[en] SEX REASSIGNMENT AND THE USELESS OF JUDICIALIZATION FOR RECTIFICATION OF BIRTH REGISTRATION: REMOVAL OF TRANSITION RITUALS IN ORDER TO IMPLEMENT TRANSSEXUALS FUNDAMENTAL RIGHTS IMMEDIATELY / [pt] REDESIGNAÇÃO DE SEXO E A DESNECESSIDADE DE JUDICIALIZAÇÃO PARA RETIFICAÇÃO DO REGISTRO DE NASCIMENTO: ELIMINAÇÃO DE RITUAIS DE PASSAGEM NA BUSCA DE IMPLEMENTAÇÃO IMEDIATA DE DIREITOS FUNDAMENTAIS DOS TRANSEXUAIS

NEWTON TEIXEIRA CARVALHO 21 February 2019 (has links)
[en] The current thesis is a study about the transsexuality in the Brazilian Law. Based on central issues related to the dignity of the human person, the study analyzes the construction of the concept of transsexuality throughout history, especially of the Medicine History, searching for answers about the discriminatory treatment that the transsexuals are constantly submitted in the social environment. The origin of the vision of transsexuality is sought as something abnormal, sick, in need of repair, to finally deconstruct this stereotype that was established over time and that prevails nowadays, including in the legal environment. The constitutional principles of Equality, Dignity and the Right to Intimacy are used as the basis in the elaboration of a respectful treatment proposal to the people who present this behavior as deviant, but which is nothing more than the expression of its identity. The lack of actions of the Legislative Power, the discrepant action of the Judiciary in identical factual situations and the insufficiency of the Executive Power measures serve to show the urgency of the confrontation of the subject by the Brazilian Law. The examination of other legal systems is done for the elaboration of suggestions aiming the overcoming of the above problems, especially regarding the change of civil registry.

No. of bitstreams: 1 Joao Paulo de Athaide.pdf: 591143 bytes, checksum: 564faf937fe9b228853934b586cd835a (MD5) Previous issue date: 2013-05-28 / The leitmotif of this thesis is to penetrate the current process of formation of referential contemporary identity through the construction of so-called trans identity, which aggregates the population groups transvestites, transsexuals and transgendered Brazilians. Initiated during the dynamic National Meeting of Transvestites and Transgenders That Fight against AIDS in June 2007, I sought to penetrate the significance that occurs and the formation of these roles in a specific socio-political representation through the interview technique of depth. Urbanites who are not part of this highlighted classificatory structure and had no place to interact with the like of so many outsiders, and therefore start questioning the various social markers in order to deconstruct them, encouraging the creation of spaces where the "different" can also contribute to the construction of identity references that are not conventional. Attitude. It is the completion of the trans person's identity and transformation into the urban lifestyle. Understood as the inclusion of these people in a particular interaction aiming to break free from the shackles of a negating modernity and contribute to the formation of other historical period called hypermodernity / O fio condutor dessa dissertação foi devassar o atual processo de formação do referencial identitário contemporâneo, através da construção da chamada identidade trans, que agrega os grupos populacionais de pessoas travestis, transexuais e transgêneros, brasileiros.

Responsividade como recurso relacional para a qualificação da assistência a saúde de lésbicas, gays, bissexuais, travestis e transexuais / Responsivity as a relational resource for enhancing healthcare assistance to lesbians, gays, bisexuals, transvestites and transgender people

Moscheta, Murilo dos Santos 21 October 2011 (has links)
This study aims to understand the challenges of public healthcare assistance to lesbian, gay, bisexual, transvestite and transgender people in Brazil (LGBTs). In addition, it also aims at elaborating relational resources for enhancing available assistance and the inclusion of this population in care services. Therefore, this study is built upon the premise that healthcare assistance to LGBT population presents necessities of improvement that, if adequately met, could contribute to the construction of a public health project that is equitable, integral, inclusive and culturally sensitive. In order to delineate the field in which this study is situated, I present the changes in Brazilian healthcare policies and highlight the Politics of Integral Attention to LGBT as well as the National Politics of Humanization. I also develop my argument within an historical scenario that contributes to our understanding of the shift in LGBT identity descriptions: from pathological to oppressed. Likewise, I introduce the history of healthcare practices that has led to the formulation of the contemporary Brazilian healthcare model in which equity and justice are organizing principles and health is not disconnected from its social determinants. Finally, I develop my argument within a scientific scenario permeated by discussions that emphasize a paradigmatic shift from modernism to post-modernism and lays the groundwork for movement from a technique-oriented and objective emphasis to a relativistic and relational approach. The investigation took place in a Basic Healthcare Center of a middle size city in which I facilitated 8 group meetings with a multidisciplinary team of health professionals. Meetings were audio-recorded. I kept a journal with field notes throughout the research process. I performed a thematic transcription and organized the contents of the transcripts according to groups of meanings. This organization allowed me to create a narrative in which I present each group meeting and, at the same time, discuss relevant aspects of LGBT health assistance as it relates to available literature. From this narrative, I chose to develop an argument that emphasizes responsivity as a resource for healthcare professionals. Initially, I present a definition of responsivity and later I articulate it with the research experience. Finally, I present some considerations about the generative potential of this resource to LGBT healthcare assistance.

