It was looked for still to approach public politics addressed for the juvenile segment in the sense of the same ones they subsidize a life condition that allows the development and the youth's promotion in specific of that originating from of the poor social class in the aspects economical, political, cultural and social / A presente tese constitui-se de um processo de trabalho investigativo, com vistas ao conhecimento dos significados que os jovens do sexo masculino, na faixa etária de 16 e 20 anos de idade, que já cumpriram a medida privativa de liberdade no ano de 2006, nas Unidades da Fundação CASA, e que no ano de 2007 estavam cumprindo a medida socioeducativa de liberdade assistida, em entidade social, localizada na Zona Leste, Bairro de São Mateus, no Município de São Paulo, atribuem às suas circunstâncias e modos vida sócio-familiar e infracional o delito, a privação da liberdade e o cumprimento da medida socioeducativa de liberdade assistida , bem como as projeções que fazem para as suas vidas. A pesquisa de natureza qualitativa desenvolveu-se por intermédio da História Oral e na perspectiva sociológica, a partir da metodologia do relato de vida, com o objetivo de conhecer os significados acima referidos, bem como as determinações constitutivas de suas trajetórias. O conceito de juventude foi trabalhado mediante o percurso histórico dos sujeitos nesta fase da vida humana e, por se tratar de jovens em conflito com a lei devido ao cometimento de ato infracional, realizou-se uma breve reflexão sobre o paradigma da Situação Irregular para a Proteção Integral, de forma a apresentar as diferenças entre ambos no âmbito da política de atendimento a este segmento juvenil. Foi discutida, também, a questão da violência urbana que abate sobremaneira os jovens, especialmente aqueles dos segmentos empobrecidos. Ainda, foram abordadas as trajetórias de vida dos jovens pesquisados, o contexto sócio-político-econômico do Município de São Paulo e do Bairro de São Mateus e seus distritos, onde os sujeitos da pesquisa residem e localiza-se a Associação Comunitária e Beneficente Padre José Augusto Machado Moreira Instituição conveniada com a antiga FEBEM, atual Fundação CASA, onde são atendidos na Medida socioeducativa de liberdade assistida. Impossível estudar estes jovens e não discorrer sobre suas relações familiares com ênfase nas questões relacionadas à escola, educação e trabalho. Ao final destes estudos, buscou-se apontar as similaridades dadas nos modos e condições de vida dos sujeitos investigados, confrontando-as com a vulnerabilidade, enquanto matriz de análise. For his realization it was basic rescued the historical process of the city of São Bernardo of the Campo. This history is determinative for the knowledge of the life and of the culture of the local population, of the factors restrictions of the disordered and quick growth of the city and of the reformulations that altered the purposes economical-politician of the development of the region. For the development of the inquiry there was rescued the trajectory of the Fundação Criança, the reversion of the paradigms, the implementation of the new programs, the methodology of work, his philosophy and the use of new tools of management technician - administrative. Finally we board the process of evaluation what it made possible to the Case be considered an exemplary case in the service to the adolescents in fulfilment of social and educatives measures in open environment / Esta Dissertação de Mestrado apresenta um estudo ex-post factum sobre o modo de operacionalização das medidas socioeducativas em meio aberto desenvolvido no Case da Fundação Criança de São Bernardo do Campo no período compreendido entre 1998 e 2004, que teve por metodologia a pesquisa ação na ação. Para sua realização foi fundamental resgatar o processo histórico da cidade de São Bernardo do Campo. Essa história é determinante para o conhecimento da vida e da cultura da população local, dos fatores condicionantes do crescimento desordenado e acelerado da cidade e das reformulações que alteraram os desígnios político-econômicos do desenvolvimento da região. Para o desenvolvimento da pesquisa foi resgatada a trajetória da Fundação Criança, a reversão dos paradigmas, a implementação dos novos programas, a metodologia de