Srovnání právních úprav ochrany přírody v České republice a Spolkové republice Německo v kontextu unijního práva / The comparison of the legal regulations of nature conservation in the Czech Republic and in Germany in the context of the EU law

The doctoral thesis is thematically focused on a particular area of the environmental law, nature conservation. The first chapter presents selected significant international conventions and EU regulations, e.g. the Birds Directive and the Habitats Directive. The other parts deal with a comparison of the constitutional framework of environmental protection and nature conservation including the introduction of the general principles of the nature conservation in Federal Act on the Conservation of Nature and Landscape. Other chapters are focused on a comparison of general and specific nature conservation. The thesis contains selected decisions of the Court of Justice of the European Union against Germany. In the conclusion, the answers to questions are given, the introduced legislation is compared and substantial differences in both legal systems are discussed.

The first part of the study refers to the events of direct enforcement and nationalization of foreign arbitral awards, according to the new legal provisions of the New Brazilian Code of Civil Procedure. The second part of the study covers the assessment of the ratification process of foreign arbitral awards before the Superior Court of Justice (STJ), considering Brazil s new Code of Civil Procedure, the new internal rules of the Superior Court of Justice, the Arbitration Law and the New York Convention. The thesis also covers two cases, specifically, judged by the Superior Court of Justice: SEC No. 2,410 (Ferrocarriles versus Supervia Concessionária de Transportes Ferroviário S/A) and SEC No. 826 (Ssangyong Corporation versus Eldorado Indústrias Plásticas Ltda). Finally, after the reflection on the research conducted, one argues nationalization of the foreign arbitral award is possible given the new provisions included in Brazil s new Code of Civil Procedure and the acknowledgement thereof by the Superior Court of Justice, in the possibility of nationalization of the arbitral award in the Appeal to the Superior Court of Justice No. 1.231.554 / A presente dissertação de mestrado trata do reconhecimento e da execução da sentença arbitral estrangeira no Brasil. É uma pesquisa teórica e prática das áreas de direito processual civil e direito internacional, uma vez que aborda as mais diversas legislações internacionais e convenções que tratam da arbitragem comercial internacional e o reconhecimento e execução dos laudos arbitrais. Na primeira parte do estudo, serão analisadas as hipóteses de execução direta e nacionalização do laudo arbitral estrangeiro conforme novos dispositivos legais oriundos do Novo Código de Processo Civil. Na segunda parte, será abordado o processo homologatório de sentenças arbitrais estrangeiras perante o Superior Tribunal de Justiça tendo em vista o Novo Código de Processo Civil, o novo regimento interno do Superior Tribunal de Justiça, a Lei de Arbitragem e a Convenção sobre o Reconhecimento e a Execução de Sentenças Arbitrais Estrangeiras ("Convenção de Nova Iorque"). Firstly, it is studied the Constitutional Model of these Extraordinary and Special Appeals, talking about the history of the High Courts and how these appeals came out and were defined by the Brazilian Federal Constitutions. The general theory of the Extraordinary Appeals is analysed with its requirements of admissibility. The devolutive and transferable effects are studied to show that Extraordinary and Special Appeals do not have the last one. The idea of the complete motivation of the decision is an important topic of the work. The appeal of requesting clarification of a decision is studied in this context. The preclusion, definition and examples of matters of public order are examined too. It was possible, after this work, to verify that the constitutional rules must be observed and they determine that it must exist decided cause about the issue at the appealed decision. The knowledge of matters of public order by the High Courts depends on it, because the Constitution does not make exceptions. The function and the purpose of the Supreme Court and the Superior Court of Justice, the objectives of the Extraordinary Appeal and the Special Appeal, their requirements and the importance of the uniform interpretation of the Federal Constitution and the Federal Laws are topics to which special focus was given / O presente trabalho examina o prequestionamento e, principalmente, analisa se questões de ordem pública poderiam ser conhecidas no julgamento de Recursos Extraordinários para o Supremo Tribunal Federal e Recursos Especiais para o Superior Tribunal de Justiça. Primeiramente, é estudado o Modelo Constitucional desses Recursos Extraordinário e Especial, falando sobre a história dos Tribunais Superiores e como esses recursos surgiram e foram definidos pelas Constituições Federais Brasileiras. A teoria geral dos Recursos Extraordinários é analisada com seus requisitos de admissibilidade. Os efeitos devolutivo e translativo são estudados para mostrar que Recursos Extraordinário e Especial não possuem este último. A idéia da motivação completa da decisão é um tópico importante do trabalho. O recurso de Embargos de Declaração é estudado neste contexto. A preclusão, definição e exemplos de questões de ordem pública também são examinados. The topic under epistemological and dogmatic points of view retakes the concepts of fact and norm to critically analyze the court decisions in the application of its seventh abridgement that states: "The pretension of simple evidence reexame does not try the appeal to the Superior Court of Justice". Therefore, is applied an epistemological and procedural retrospect, from Roman Law to nowadays Instrumentalism, questioning the current landmark of analysis. Under a dogmatic boarding it is cogitated the possibility of setting distinctive criterias of fact and norm concepts, concluding for its impossibility, especially if anchored in the subsumetive paradigm. The present text, based on the Knijnik´s Tricotomic Theory and its concept of mixed questions, attempts to overcome the subsumetive paradigm. However, it concludes that the Tricotomic Theory tackles in an artificial division of concepts. As contribution for a new dogmatic, the present text offers a linguistic and discursive approach of the subject. In support to this approach, axiology and semiotics are binded towards a rhetorical reconstruction, that reread after-modern fashion offers a chance of reflection under more current argumentative and systematic prisms to the procedural thought. After these retaken cases are analyzed it is possible to isolate and criticize emblematic examples of the incompatibility involving the theory of the common sense of the procedure (subsumitive and binary) in contrast with the court decisions (rhetorical and complex). / O reexame de prova em recurso especial é o tema abordado pelo presente texto, que sob o ponto de vista epistemológico e dogmático retoma os conceitos de fato e direito no propósito de analisar criticamente a jurisprudência do Superior Tribunal de Justiça no que concerne à aplicação da sua Súmula 7, segundo a qual: A pretensão de simples reexame de prova não enseja recurso especial . Nesse intuito, parte-se em retrospectiva epistemológica e processual, desde o direito romano à instrumentalidade, questionando-se acerca da atualidade desse marco de análise para objetivo proposto. Ao mesmo tempo, cogita-se, sob um ponto de vista mais dogmático, da possibilidade de fixação de critérios distintivos dos conceitos de fato e direito, concluindo-se pela sua impossibilidade, especialmente se ancorada a discussão no paradigma subsuntivo. A partir desse ponto, o texto aborda tentativas de superação desse paradigma, inclinando-se à Teoria Tricotômia de Knijnik e seu conceito de questão mista. No entanto, conclui que mesmo a Teoria Tricotômica está comprometida em demasia com uma divisão artificial dos conceitos, pelo que se propõe uma abordagem lingüística e discursiva do tema como contribuição para uma nova dogmática. Em amparo a essa abordagem, são cotejadas axiologia e semiologia rumo a uma reconstrução retórica, que relida à moda pós-moderna oferece ao pensamento processual oportunidade de reflexão sob os prismas argumentativos e sistemáticos mais atuais. Somente após essa retomada é analisada a jurisprudência do STJ, fazendo-se possível isolar e criticar casos emblemáticos da incompatibilidade entre a teoria embasadora do senso comum do processualista (subsuntiva e binária) em contraste com a prática judiciária (retórica e complexa).

