative approach and semi-structured interviews with BPC beneficiaries, social workers who work for CRAS (Social Assistance Reference Center), social workers responsible for the revision of this benefit in Campinas city, INSS (Social Security) solicitor and members of the City Council for the elderly and the disabled. The produce of this work is displayed in four chapters and the results show a fragile vision about BPC as a social assistance right with constitutional base, a consequence of a political culture with low inscription in the fields of human rights / Esta pesquisa procurou ressaltar o caráter inaugural do Benefício de Prestação Continuada BPC como um direito social não-contributivo, num país que historicamente teve como marca a cidadania regulada e que, portanto, nunca universalizou o trabalho assalariado e a proteção social para toda a população. A análise empreendida situou o movimento histórico de conquista deste direito na dinâmica cultural, política e social brasileira, que destitui o pobre da condição de cidadania, retomando os embates para a aprovação do BPC na Assembléia Constituinte que deu origem à Constituição Federal de 1988, bem como discutiu as ambigüidades que perpassam a própria historicidade da assistência social na sociedade brasileira. Na perspectiva de problematizar e contribuir para a consolidação do BPC, este estudo analisou as forças de apoio e resistência no processo de sua constituição, discutiu sua natureza no âmbito da assistência social e identificou as tentativas de desconstrução e retrocesso que cercaram a sua definição e implementação. Também foi possível refletir sobre o BPC em sua articulação com o Sistema Único de Assistência Social SUAS, os desafios e possibilidades para inclusão dos seus beneficiários em programas, projetos e serviços socioassistenciais. Partiu-se do pressuposto de que a assistência social se vincula ao campo da proteção social como uma das políticas sociais que compõem a seguridade social brasileira e que, desse modo, assumir a proteção social como direito de todos os cidadãos expressa a ruptura com uma cultura que remete direitos sociais ao trabalho assalariado, demarcando uma nova relação entre o Estado e a sociedade fundada na concepção da cidadania universal. A partir de dados coletados no município de Campinas (SP), focalizando-se os beneficiários do BPC idosos e pessoas com deficiência e seus interlocutores, buscou-se demonstrar a percepção do BPC enquanto direito socioassistencial, enfatizando as condições de acesso e manutenção deste benefício, a identificação do seu gasto pelos beneficiários, sua articulação com os Centros de Referência de Assistência Social CRASs o controle social e as interfaces com o INSS, no que diz respeito a sua operacionalização. Como procedimentos metodológicos, além da pesquisa documental e bibliográfica, a dissertação apoiou-se em pesquisa empírica com uma abordagem qualitativa, realizando-se entrevistas semi-estruturadas com beneficiários do BPC, assistentes sociais que trabalham nos CRASs, assistentes sociais responsáveis pela revisão do benefício na cidade Campinas, procuradores do INSS e membros dos conselhos municipais do idoso e da pessoa com deficiência. O produto deste trabalho está disposto em quatro capítulos e os resultados indicam uma frágil visão do BPC como direito socioassistencial de base constitucional, conseqüência de uma cultura política de baixa inscrição no campo dos direitos humanos

Par sa finalité et son objet, la formation professionnelle continue appartient au droit de la protection sociale. Elle permet ainsi aux salariés de faire face au risque social d'obsolescence des compétences, mais également de sécuriser leur parcours professionnel. En 1973, le législateur forgea un lien artificiel entre cette matière et le droit du travail en la codifiant au sein du Code du travail. Le droit du travail exerça une influence constante sur la formation professionnelle qui fut orientée en priorité vers les besoins des seuls salariés. La réforme du 5 mars 2014 et les lois qui ont suivi semblent vouloir rompre avec ce cadre juridique artificiel. Le législateur entend consacrer un système d’assurance social, universel, personnel et individuel, ce qui pose la question d'un éventuel droit à la formation et appelle une réforme globale de son mode de fonctionnement. / Continuing vocational training in French social law : contributing to the study of a new social insurance.For its purpose and its content, continuing vocational training belongs to the law of social protection. It allows employees to face the social risk of skills' obsolescence but also to secure their professional path. In 1973, the legislator created an artificial link between vocational training and labour law by codifying this field into the Labour Code. Labour Law exercised a constant influence on vocational training which was primarily based on the sole needs of employees. The reform of 5th March 2014 and the subsequent laws seem to have the will to break with this artificial legal framework. The legislator intends to create a system of social insurance which is universal, personal and individual. It raises the question of a potential right to vocational training and calls for a global reform of its functioning.

