Composed of six chapters, it presents, in the first, brief study in international law with the various forms that presents terrorism. The second chapter, in turn, presents the criminal constitutional principles in the face of new criminal methods. The third chapter assesses the legal interests emphasizing the aspect of collective protection of these interests and under the perspective of constitutional interpretation, thus providing a correct interpretation of the criminal standard. The draft of the 2012 penal code transacts before the Senate House with classification proposal of terrorism crime in Articles 239, 240, 241 and 242 being what this is all about in the fourth chapter. The fifth chapter analyzes Law 7.170/83, called National Security Law and issued during the military period and its non-responsiveness to existing constitutional principles. The sixth chapter examines the terrorist crime of political boundaries under the aspect of international law, thus presenting the issues of religious and racial intolerance, setting so the consequent violations of the guarantees of fundamental civil rights / O tema desta dissertação refere-se ao estudo do delito de terrorismo à luz da Constituição Federal de 1988, a partir da análise dos mandados expressos de criminalização previstos no artigo 5º, XLIII, que determinam a edição de norma penal para tipificar o delito de terrorismo. Composta por oito capítulos, apresenta, após a Introdução, em seu segundo capítulo, um breve estudo de direito comparado, revelando as diversas formas pelas quais o terrorismo se apresenta. O terceiro capítulo, por sua vez, apresenta os princípios constitucionais penais diante das novas modalidades criminosas. Os bens jurídicos são avaliados no quarto capítulo, que enfatiza o aspecto de proteção coletiva desses bens e a perspectiva da interpretação constitucional, proporcionando assim uma correta interpretação da norma penal. O anteprojeto do código penal de 2012 tramita perante o Senado Federal com proposta de tipificação do delito de terrorismo em seus artigos 239, 240, 241 e 242; este é o assunto tratado no quinto capítulo desta pesquisa. O sexto analisa a Lei nº7.170/83, denominada Lei de Segurança Nacional, editada no período militar, e sua receptividade pelos princípios constitucionais vigentes. A long way home : cinema and the cultural map of America, 2001-2011

This thesis addresses a set of transformations in the symbolic construction of America, as reflected by a number of films released during what is commonly referred to as the post 9/11 period. Following a rich debate in the field of American literary studies, the study investigates the self-image of the nation as projected by four representative films of the decade. Throughout the chapters, the central hypothesis of the thesis is that the cultural symbology of the nation, its symbolic map, continues to act as a territorialising force within the diegetic universes of the texts. In so doing, the meta-narrative of America stands in opposition to a deterritorialising tendency that - as a body of recent critical scholarship attests - inform the post 9/11 context, a tendency borne out of a new, shared awareness of historical violence within the national community. As it displaces codified social boundaries, and established links between individual and communities, such deterritorialising rhetoric threaten the symbolic coherence of the world. The conflict between long-standing symbologies of the nation and the impact of a new cultural milieu thus emerges in the cinema as a representational impasse, whose different textual outcomes are addressed in the main chapters of this thesis. In order to investigate the interplay of different symbolic maps, the present study focuses on four spatial signifiers - the house, the village, the city and the land - and derives its methodological tools from a body of scholarship largely comprised within the so-called 'spatial turn'. The terms of this theoretical engagement are specified in the first part the thesis, while the conclusion expands on the direction of the research, and connects the study to other related disciplinary discourses, both in Film studies and American studies.