The last decades have been marked by major changes in all sectors of society, which ends up raising outstanding questions that neither the law either the society itself have answers. The right to health, guaranteed in the Article 6 of the Federal Constitution of 1988 and regulated by the creation of the Unified Health System, determines the universal, full and equal access to this right, and never before society had so many possibilities and access to so many rights as it has nowadays. However, live the era of rights does not mean actually having access to all of them: when we refer to transgender identities, the right to health is relativized, since for those people the right to full health depends on the criteria and conditions imposed by international standards followed in Brazil, for which only one who is diagnosed ill can have access to transsexual procedures. This hurts the exercise of their autonomy, since transsexuals are limited by gender norms on the pathologizing of experience. The condition of sick person at the same time as they are received (transsexual program) are excluded by rules governed by explanations accepted as official, however, lagged, since there is no examination or symptom that leads to the conclusion that the transsexual is upset, coupled with the fact the various changes that the recommendations that include transsexuality in mental disorders catalogs have suffered over the years, showing that they are not static references, therefore, subject to changes mainly in order to give effect to the right to health. This discrepancy between the rights established as international recommendations and the law as a form of social life, which has its reality in the will of society, the legal reality of life is the main face of depathologization by transsexuals. The vulnerability brought by pathologization shows that Brazil is the country with the highest number of transgender murders in the world. Therefore, the design of the transsexual as a subject non-standard non-binary gender normality and labeled as sick person, brings enormous suffering, including the voluntary and early terminally life. So this dissertation aims to induce a reflection on the right to health of transsexual people, demonstrating that there is the possibility of modifying the conditions imposed by international recommendations in our country, which has autonomy for the maintenance of transsexual processes in Unified Health System without the need of a pathologizing diagnosis. These changes in the Brazilian structures and government programs are possible and necessary, which will allow access to the right to health to all, regardless of conditions and, especially, gender identity. The main goal is to bring to reflect the elimination of the word disorder and, hence, the elimination of pathologic diagnosis, given that transsexuals are engaged in the search of autonomy and identity, since they are not sick or abnormal.

A assistência à saúde de pessoas transexuais: aspectos históricos do processo transexualizador no Estado do Rio de Janeiro / The health care of transsexual people: historical aspects of the sex reassignment process in the State of Rio de Janeiro

Mably Jane Trindade Tenenblat 30 April 2014 (has links)
This dissertation examines the implementation of the sex reassignment process in the Unified Health System (SUS), from the ideals of the Health Reform Movement and a historical perspective of the Brazilian public health policy, focusing on the particularities of the State of Rio de Janeiro. Some aspects of transsexuality related to the state's sphere and to the effective realization of the rights of the LGBT population are discussed, particularly the access to health care for transsexual people. The time frame covers the period from 1970, when the first reassignment surgeries were started in Brazil, and 2008, when such process was officially instituted. The applied methodology favored, as tools and techniques of qualitative research, were fieldwork and semi structured interview with professionals who have worked in the health institutions that had programs geared specifically to transsexual population in the State of Rio de Janeiro and users of health services of these programs. In this scenario of discrimination and stigma, often the result of ignorance and misrepresented information about transsexuality, it is intended to give greater visibility to the health demands of transsexuals, showing the complexity of such demands as well as the weaknesses of the model of healthcare behind the aforementioned programs. It is also intended to contribute to the fomentation of academic production of Social Work, which is relatively limited in this area.