Denna kvalitativa studie om internationellt utvecklingsbistånd undersöker effekterna av gender mainstreaming i sociala trygghetssystem i Afrika, söder om Sahara, med särskilt fokus på jämställdhet, kvinnors empowerment och biståndets effekter på familjeförhållanden. Studien lyfter fram en historisk bakgrund av gender mainstreaming i politiken, men även dagens internationella engagemang för att bekämpa den extrema fattigdomen. Studien belyser det svenska internationella biståndets initiativ för att minska fattigdomen i Afrika, söder om Sahara. Totalt genomfördes fyra semistrukturerade intervjuer med högkvalificerade tjänstemän som representerar det internationella biståndet, med bakgrund från Utrikesdepartementet, Styrelsen för internationellt utvecklingssamarbete (Sida), Latinamerikainstitutet på Stockholms universitet och UNICEF Office of Research - Innocenti. Resultatet visade att ett genderintegrerat bistånd i form av sociala kontantöverföringar som främjar jämställdhet i samhällen som biståndet verkar i, bidrar till att minska den extrema fattigdomen. Men resultaten visade även att det krävs ytterligare forskning för att kunna se direkta kausala effekter av biståndet som riktas till kvinnor jämfört med bistånd som riktas till män, samt den effekt som biståndet har på kvinnors empowerment och på biståndsmottagarnas familjeförhållanden. Slutsatsen av undersökningen är att uppbyggnaden av genderintegrerade sociala trygghetssystem i Afrika, söder om Sahara, är av särskild betydelse då man genom ökad jämställdhet och ett övergripande socialt skyddsnät minskar den extrema fattigdomen och främjar regionens välmående i sin helhet. / This qualitative study on international development aid explores the effects of gender mainstreaming in social protection systems in sub-Saharan Africa, with a focus on gender equality, women's empowerment and family structures. The study features a historical background of gender mainstreaming in politics, but also today's international commitment to combat extreme poverty. The study highlights the initiative of the Swedish international aid to reduce poverty in sub-Saharan Africa. A total of four semi-structured interviews were conducted with highly qualified public servants representing the international foreign aid, representing The Swedish Ministry of Foreign Affairs, The Swedish International Development Cooperation Agency (Sida), The Institute of Latin American Studies at Stockholm University and UNICEF Office of Research - Innocenti. The results showed that a gender-based foreign aid in the form of social cash transfers that aims to promote gender equality, helps to reduce extreme poverty. In addition, the results showed that further research is required to see the direct effects of aid directed at women as compared with aid directed at men, as well as the impact of aid on women's empowerment and the family structures of aid recipients. The conclusion of this study is that the development of gender-based social protection systems in sub-Saharan Africa is of particular importance as, through increased gender equality and overall social protection systems, the region's prosperity increases, and levels of extreme poverty reduces.

Les régimes spéciaux de sécurité sociale des fonctionnaires nourrissent la mythologie française. Leur simple évocation fait généralement l’unanimité, que l’on en parle comme d’avantages acquis, de privilèges catégoriels ou de rémanences du passé. Qualifier juridiquement la protection sociale des fonctionnaires de régime spécial de sécurité sociale présente pourtant certains biais. La notion de « régime » implique une relative cohérence d’ensemble. L’intégration dans la « sécurité sociale » induit le respect des mêmes principes et modes de fonctionnement que l’institution. Le qualificatif « spécial » laisse à penser que ledit régime entretient un rapport de spécial à commun avec le régime général. Ces trois items n’en sont pas moins contestables. La protection sociale des fonctionnaires est une construction itérative, étalée sur plus d’un siècle, où prestations et garanties reposent chacune sur une logique qui lui est propre. Un large pan de cette protection sociale consiste en une couverture administrative, endossée directement par les employeurs publics. Le régime général n’est pas le droit commun de la sécurité sociale. Cela étant dit, c’est une autre étude de la sécurité sociale en général et de la protection sociale des fonctionnaires en particulier qui peut débuter. Le tout pour conclure à une crise d’identités : c’est dans son intégration à la sécurité sociale que la protection sociale des fonctionnaires parvient le mieux à exprimer sa singularité ; mais c’est parce que la protection sociale des fonctionnaires tend à être assimilée à la sécurité sociale qu’il convient d’en admettre la relativité. / Special social security schemes for civil servants belong to the French mythology. Their mention is usually embraced by all, which is spoken of as long-acquired habits, categorical privileges or afterimages of the past. Legally qualify social protection of the civil servants of special social security schemes raise questions. The concept of « scheme » implies a relative overall consistency. The integration to the « social security » means to respect the same principles and operating modes as the rest of the institution. The adjective « special » suggests that the scheme has the same relationship to general scheme as special law to ordinary law. These three items are questionable. Social protection of the civil servants is an iterative construction, spread over more than a century, where the benefits and guarantees each based on its proper logic. A large part of this social protection consists of an administrative cover, endorsed by public employers. The general scheme is not the ordinary social security law. That being said, this is another study of social security in general and social protection of the civil servants in particular who can begin. All for finding an identity crisis: with its integration to social security, social protection of the civil servants succeeds in expressing its uniqueness; but it’s because this social protection tends to be equated with social security that relativity may be deduced from it.