As legislações antiterror normalmente inserem-se no contexto do denominado Direito Penal do inimigo, em que se pretende a exclusão do delinquente da sociedade. Entretanto, é preciso encontrar limites operativos da definição de terrorismo de modo a permitir sua incriminação no marco das sociedades democráticas. Para tanto, por meio de uma abordagem fenomenológica, enquanto revisão crítica dos temas centrais transmitidos pela tradição filosófica através da linguagem, adota-se o método monográfico e, enquanto técnica de pesquisa, a documentação indireta, notadamente pesquisa bibliográfica espanhola e norte-americana, bem como análise de propostas legislativas e de textos legislativos, a fim de verificar a situação brasileira sobre o tema. Com isso, analisando o conteúdo do injusto de tal criminalidade, observa-se o ataque a bens jurídicos concretos protegidos pelos crimes comuns, à paz pública e as vias democráticas de tomada de decisões políticas. Assim, o método terrorista deve ter a intimidação massiva como forma de comissão, com violência reiterada e indiscriminada, a comissão de crimes gravíssimos como modo de execução e caráter armado enquanto meio utilizado. Para lograr êxito no ataque aos bens jurídicos, a conduta terrorista deverá ser executada por uma organização, imbuída de uma finalidade política, no sentido de impor uma determinada regulação à margem dos mecanismos democráticos de tomada de decisão política estabelecidos. A partir disso, o método terrorista serve como limite horizontal para a tipificação da conduta, ao passo que a estrutura organizativa serve como limite vertical e, por fim, o elemento teleológico, como limite transversal. / Analyzing the situation experienced in the law of democratic States after the terrorist attacks of September 11, 2001, occurred in the United States, there is the adoption of a series of legislative and executive measures aimed at combating such crime. The anti-terror laws usually falls within the context of the enemy called Criminal Law, according to which it is intended the exclusion of the offender from society. However, it's necessary find operating limits of the definition of terrorism to allow incrimination in the context of democratic societies. Therefore, through a phenomenological approach, while critical review of the central themes transmitted by philosophical tradition through language, it was adopted the monographic method, while technical research, the indirect documentation, notably Spanish literature and American, and analysis of legislative proposals and legislation in order to verify the Brazilian situation on the topic. Thus, analyzing the content of the unjust in such crime, there was the attack on concrete legal rights protected by common crimes, public peace and democratic process of political decision-making. Thus, the terrorist method must have the massive intimidation as a form of commission, with repeated and indiscriminate violence, the commission very serious crimes as a way of implementation and armed character as a means used. To bring about the attack on the legal interests, the terrorist conduct must be performed by an organization, which must have political purpose, to impose a particular setting the margins of democratic mechanisms established political decision-making. From this, the terrorist method serves as a horizontal limit for its characterization, while the organizational structure serves as a vertical limit and, finally, the teleological element, such as transverse edge.

Morrer pelo paraíso : o terrorismo internacional na Caxemira : entre a guerra por procuração e o Jihadismo instrumental : 1989-2009

O objetivo desta dissertação é efetivar um estudo de casos acerca da atuação das três principais organizações terroristas islamitas atuantes na região da Caxemira, uma região disputada por Paquistão e Índia, no período que vai de 1989 a 2009. O conflito pela Caxemira persiste há pouco mais de seis décadas e pelo seu domínio foram travadas duas grandes guerras, em 1947-1948 e em 1965, alguns conflitos efêmeros e embates recorrentes. Como resultado prático dos conflitos, o território da Caxemira foi dividido entre os contendores, tendo por referência limítrofe uma Linha de Controle reconhecida bilateralmente em 1972. A hipótese que orienta a dissertação defende que, seguindo as diretrizes de uma estratégia de política externa do Paquistão, de Guerra por Procuração, em finais dos anos oitenta atores privados religiosos fundamentalistas islâmicos passaram a atuar no conflito utilizando técnicas de ataque terrorista contra autoridades e população civil habitantes da porção caxemir administrada pela Índia. Ademais, estas organizações receberam o patrocínio e foram controladas pelo principal Serviço Secreto militar paquistanês, o ISID – Diretoria de Serviços de Inteligência Interligados. Assim, contando com o respaldo de setores do Estado paquistanês, como o referido Serviço Secreto, estas organizações terroristas aumentaram seu poder relativo dentro do Paquistão e no contexto regional da Ásia Meridional, trazendo problemas relacionados ao incremento da ingovernabilidade do poder central e das disputas sectárias no Paquistão, bem como, a disseminação da ação terrorista transnacional no subcontinente indiano e no Oriente Médio. / This dissertation presents a case study on the performance of three major Islamic terrorist organizations operating in the region of Kashmir, a region disputed by Pakistan and India from 1989 to 2009. The conflict over Kashmir lasts for more than six decades now and two major wars were fought over its control, in 1947-1948 besides other ephemeral conflicts and clashes. As a practical result of conflict, the territory of Kashmir has been divided between the contenders, the 1972 Line of Control being a reference frontier acknowledged bilaterally. The hypothesis that guides the dissertation argues that, following the guidelines of a Pakistani foreign policy strategy, the “war by proxy”, civil religious Islamic fundamentalists started, in the late eighties, to launch terrorist attacks against authorities and the civilian population of the territory under Indian control. These organizations received the patronage and were controlled by the main military Secret Service of Pakistan, the ISID - Inter-Services Intelligence Directorade. With the support of sectors of the Pakistani state, such as the Secret Service, these terrorist organizations have increased their relative power within Pakistan and in the regional context of Southern Asia, bringing problems related to a growing crisis of governability and sectarian disputes in Pakistan, as well as the spread of transnational terrorist action in the Indian subcontinent and the Middle East.