trabalho, sua filosofia e a utilização de novas ferramentas de gestão técnico- administrativas. Foi dada ênfase ao conhecimento de como se deu o processo de construção dessa nova forma de gestão de programas sociais, seus aspectos conceituais e metodológicos e o fluxo de atendimento. Nesse intento, concentrei-me nos conceitos-chave de “proteção social”, “vínculos sociais”, “reconhecimento”. Além de abordar a justiça social no âmbito da educação musical, os fundamentos teóricos da pesquisa se alicerçam também nos conceitos de Convivência Social como método do trabalho social na Proteção Social Básica, especificamente nos Serviços de Convivência e Fortalecimento de Vínculos. As questões centrais da investigação são: a) Por que as práticas musicais com adolescentes estão presentes nos CCAs da capital paulista, centros entendidos como instância de política de Assistência Social brasileira?; b) Quais os significados das práticas musicais com e para essas/esses adolescentes quando inseridas nesses contextos de Assistência Social?; c) Considerando a perspectiva de justiça social, as práticas musicais promovem o usufruto de direitos e garantem a equidade de acesso a bens socioculturais e bem-estar social em favor do desenvolvimento de potencialidades dos adolescentes atendidos nos CCAs? Este estudo espera colaborar para aprofundar a compreensão do papel das práticas musicais voltadas para adolescentes que frequentam espaços de atendimento socioassistencial. Um de seus principais resultados é que as práticas musicais, como atenções socioeducativas, assumem papel de geradora de relações sociais e de fortalecimento individual dos adolescentes atendidos nos CCAs. Esta pesquisa implica em possibilidade de desenhar novas metas e objetivos para a práticas musicais nos serviços socioassistenciais, valorizando a conscientização dos educadores musicais que atuam nos CCAs e reconhecendo a política de proteção social como direcionamento das práticas musicais qual componente do desenvolvimento social que preserva a dignidade, a justiça e os direitos das/dos adolescentes na condição de cidadãos. / Supported by the Brazilian National Social Assistance Policy (PNAS), the Norms of the Unified Social Assistance System (NOB/SUAS) and the perspective of the social justice in Music Education, I developed a multiple case studies research aiming to understand why the musical practices with teenagers are present in the Centers for the Children and Adolescents (CCA) of the Sao Paulo city in the micro and macro aspects of the current socio welfare policy. In that attempt, I concentrated on the key concepts of "social protection", "social ties", "recognition". In addition to addressing social justice in the field of music education, the theoretical foundations of research are also based on the concepts of Social Coexistence as a method of social work in Basic Social Protection, specifically in the Services of Coexistence and Strengthening of Links. The main questions of the study are: a) Why are the musical practices with adolescents present in the CCAs of the São Paulo city, centers understood as a policy instance of Brazilian Social Assistance?; b) What are the meanings of the musical practices with and for these adolescents when inserted in these contexts of Social Assistance?; c) Considering the perspective of social justice, do the musical practices promote the enjoyment of rights and ensure fair access to socio-cultural assets and social welfare in favor of developing the potential of the adolescents assisted in the CCAs? This study hopes to collaborate to deepen the understanding of the role of musical practices aimed at adolescents who attend social assistance spaces. One of its main results is that musical practices, such as socio educative care, assume the role of generating social relations and individual strengthening of the adolescents assisted in the CCAs. This research implies the possibility of designing new goals and objectives for the musical practices in the social assistance services, valuing the awareness of the musical educators who work in the CCAs and recognizing the social protection policy as a direction of the musical practices as a component of social development that preserves the dignity, justice and the rights of adolescents as citizens.