Daniela Murta Amaral 05 August 2011 (has links)
In 2008, by 1707 Decree from the Ministry of Health, was established on the brazilian National Health System the Transsexuals Sex Reassigment Process who laid the basis for the regulation of access to the programs that perform transsexual sex reassignment procedures. This Decree, which is based on the recognition that sexual orientation and gender identity are determinants of health status and that the discomfort and inadequacy feeling related to the anatomical sex of transsexuals should be treated within the comprehensiveness care recommended by National Health System, has meant significant advances in legitimizing the demand for sex reassignment of transsexuals and facilitated access of population to health care. Although the transgenders attention proposal instituted in Brazil is about a comprehensive health policy that overtake the surgical issue and considers psychosocial factors of this experience, it is based on a biomedical model that considers transsexualism a mental disorder which diagnosis is a condition of access to care and its treatment is directed to achieving sexual reassignment surgery. In this sense, only those individuals who fit into the Gender Identity Disorder nosological category and, therefore, express the desire to adapt their body to the gender with which they identify themselves through body modification have their right to health care guaranteed. Thus, whereas in Brazil the attention to transsexuals is absolutely restricted by a psychiatric diagnosis, that at the same time legitimates the demand for sex reassignment and make feasible the access to health care is an array of pathologization and stigma that restricts the right to medical care and limits the autonomy, this study intends to discuss the challenges of depathologization of transsexuality in the management of public policies for the transgender population in the country. From a research about the historical, social and political issues that defined transsexualism as a mental disorder and about the processes that associated the regulation of access to health care to the diagnosis of transsexualism, it is expected to question the current model of trans personss care and to build new opportunities for building inclusive and comprehensiveness policies that guarantee for trans people the right to health and exercise of autonomy.

Identidade social e autoestima de travestis, homens e mulheres trans e transgêneros : a influência do apoio social

Silva, Bruno de Brito 29 August 2016 (has links)
Conselho Nacional de Pesquisa e Desenvolvimento Científico e Tecnológico - CNPq / This master thesis consists of four studies, two of theoretical character and two that have analytical and quantitative approach in order to investigate the social identity and self-esteem of transvestites and transwomen and transmen, as well as knowing the influence and role of social support network, formed by family, love relationships and the LGBT community, in the constitution of these. Studies 1 and 2 theorized on how are these phenomena among transgender, being the first a review of social identity and social support and the second, a systematic review of the literature on self-esteem with this part of the population. It was highlighted the importance of social support for the successful development and good formation of self-esteem and social identity in transgender. Study 3 adapted and investigated evidence of validity and reliability of Need for Identification Scale (nID), offering a reliable and valid measure in the measurement of social identity construct. Finally, the study 4, explored the variables mentioned above and their correlations in transgender through an online questionnaire including scales: of the body Identity questionnaire, of the questionnaire Brazilian Youth, nID Scale, validated in study 3, the ESSS and the marital satisfaction GRIMS Scale. There were 203 participants from all regions of the country, of which 34.8% were transvestites and transwomen. It was found that the bigger the family support, the higher the self-esteem, and the fact of being in hormone therapy, increasing age and satisfaction with social support, predicted greater social identification for the participants towards the identity and expressed gender belonging group. It also alert to the need for social acceptance of transgender modes/ways of existence in society.

Fundação de Amparo a Pesquisa no Estado do Rio Grande do Sul / This dissertation is chacaracterized as a study of media consumption wich articulates the senses formulated in Mundo T-Girl, an online Facebook community mainly composed of transsexuals women and travestis, their context and gender relation. Theoretically, we base ourselves in the perspective of Cultural Consumption, to assert that every consumer has a symbolic dimension subordinate to culture, revealing the meaning structures of social life. Methodologically, the research is configured as an ethnography in online context. The empirical field is Mundo T-Girl, a community on Facebook composed of transsexual women and travestis. We defined as the object of study the comments made about the celebrities. Our problem is to discover the senses that integrate and distinguish transsexual women and travestis. The main objective is to investigate the reasons why its members belong to this online space. For this, we conducted an analysis of the meanings formulated in the consumption of celebrities classified into two major groups: a) rights and political representation; b) gender roles. As results, we realize that the integrative practices in the community includes the adjustment to the current standard of femininity, as well as the discussion of a political project that consider their demands for social inclusion. At the same time, they seek to define the symbolic distance between themselves and women whose behaviors violate the conservative models of gender, as well as the part of society that does not consider them as political beings.