Serving as an unfortunate benchmark for the twenty-first century, 9/11 has completely altered society’s perceptions of personal safety, security and social identity, along with provoking intense emotional reactions. One outlet for these resulting emotions has been through art and literature. Five years have since passed and contemporary authors are still struggling to accurately represent that tragic day and its consequent impression. This paper provides an analysis of how the events of 9/11 have been incorporated into adult fiction. Variations of themes related to psychology, interpersonal relationships, political and social perspectives, and heroism were found to be used most frequently among authors.

Att ha en välfungerande intern kommunikation inom en organisation är av yttersta vikt. Att dessutom ha en välfungerande intern kommunikation under en krishändelse är fundamental. Idag hamnar samhällen och organisationer ofta i olika typer av problematiska och hotfulla situationer. Detta är nästintill oundvikligt. Det som dock är hanterbart är kommunikation kring dessa situationer. Vintern 2010 sattes Polismyndighetens kommunikation på prov i och med ett terrorattentat där en självmordsbombare sprängde sig i centrala Stockholm. Denna uppsats tar sikte på att studera och undersöka polisens interna kommunikation under denna händelse. Avsikten är att redogöra för huruvida retoriska strategier så som retorisk situation, definition och angreppssätt, tagits i beaktande under den interna kommunikationens skapande och förmedlande. Genom användandet av en kvalitativ fallstudie som metod analyserade den interna skriftliga kommunikationen. Studien visar att flera delar inom den interna kriskommunikationen kan sammankopplas med olika retoriska strategier och modeller. Dock finns det delar som kan förbättras rent retoriskt. / To have an effective internal communication within an organization is of utmost importance. To also have a well-functioning internal communication during a crisis event is fundamental. Today, communities and organizations are often placed in different types of problematic and threatening situations. This is almost inevitable. However, the communication about these situations is manageable. In the winter of 2010 the communication of the Police Authority were put to the test, because of a terrorist attack that also included a suicide bomber. This essay aims and investigates the police's internal communication process during this event. The intention is to report on whether rhetorical strategies such as rhetorical situation, definition and approach, has been taken into consideration in the internal communication. Through the use of a qualitative case study method the internal written communication were analyzed. The study indicates that several elements within the internal crisis communication can be linked with various rhetorical strategies and models. However, there are parts that can be improved.

Power, value, and the individual exchange : towards an improved conceptualization of terrorist finance

This thesis finds that the term ‘terrorist financing’ is a misnomer in that much of the activity encompassed by that term involves neither terrorism nor money. Instead, terrorist financing more accurately refers either to the flow of economic and material value to ‘terrorist’ actors or specific material expressions of support to ‘terrorism,’ however that contested term is defined. This finding not only directly challenges the dominant ways terrorist finance is now conceptualized, but also provides the first unified coherent conceptual framework capable of supporting systematic analysis of the topic. This thesis arrives at this conclusion by first critically examining the various – and often contradictory or incoherent – normative, legal, and political contexts that dominate ‘orthodox’ thinking on terrorism and terrorist finance, and then relocating the financing of terrorism squarely in context of the everyday realities of how terrorism and terrorist actors interact with global and local political economies. This thesis goes beyond existing critical works on terrorist financing, and constructs the necessary conceptual foundation for a vastly more coherent, systematic, and ultimately useful understanding of the financial and economic dimensions of terrorism.

Terroristorganisationer : En studie om terroristorganisationers mål, fiender, medel och organisationssätt.

The aim with this study is to achieve an increased understanding and knowledge about terrorist groups. The factors that the study come to be focused around is the groups' objectives, their organization, which enemies they have and with which means that they use for there terrorism. In order to respond to this aim the four different terrorist groups, Colombian revolutionary armed forces (FARC), Baskien - our native country and our freedom (ETA), red Army fraction (RAF) and al Qaida is studied. To achieve the aim of this study the methods qualitative text analysis and comparative method is being used. It is designed also within the framework of this study a categorization model that is used as method in order to do a division of the studied groups based on their objective, enemies, organization and means. The model is also constructed to be used in order to analyze others terrorist groups than these current groups. The result of the study is presented in the categorization model on page 32 in the essay.

This paper aimed at analysing what was South Africa's response to its international obligations regarding the 9/11 events and how does such response comply with the country's constitutional framework. This study gave a brief outline of the most significant legislative changes in a number of countries and then concentrate on the South African anti-terrorism legislation. It identified the provisions of the Act that have been discussed most controversial throughout the drafting process and analysed whether they comply with constitutional standards. Particular emphasis was laid on the possible differences between the South African Act and comparative legislation that derive directly from the apartheid history of the country.