The purpose of this study is to describe, analyze and comprehend the socio-educational measures in open environment, probation and provision of community services in the perspective of adolescents in conflict with the law, in the Socio-educational Program in Open Environment (Programa de Medidas Socioeducativas em Meio Aberto), in São Carlos city, located in the state of São Paulo, Brazil. The qualitative study, an observant participation, intends to establish an interaction between the researcher and the research participants and it assumes that participating in the context with the collaborators is essential to understand the studied phenomenon. The field visits to the canvas painting workshop called Expressarte: Arte em Liberdade were performed weekly, in March and June 2011. By observing and taking notes of the workshops, I could understand the meaning that adolescents attribute to the Program of Socio-educational Measures. Only by taking a role in the group and participating in daily activities I could experience the context in which adolescents are part from their perspective, seeking to better understand relevant aspects of this educational experience. By using different resources such as informal conversations, participant observation and document analysis, the data collection allowed the data triangulation. From the data analysis organized in field diaries emerged some foci of analysis: socio-educational measures in an open environment, the Expressarte workshop and the professionalization, which were analyzed by the Freire, Fiori and Dussel s concepts of education. The purpose was to understand the possibilities of people educate themselves in different social practices and the meaning of the socio-educational system for adolescents in conflict with the law. The deepening of the analysis of collected data in this research will constitute the object of further studies and it will produce discussions that contribute to the process of reflection on the importance of educational measures, analyzed from the perspective of adolescents in conflict with the law. / Este trabalho busca um aprofundamento das discussões existentes em relação a adolescentes em conflito com a lei e como significam as Medidas Socioeducativas de Liberdade Assistida e Prestação de Serviços à Comunidade. O estudo tem como objetivo descrever, analisar e compreender as medidas socioeducativas, na perspectiva dos adolescentes, no espaço do Programa de Medidas Socioeducativas em Meio Aberto, no município de São Carlos/SP. O estudo de natureza qualitativa, uma observação participante, intenciona estabelecer interação entre o pesquisador e os participantes da pesquisa, partindo do pressuposto que participar do contexto com os colaboradores é fundamental para se compreender o fenômeno pesquisado. As inserções foram realizadas semanalmente, na oficina de pintura em tela, denominada Expressarte: arte em liberdade, entre os meses de março e junho de 2011. Ao observar e registrar as oficinas foi possível compreender o significado que os adolescentes dão ao Programa de Medidas Socioeducativas, e somente assumindo um papel no grupo e participando das atividades cotidianas, pude vivenciar o contexto dos adolescentes, buscando melhor compreender aspectos relevantes dessa experiência educativa. A coleta de dados utilizando diferentes recursos, como as conversas informais, a observação participante e a análise documental, possibilitou a triangulação dos dados Da organização dos dados nos diários de campo emergiram alguns focos de análise: medidas socioeducativas em meio aberto, oficina Expressarte e profissionalização, que foram analisados com base na concepção de educação como prática de humanização de Paulo Freire, Ernani Maria Fiori e Enrique Dussel, buscando-se compreender as possibilidades das pessoas se educarem em diferentes práticas sociais e o significado do sistema socioeducativo para adolescentes em conflito com a lei. O aprofundamento das análises dos dados coletados nesta investigação se constituirá em objeto de estudos posteriores, fomentando discussões na busca de caminhos que contribuam com o processo de reflexão sobre a importância das medidas socioeducativas, analisadas na perspectiva de adolescentes em conflito com a lei.