Consistency in the international law of maritime delimitation : towards a set of common principles for the judicial establishment of maritime boundaries

This thesis examines the process applied by international tribunals for delimiting Exclusive Economic Zone (EEZ) and continental shelf boundaries under international law. Maritime delimitation is governed by articles 74 and 83 of the 1982 UN Convention on the Law of the Sea (UNCLOS), which are customary international law. However, owing to the vagueness of such legal provisions, international tribunals have been developing a standard process for delimiting maritime boundaries. The delimitation process has evolved significantly since the 1969 judgment of the International Court of Justice (ICJ) in North Sea Continental Shelf. The ICJ re-stated this process in its 2009 Black Sea judgment as being constituted of three stages: first, an equidistance line is provisionally drawn; second, this line is adjusted should relevant circumstances so require; third, the overall equitableness of the boundary is evaluated by assessing the proportionality between the length of the relevant coast and the marine areas appertaining to each state. This thesis analyses each stage of the delimitation process as re-stated in Black Sea. By way of introduction, chapter 1 outlines the relevant legal provisions and the historical evolution of the delimitation process through the jurisprudence of international tribunals. Chapter 2 discusses both the notions of the relevant coast and of the relevant area, and the practical methods for their identification. Since Black Sea, international tribunals have tended to identify the relevant coast and the relevant area prior to establishing a provisional equidistance line. Chapter 3 discusses the issues concerning the drawing of the provisional equidistance line. Chapter 4 examines relevant circumstances and the methods for adjusting an equidistance line. Chapter 5 discusses proportionality. Using doctrinal legal research methodologies, this thesis aims to assess the degree of consistency in the international tribunals’ application of the three-stage delimitation process. It argues that, while great leaps forward have been made since 1969, there is still a number of unresolved issues, in relation to which this thesis endeavours to provide some workable solutions.

