Previous issue date: 2011-06-29 / Este trabalho aborda a narrativa de Clarice Lispector através de uma articulação entre o discurso literário e o discurso psicanalítico. As obras selecionadas para maior aprofundamento foram os contos Miopia progressiva, A legião estrangeira, que fazem parte do livro Felicidade clandestina e o conto Amor, do livro Laços de família. Utilizamos alguns conceitos da teoria psicanalítica, principalmente os três registros lacanianos para situar e elaborar um ponto de ruptura recorrente da narrativa de Clarice, que denominamos confins do simbólico, como lugar da invenção do sujeito. Borda ou litoral situada entre o Real e o Simbólico, momento ambíguo da linguagem, porque toca o limite onde o sentido vacila e o novo se anuncia como virtualidade, este é o lugar originário do sujeito. Os personagens de Clarice Lispector se encontram repetidamente lançados na ambigüidade deste ponto que ilustra, na interface dos discursos, Literário e Psicanalítico, o saber sobre o sujeito da linguagem, que é também o sujeito do inconsciente.

Previous issue date: 2013 / CNPQ; REUNI / Vários estudos apontam que vítimas de situações traumáticas são propensas a narrar a sua história na tentativa de dar sentido a essas experiências. A pesquisa em questão ressalta a construção dos sentidos configurados narrativamente pelo sujeito vítima de queimadura, pois entendemos que as marcas, sequelas e cicatrizes produzidas pelo incidente convocam o sujeito a se reposicionar subjetivamente frente a sua nova condição. Assim, o objetivo principal deste estudo foi investigar como o paciente organiza narrativamente a sua relação eu-corpo, tendo como referência o incidente da queimadura. Os objetivos específicos consistiram em: (i) analisar se o evento da queimadura conduz o paciente à re-historiação; (ii) circunscrever os sentidos configurados narrativamente pelo sujeito acerca do incidente da queimadura; e (iii) identificar se há mudança no posicionamento do paciente no que se refere à relação eu-corpo. O delineamento da pesquisa se constituiu em três estudos de casos. Desse modo, participaram da pesquisa três mulheres adultas, vítimas de queimadura, que estavam em atendimento no Hospital da Restauração, em fase de reabilitação de longa duração. Foram utilizadas três estratégias para a construção dos dados: a técnica da observação espontânea, o questionário misto e uma entrevista com depoimento pessoal. O procedimento de produção dos dados aconteceu em dois momentos: (i) observação do funcionamento do Centro de Tratamento de Queimados e, ao mesmo tempo, a escolha dos possíveis participantes; (ii) aplicação do questionário e, por conseguinte, a entrevista com o paciente. Para analisar os dados, utilizamos a análise do discurso de Orlandi. Essa análise nos possibilitou constatar que o sujeito, ao sofrer um acidente traumático proveniente de queimaduras, é propenso a revisitar a sua história de vida, enfatizando o antes e o depois do incidente. Também visualizamos que os sentidos produzidos por eles são configurados em tramas discursivas carregadas de muita dor e sofrimento, marcadas pelo real do seu corpo. Em síntese, compreendemos que a representação da relação eu-corpo é construída narrativamente a partir da interface que o sujeito estabelece com o seu corpo e com a cultura, pois as experiências sentidas e vividas nessas relações, sejam elas conscientes e/ou inconscientes, possibilitam ao sujeito narrar essas experiências como histórias. Portanto, o eu e o corpo formam uma relação íntima na qual o sujeito constrói a representação de si através do discurso narrativo.

This thesis deals with the fundamental right to the protection of personal data as enshrined in Article 8 of the Charter of Fundamental Rights of the European Union ('the Charter'). An analysis of the case law of the Court of Justice of the European Union (CJEU) on Article 8 of the Charter reveals an intriguing paradox: although this provision has been repeatedly invoked in order to enhance protection of personal data and has featured prominently in several far-reaching judgments (Digital Rights Ireland, Google Spain or Schrems), there is considerable uncertainty as to the substantive scope of the right to the protection of personal data. The relationship between the right to privacy and the right to data protection has proved difficult to untangle, and the autonomous nature of Article 8 of the Charter has not always been respected. The aim of the thesis is to analyse the purpose and content of this fundamental right with reference to the CJEU's case law and recent academic debate. This thesis is divided into four chapters. The topic dealt by this study is about protection of GIs, and the problem attempted is what should be the position of the EAC regarding the protection of GIs in the final EPA negotiations with the EU? In addressing this problem, the paper hypothesised that, there are abundant potential GIs in the EAC and their protection can result to profound positive economic contribution to the region. Hence, EAC should opt for the protection of GIs in the final EPA text with the EU. Moreover, most potential GIs found in the EAC are agro-based products of which their production costs are less than EU’s GIs, because of comparative advantage in agricultural production. It follows therefore that, in addressing the said problem the paper runs as follows. Chapter one addresses historical overview of the ACP-EU relations that resulted to the current EPA’s negotiations, objectives and principles of EPA, and lastly the current status of EAC-EPA negotiations. Whereas in chapter three meaning of the term GI, Legal frameworks used to protect GIs are comprehensively examined. Also in this chapter the feasibility of EAC legal framework for protecting GIs is also explored. Chapter four addresses the economic rationale and associated benefits of protecting GIs, and the requisite conditions needed for a product to qualify GI status. Whilst chapter five addresses potential GIs found in the EAC partner states, policies and legal frameworks available to administer such potential GIs. Chapter six covers general conclusion for various findings observed by the study and provides recommendations as to which position should EAC opt, reasons for the same and also addresses possible areas for future research. Conclusively, the paper after intense observations, recommends the EAC to opt for inclusion of the GIs in the final EPA text. The reason being that, there are several economic, social and ecological benefits accrued from protecting GIs. in English This thesis deals with the right to personal data protection as enshrined in Article 8 of the EU Charter of Fundamental Rights (the Charter) and its relationship with Article 7 Charter, the right to respect for private and family life. Since both of the rights have immediate relevance for EU data protection, their coexistence in the Charter necessitates an explanation as to their relationship, interaction and the merit of adding an independent right to personal data protection. However, such explanation is difficult to trace. International human rights instruments have traditionally safeguarded the protection of personal data by the right to privacy. The common constitutional traditions of the Member States differ significantly in the enactment of data protection and the EU legislation in force is likewise treating data protection as a privacy subset. The thesis firstly attempts to assess whether the right to personal data protection is capable of autonomous standing, detached from the privacy right and secondly, whether the CJEU allows the right to personal data protection to stand as an autonomous right in reality.