The aim is to investigate the chances that youths have by living in Centro Educacional Pitimbu and Centro Educacional Padre. Jo?o Maria (CEDUC), to become subjects in the exercise of their citizenship. The methodology adopted is the verbal history of life (MEIHY, 2005) of youths that had life experiences in these institutions from 2002 to 2005, allowing researchers to access directly to investigated individuals, through the place where they currently reside, and enabling the reconstitution of their life story, from semi-structured interviews. The young people s statements interviewed were grouped and analyzed from the following categories of analysis: the egress and family, the school and egress, the community and egress, the egress and work, the egress and CEDUC, the egress and experience infringement. The results indicate that, despite the advances in Brazilian legislation for the sector, the actions promoted by these institutions generally would have produced innocuous and stigmatized consequences. Moreover, they show in essence that they carry on their inner contradictions which fundamentally correspond to the interests of the dominant system and a society which uses mechanisms of social policy, in addition to favoring the control and repression. And thus, while such actions remain unable to produce important changes in the conditions of existence of young people who meet by social deprivation of liberty, it is possible to say that the chances are minimal so that they become autonomous subjects in a society that, preferring their punishment, denies them, stubbornly, access to their basic rights. In theory, the researcher dialogues with authors as Foucault, Goffman, Bourdieu, Offe, Bauman, Boaventura Santos, Takeuti, Germano, Ari?s, Wacquant, among others / O estudo analisa, criticamente, os efeitos das pol?ticas p?blicas, executadas pela Funda??o Estadual da Crian?a e do Adolescente (FUNDAC/RN), junto aos adolescentes, de ambos os sexos, autores de atos infracionais, em cumprimento, por determina??o judicial, da medida socioeducativa de interna??o , identificando as contradi??es que perpassam a compreens?o e tratamento da quest?o. Objetiva investigar quais as chances que t?m os jovens egressos, com passagem pelo Centro Educacional Pitimbu (CEDUC Pitimbu) e pelo Centro Educacional Pe. Jo?o Maria (CEDUC Pe. Jo?o Maria), de se tornarem sujeitos no exerc?cio de sua cidadania. A metodologia adotada ? a hist?ria oral de vida (MEIHY, 2005) dos jovens egressos das institui??es referidas, no per?odo 2002/2005, permitindo ao pesquisador o acesso aos sujeitos investigados, diretamente nos locais onde residem, na atualidade, e possibilitando a reconstitui??o de sua hist?ria de vida, a partir de entrevistas semi-estruturadas. Os depoimentos dos jovens entrevistados foram agrupados e analisados a partir das seguintes categorias de an?lise: o egresso e a fam?lia, o egresso e a escola, o egresso e a comunidade, o egresso e o trabalho, o egresso e o CEDUC, o egresso e a viv?ncia infracional. Os resultados sinalizam que, a despeito dos avan?os na legisla??o brasileira para o setor, as a??es promovidas por essas institui??es, em geral, s? t?m produzido conseq??ncias in?cuas e estigmatizadoras, evidenciando que, em ess?ncia, elas carregam no seu interior contradi??es que, no fundo, correspondem aos interesses do sistema dominante e de uma sociedade que, utilizando mecanismos de pol?tica social, ainda privilegia o controle e a repress?o. The study is going to be presented in this paper intends to analyze the guarantee of the rights of teenagers who pay their penalties through social and educational measures in open spaces, from the point of view of the Social Service. The work of a social worker with these teenagers is full of possibilities and limits. The grounding of this paper rewinds the beginning of this career and of the professional assignment connected to childhood and youth, having as focus the conflict to guarantee social rights of transgressor teenagers. This is a qualitative research, which uses as main technique interviews with social workers who follow teenagers that are under social and educational measures through Assisted Freedom and Community Service. To data collect, it was written an interview guide, which was applied to eight social workers that are involved in treatment centers of social and educational measures in open spaces, in the cities of Fortaleza-CE and Aracaju-SE. The research in Fortaleza-CE happened on April of 2013, and on November of 2013 in Aracaju-SE. After the interviews, the data collected was analyzed through a selection of speeches that are relevant to this study, articulated with some thoughts of writers who dedicated to researches in this subject. The results of this study emphasize that these professionals act in order to pursue the guarantee of teenagers rights, despite the difficulties to access these services. Another information found is about the actions and techniques used in this job, such as individual treatment, collective treatment, home visits, another politics, among others. It was found also some aspects that make these actions harder to execute, like discrimination to teenagers, little investment in childhood and youth, lack of capacity of the professionals who work with them, among others which point out the weakness to guarantee what is fixed by law. Therefore, it is considered that