Développées par la Cour de Justice, les invocabilités des directives européennes définissent les conditions permettant aux personnes juridiques de se prévaloir d'une directive dans leurs rapports juridiques. La Cour de Justice a réussi à introduire ces invocabilités dans les ordres juridiques nationaux, notamment en Italie et en France, en s'appuyant, d'une part, sur des éléments déjà existants dans les ordres juridiques des États membres, tels que la technique de l'interprétation conforme et le principe de la responsabilité de la puissance publique, en les faisant évoluer dans le sens européen. D'autre part, la Cour a aussi créé des outils nouveaux et, finalement, révolutionnaires, tels que les invocabilités de substitution et d'exclusion de la norme nationale incompatible avec une directive européenne. La mise en oeuvre de ces invocabilités a eu des répercussions importantes sur le rôle des juridictions nationales, qui ont vu l'ensemble de leurs missions s'étendre. La sphère juridique des particuliers a également été influencée, de façon imprévisible et, parfois, préjudiciable. / Developed by the European Court of Justice, the invocability of EU directives defines the conditions allowing legal subjects to exercise the rights conferred by a directive in their legal relationships. The ECJ has managed to introduce different types of invocability into the member States national legal orders, and notably in Italy and France, by, on the one hand using some pre-existing elements of the national legal orders, such as consistent interpretation and the principle of State liability, and making them evolve in a European way. And, on the other hand the ECJ has also created new and, finally, revolutionary tools, such as invocability of substitution and invocability of exclusion of the national law incompatible with a EU directive. The implementation of these different types of invocability has had a deep impact on the role of national courts, who have seen their mandate extended. The legal sphere of legal subjects had also been influenced, in unpredictable and sometimes detrimental ways.

La lutte contre le terrorisme, ainsi que ses conséquences sur la sphère des droits de l'Homme, n'est pas un thème nouveau en Europe. Cependant, depuis les attentats du 11 septembre 2001 perpétrés sur le sol des Etats-Unis, «confirmés» par ceux de Madrid en 2004 et Londres en 2005, elle n'a jamais incarné une telle priorité. La majeure partie des mesures prises par l'Union européenne tombe sous le titre de la coopération en matière pénale, c’est-à-dire sousl’ex-troisième Pilier, parmi lesquelles la décision-cadre sur la lutte contre le terrorisme, la décision-cadre sur le mandat d'arrêt européen et les accords entre l'Union européenne et les Etats-Unis d'Amérique sur l'extradition et l'assistance juridique mutuelle. Sur base des mesures européennes, certains Etats, historiquement non concernés par ce phénomène, ont été pressés à adopter des mesures anti-terroristes alors que d’autres y ont vu une légitimation pour renforcer leur corpus juridique déjà existant. Quel est l'impact des mesures européennes et de celles prises par les Etats sur le délicat équilibre entre la sécurité et la liberté ? En d'autres termes, quel est le rôle de l'Etat de droit : une limitation à ces mesures ou, un principe visant au renforcement du combat contre le terrorisme? / The fight against terrorism, as well as its consequences in the field of Human Rights, is not a new theme for Europe. However, since the terrorist attacks of September the 11th 2001 in the United States of America, “confirmed” by the ones of Madrid in 2004 and London in 2005, it has never embodied such a priority. The larger part of the measures taken by the European Union falls under the heading of cooperation in criminal matters, i.e. within the scope of the former Third Pillar, among which the framework decision on combating terrorism, the framework decision on the European arrest warrant and the agreements between the European Union and the United States of America on extradition and mutual legal assistance. On basis of the European measures, some States, not historically concerned by terrorism, have been compelled to carry out counter-terrorism measures whereas, others have seen a legitimation to reinforce their existing body of law. What is the impact of the European measures and the ones taken by States on the delicate balance between security and liberty? In other words, what is the role of the Rule of Law: a limitation to those measures or, a principle aiming to the strengthening of the fight against terrorism?

Female petty crime in Dundee, 1865-1925 : alcohol, prostitution and recidivism in a Scottish city

Late-nineteenth and early twentieth-century Dundee had a strikingly large female workforce and this fact has attracted much scholarly attention. But existing research has not probed the official crime records to determine whether the associated local stereotype of the disorderly mill worker, as a ‘moral blot' on the landscape, is justified. This study looks at female criminality in Dundee 1865–1925. It finds that drunkenness, breach of the peace and theft were the leading female offences and that the women most strongly associated with criminality belonged to the marginalised sections of the working class. Amongst them were the unskilled mill girls prominent in the contemporary discussions, but it was prostitutes and women of ‘No Trade' who appear to have challenged the police most often. They were frequently repeat offenders and consequently this thesis devotes considerable attention to the women entrenched in Dundee's criminal justice system. A pattern noted in the city's recidivism statistics, and often echoed elsewhere, is that the most persistent offenders were women. The fact that men perpetrated the majority of petty crime raises the suspicion that the police statistics capture differential policing of male and female recidivists – an idea that builds upon feminist theory and Howard Taylor's stance on judicial statistics. Yet a detailed study of the archives reveals that there are as many examples of the police treating women fairly as there are of gender-biased law. Indeed, several practical constraints hindered over-zealous policing, one of which was the tendency of the local magistrates to throw out cases against prostitutes and female drunks. This thesis, taking the police and court records as a whole, emphasizes that it was generally pragmatism, rather than prejudice, that guided the sanctioning of female recidivists in Dundee.

Particularly in TJMG, Family Court Divisions demanded written Social Studies and Investigations of social workers. Those professionals are commissioned as State Representatives to implement an intervention in family environment. Such intervention intends to produce a technical document (Social Study or Social Report) that must be able to support judicial decisions, as an expert analyses recommending whether is possible or not to concede a custody petition. In this way, social study reports need to demonstrate some aspects and determinants about social and family life of all those involved in law action, as: intrafamily relationship (affective links, socialization processes and potential physical and psychological violence occurrences); social questions those would be identified as family conflict causes or social questions those would can still provoking it; social relationships of family group and their general social and economical conditions. This research demanded closest approximation of this kind of social worker instrument of communication in the forensic universe and it had written keeping in mind how it could contribute to professional usage in this specific area. However, this research does not restrict itself on what those professionals have showed in their discourses about values, but it has driven itself through ethical commitment to the users that are involved on the intervention process and social report. From this assumption, this dissertation focuses institutional status, central elements and professional development of social worker, and a brief historical trajectory of Social Service in the Judiciary System of Minas Gerais State. After all, this research was built upon presuppositions of conservative though and 1993 Ethical Code of Social Worker s values and principles / A presente dissertação foi realizada com o objetivo de analisar os laudos sociais elaborados pelos assistentes sociais que atuam junto às Varas de Família dos Fóruns do Tribunal de Justiça de Minas Gerais, sob o ponto de vista dos valores e princípios éticos presentes no Código de Ética do Assistente Social (1993). No TJMG, especificamente no que tange às Varas de Família, os assistentes sociais são solicitados para a realização de Estudos Sociais ou Perícias Sociais, ou seja, são demandados, enquanto representantes do Estado, a intervir no espaço familiar. A finalidade dessa intervenção é a elaboração de um documento técnico (laudo social ou relatório social), que ofereça subsídios para a decisão judicial, isto é, uma análise e um parecer sobre as possibilidades de efetivação da guarda pleiteada. Para isso, o estudo social precisa contemplar os aspectos/determinantes da vida sócio-familiar dos sujeitos envolvidos naquela ação judicial: suas relações intrafamiliares (vínculos afetivos, processos de sociabilidade, intercorrência de situações de violência física e psicológica); as questões sociais que provocaram ou provocam o conflito vivenciado, e as possíveis redes sociais de apoio; as relações sociais estabelecidas pelo grupo familiar e as suas condições sócio-econômicas. Ao realizar a pesquisa, buscamos nos aproximar desse instrumento de comunicação do assistente social no universo forense, na perspectiva de contribuir para uma reflexão sobre os valores e princípios éticos que pautam o exercício profissional nesse campo específico de atuação. Contudo, não nos baseamos apenas no que foi explicitado pelos profissionais em seu discurso sobre valores, mas no compromisso ético firmado com o usuário no processo de intervenção e na elaboração do laudo social.