this research revealed limits and possibilities about the garantees of rights of teenagers who pay penalties through social and educational measures in open spaces, as well as the necessity to enlarge and improve the treatment to these young people. It is recommended studies about the politics directly related to treatment of these teenagers that are under social and educational measures, in order to provide to the hard job with subjects so discriminated by great part of society. / O estudo a ser apresentado tem como objeto a análise da garantia dos direitos de adolescentes que cumprem medida socioeducativa em meio aberto, a partir do Serviço Social. O exercício profissional do assistente social junto a esses adolescentes é permeado de possibilidades e limites. A fundamentação teórica resgata o início da profissão e do exercício profissional vinculado à infância e juventude, tendo como foco a luta pela garantia dos direitos sociais dos adolescentes que cometeram ato infracional. Trata-se de uma pesquisa qualitativa, que utiliza como técnica principal a entrevista com assistentes sociais que atuam no acompanhamento aos adolescentes em cumprimento das medidas socioeducativas Liberdade Assistida LA e Prestação de Serviço à Comunidade PSC. Para a coleta de dados, foi previamente elaborado um roteiro de entrevista, sendo aplicado a 8 assistentes sociais em exercício profissional nos núcleos de atendimento de medidas socioeducativas em meio aberto, em Fortaleza-CE e Aracaju-SE. Ressalta-se que a pesquisa de campo em Fortaleza foi realizada no mês de abril de 2013 e, em novembro de 2013, foram realizadas as entrevistas em Aracaju-SE. Posteriormente, foi feita a análise dos dados coletados nesses espaços, por meio de seleção das falas relevantes a esse estudo, bem como da articulação com o pensamento de autores que se dedicaram a pesquisas acerca dessa temática. Os resultados do estudo enfatizaram que existem ações desenvolvidas por esses profissionais, no que diz respeito à busca pela garantia dos direitos dos adolescentes, apesar dos impasses existentes com relação ao acesso a tais serviços. Outro dado refere-se às ações e técnicas utilizadas no exercício profissional, como atendimentos individuais, atendimentos grupais, visitas domiciliares, articulação com outras políticas, dentre outras. Constata-se, também, alguns aspectos que dificultam essas ações, tais como a discriminação com os adolescentes, o pouco investimento na área da infância e juventude, a falta de capacitação dos profissionais, evidenciando a fragilidade em garantir o que está previsto no ECA e SINASE. Considera-se, portanto, que esta pesquisa revelou limites e possibilidades a respeito da garantia dos direitos de adolescentes em cumprimento de medida socioeducativa em meio aberto, além da necessidade em ampliar e melhorar o atendimento a esses jovens. Recomenda-se a realização de estudos sobre as políticas que estão diretamente relacionadas ao acompanhamento de adolescentes que cumprem medidas socioeducativas, a fim de subsidiar a árdua atividade a ser realizada com sujeitos que são discriminados pela grande parte da sociedade.

Essa política se encontra no arcabouço jurídico-institucional (lei e sistema) Estatuto da Criança e do Adolescente (ECA), Lei Federal nº 8.069/1990, voltada para a proteção integral de crianças e adolescentes até 18 anos de idade e, em condições especiais, entre 18 e 21 anos. O estudo de base analíticodocumental tem como objetivo a análise qualitativa da política socioeducativa de direitos, observando os quesitos sobre o cumprimento das decisões judiciais, quando inserida em programas socioeducativos, tomando como referência os aspectos da execução, natureza, tipologia, modalidades e financiamento. A abordagem qualitativa segundo Minayo (2007(a)) aprofunda-se no mundo dos significados, o qual deve ser exposto e interpretado primeiramente pelos próprios sujeitos pesquisados. Na presente investigação, a observação e a análise documental com pesquisa de campo (entrevistas semiestruturadas) embasaram a compreensão e a síntese desta. Para a consecução da análise foram entrevistados: conselheiros municipais dos direitos da criança e do adolescente, conselheiros tutelares, educadores do Centro de Referência Socioeducativo e a Secretária Municipal de Assistência Social e Cidadania. As entrevistas foram consideradas a base empírica da pesquisa, quando foram destacados os limites e as capacidades apresentadas pelos sujeitos entrevistados na concretização da proteção integral e, nesse sentido, possibilitaram apreender as convergências e divergências indicadas na sua atuação prática. / Abstract: This research deals with the socio educational policy of rights for adolescents in conflict with the law, and it is focused on the socio educational measures in Maringá, a city in the Northwest of Paraná state. This policy is part of the Statute of the Child and Adolescent, whose basis is the law and system, and it is stated in the Federal Law # 8.069/1990, which is based on the integral protection of children and adolescents, until the age of eighteen and, in special conditions, for those who are between 18 to 21 years old. The study, based on analysis of documents, aims at the qualitative analysis of the socio educational policy of rights, observing the issues regarding the obedience to judicial decisions, when it is inserted in socio educational programs, taking into account their execution, nature, type, modality and financial aspects. According to Minayo (2007a), the qualitative approach goes deeply into the world of meanings, which must be shown and firstly interpreted by its own subjects. In the current investigation, observation and documental analysis, in addition to field research (semi structured interviews), were the basis for its understanding and synthesis. To carry out the analysis, city counselors for the right of children and adolescents were interviewed, as well as tutelary authorities and social educators from the Reference Center of Socio Education and from Municipal Socio-Citizenship Assistance Secretary. The interviews, considered the empirical basis of the research, when the limits and capacities of the interviewed subjects were mentioned, enabled to apprehend the agreements and disagreements indicated in their practical actions. / Resumen: Esta investigación aborda La política socioeducativa de derechos para el adolescente em conflicto com La ley, com enfasis em lãs medidas socioeducativas ejecutadas em el município de Maringá, ubicado em La región Norte Del Estyado de Paraná. Esa política se encuentra em el marco jurídico-institucional (ley e sistema) Estatuto da Criança e do Adolescente (ECA), Lei Federal nº 8.069/1990, volcada para La protección integral de niños y adolescentes hasta los 18 años de edad y, em condiciones especiales, entre 18 y 21 años. El estudio de base analítico-documental tiene como objetivo el análisis cualitativo de la política socioeducativa de derechos, observando los quesitos respecto el cumplimiento de las decisiones judiciales, cuando inserto en programas socioeducativos, considerando los aspectos de la ejecución, naturaleza, tipologia, modalidades y financiamento. El abordaje cualitativo segundo Minayo (2007a) profundizase en el mundo de los significados, el cual debe ser expuesto e interpretado primeramente por los propios sujetos investigados. En la presente investigación, la observación y el análisis documental con el abordaje en el campo (entrevistas semiestruturadas) fueron la base de la comprensión y de la síntesis del trabajo. Para la consecucióndel análisis fueron entrevistados: consejeros municipales de los derechos de la infancia y la adolescencia, consewjereos tutelares, educadores del Centro de Referencia Socioeducativo y de la Secretaria Municipal de Asistencia Social y Cidadania. The study is going to be presented in this paper intends to analyze the guarantee of the rights of teenagers who pay their penalties through social and educational measures in open spaces, from the point of view of the Social Service. The work of a social worker with these teenagers is full of possibilities and limits. The grounding of this paper rewinds the beginning of this career and of the professional assignment connected to childhood and youth, having as focus the conflict to guarantee social rights of transgressor teenagers. This is a qualitative research, which uses as main technique interviews with social workers who follow teenagers that are under social and educational measures through Assisted Freedom and Community Service. To data collect, it was written an interview guide, which was applied to eight social workers that are involved in treatment centers of social and educational measures in open spaces, in the cities of Fortaleza-CE and Aracaju-SE. The research in Fortaleza-CE happened on April of 2013, and on November of 2013 in Aracaju-SE. After the interviews, the data collected was analyzed through a selection of speeches that are relevant to this study, articulated with some thoughts of writers who dedicated to researches in this subject. The results of this study emphasize that these professionals act in order to pursue the guarantee of teenagers rights, despite the difficulties to access these services. Another information found is about the actions and techniques used in this job, such as individual treatment, collective treatment, home visits, another politics, among others. It was found also some aspects that make these actions harder to execute, like discrimination to teenagers, little investment in childhood and youth, lack of capacity of the professionals who work with them, among others which point out the weakness to guarantee what is fixed by law. Therefore, it is considered that this research revealed limits and possibilities about the garantees of rights of teenagers who pay penalties through social and educational measures in open spaces, as well as the necessity to enlarge and improve the treatment to these young people. It is recommended studies about the politics directly related to treatment of these teenagers that are under social and educational measures, in order to provide to the hard job with subjects so discriminated by great part of society. / O estudo a ser apresentado tem como objeto a análise da garantia dos direitos de adolescentes que cumprem medida socioeducativa em meio aberto, a partir do Serviço Social. O exercício profissional do assistente social junto a esses adolescentes é permeado de possibilidades e limites. A fundamentação teórica resgata o início da profissão e do exercício profissional vinculado à infância e juventude, tendo como foco a luta pela garantia dos direitos sociais dos adolescentes que cometeram ato infracional. Trata-se de uma pesquisa qualitativa, que utiliza como técnica principal a entrevista com assistentes sociais que atuam no acompanhamento aos adolescentes em cumprimento das medidas socioeducativas Liberdade Assistida LA e Prestação de Serviço à Comunidade PSC. Para a coleta de dados, foi previamente elaborado um roteiro de entrevista, sendo aplicado a 8 assistentes sociais em exercício profissional nos núcleos de atendimento de medidas socioeducativas em meio aberto, em Fortaleza-CE e Aracaju-SE. Ressalta-se que a pesquisa de campo em Fortaleza foi realizada no mês de abril de 2013 e, em novembro de 2013, foram realizadas as entrevistas em Aracaju-SE. Posteriormente, foi feita a análise dos dados coletados nesses espaços, por meio de seleção das falas relevantes a esse estudo, bem como da articulação com o pensamento de autores que se dedicaram a pesquisas acerca dessa temática. Os resultados do estudo enfatizaram que existem ações desenvolvidas por esses profissionais, no que diz respeito à busca pela garantia dos direitos dos adolescentes, apesar dos impasses existentes com relação ao acesso a tais serviços. Outro dado refere-se às ações e técnicas utilizadas no exercício profissional, como atendimentos individuais, atendimentos grupais, visitas domiciliares, articulação com outras políticas, dentre outras. Constata-se, também, alguns aspectos que dificultam essas ações, tais como a discriminação com os adolescentes, o pouco investimento na área da infância e juventude, a falta de capacitação dos profissionais, evidenciando a fragilidade em garantir o que está previsto no ECA e SINASE. Considera-se, portanto, que esta pesquisa revelou limites e possibilidades a respeito da garantia dos direitos de adolescentes em cumprimento de medida socioeducativa em meio aberto, além da necessidade em ampliar e melhorar o atendimento a esses jovens. Recomenda-se a realização de estudos sobre as políticas que estão diretamente relacionadas ao acompanhamento de adolescentes que cumprem medidas socioeducativas, a fim de subsidiar a árdua atividade a ser realizada com sujeitos que são discriminados pela grande parte da sociedade.

The field of research is the Court of Childhood and Youth located in Goiânia´s County. This is a qualitative research, carried out through direct observation of informal hearings made by the prosecution and trial hearings, as well as semi-structured interviews with professionals of justice: defenders, prosecutors and magistrate. Pierre Bourdieu and Michel Foucault are central authors for this study; Bourdieu is very useful to think about how juvenile justice is organized, while Foucault contributes to the analysis of discourse. In the case of Bourdieu, the concepts of Illusio (game) and those very close to him, as field / subfield also Nomos and doxa, beyond the habitus, are here mobilized at different intensities; in the case of Foucault, the folds or successive doubles, provided by examination of practices associated with the Standards Branch, are here important. It is understood that the extension of punitive power operated in the folds that focus on the trial of juvenile justice, can only be faced with the combination of social-educational measures and protective measures, a feature that is provided by the legislation. It is analyzed, then, the reality of this possibility that will appeal to a judgment tuned to the perspective of equity. Furthermore, the introduction and the final considerations of this work are busy putting it into dialogue with topics that are on the agenda of contemporary sociopolitical scene: reducing the age of penal majority and punitive resurgence under juvenile law. / O presente estudo reflete sobre a produção da punição e dos limites e possibilidades de um julgamento, pautado pela equidade, no âmbito da justiça juvenil atuante na esfera da socioeducação. O campo da pesquisa é o Juizado da Infância e Juventude da Comarca de Goiânia. Trata-se de uma investigação qualitativa, realizada por meio da observação direta de oitivas informais da promotoria e audiências, e também entrevistas semiestruturadas com profissionais desta justiça: defensores, promotores e magistrada. Pierre Bourdieu e Michel Foucault são autores centrais para este estudo; Bourdieu é de grande valia para pensar a forma como está organizada a justiça juvenil da comarca estudada, enquanto Foucault contribui para a análise dos discursos. No caso de Bourdieu, os conceitos de Illusio (jogo) e aqueles muito próximos dele, como campo/subcampo, também nomos e doxa, além do habitus, são aqui mobilizados em diferentes intensidades; no caso de Foucault, privilegia-se as dobras ou duplos sucessivos, providenciados pelas práticas de exame, associados ao Poder de Normalização. Entende-se que a extensão do poder punitivo, operado nas dobras que incidem sobre o julgamento da justiça juvenil, só pode ser enfrentada por meio da combinação entre medidas socioeducativas e medidas protetivas, recurso este disponibilizado pela legislação que informa esta justiça. Analisa-se, então, a realidade desta possibilidade que vai ao encontro de um julgamento afinado à perspectiva da equidade. Para além disso, a introdução e as considerações finais deste trabalho se ocupam em colocá-lo em diálogo com temas que estão na pauta da cena sociopolítica contemporânea, a redução da maioridade penal e o recrudescimento punitivo no âmbito do direito juvenil.

[pt] Esta tese apresenta uma análise dos modelos de gestão da política socioeducativa em meio aberto adotados em algumas capitais brasileiros para adolescentes a quem se atribui autoria de ato infracional, com vistas a discutir possíveis caminhos que contribuam para a efetivação de medidas que promovam o respeito aos direitos humanos dos adolescentes. A pesquisa foi construída com uma abordagem quantitativa e qualitativa e fundamentou-se na perspectiva do materialismo histórico e dialético com aprofundamento teórico na criminologia crítica. Utilizou-se de fontes que dialogam com a gestão da coisa pública, Estado Penal e com o sistema de garantia de direitos da criança e do adolescente. A metodologia de pesquisa incluiu entrevistas com gestores municipais e técnicos de medidas socioeducativas, análise de documentos normativos relativos às medidas socioeducativas em meio aberto. Os resultados da pesquisa elucidam diversos aspectos referentes aos modelos de gestão adotados nos municípios analisados, destacando-se a alta rotatividades das equipes técnicas, as relações tensionadas com o judiciário, a complexidade da rede intersetorial, a insuficiência dos recursos financeiros para execução da política socioeducativa, o baixo investimento no desenvolvimento das equipes, o cenário complexo durante e após a pandemia no que tange ao fluxo da rede, o papel do judiciário, o aumento de demandas e a ineficiência dos prazos para realização dos trabalhos previstos no plano de atendimento das equipes da Assistência Social e do sistema público no modelo de gestão direta. / [en] This thesis presents an analysis of the management models of socio- educational policy in an open environment adopted in Brazilian municipalities for adolescents who are attributed with being responsible for an infraction, to discuss possible ways that contribute to the implementation of measures that promote respect for human rights. adolescent humans. The research was built with a quantitative and qualitative approach and was based on the perspective of historical and dialectical materialism with theoretical deepening in critical criminology. It used sources that dialogue with the management of public affairs, the Penal State, and the system of guaranteeing the rights of children and adolescents. The research methodology included interviews with municipal managers and technicians of socio-educational measures and analysis of normative documents related to socio-educational measures in an open environment. The results of the research elucidate several aspects related to the management models adopted in the municipalities analyzed, highlighting the high turnover of technical teams, the strained relations with the judiciary, the complexity of the intersectoral network, the lack of financial resources to implement the socio-educational policy, the low investment in team development, the complex scenario during and after the pandemic in terms of network flow, the role of the judiciary, the increase in demands and the inefficiency of deadlines for carrying out the work provided for in the teams service plan of Social Assistance and the public system in the direct management model.
