O recorte do campo é uma manifestação popular, que é também um ritual e possibilita evidenciar performances, experiências, práticas e significados, que podem elucidar dimensões subjetivas e ideológicas das relações de gênero e da sexualidade. Na tentativa de aprofundar algumas questões significativas acerca das dimensões sociais evidenciadas na elaboração e performatização de personagens femininos encenados por homens travestidos no maracatu rural pernambucano, buscou-se fazer um estudo etnográfico, com base na observação participante, a partir de aspectos da trajetória de travestilidade de homens brincantes do maracatu nos ensaios e apresentações durante o período carnavalesco. Essa travestilidade se relaciona com a constituição da pessoa, com enfoque nas simbologias e classificações de gênero, originando práticas sexuais normatizadas, que incluem relações com o mesmo sexo e com o sexo oposto, até certo ponto contrastivo com a norma ocidental, que valoriza a heterossexualidade e correspondência sexo/gênero. Os papeis masculinos e femininos no âmbito do folguedo popular do maracatu constituem-se elementos organizativos que reafirmam a diferença entre homens e mulheres nos contextos das relações sociais. / This study aims to understand the travestility in maracatu rural in Pernambuco in the context of gender and sexuality relations. The clipping of the field is a popular event, which is also a ritual and provides evidence performances, experiences, practices and meanings that can elucidate subjective and ideological dimensions of gender relations and sexuality. In an attempt to deepen some significant questions about the social dimensions highlighted in the design and performatation of female characters staged by disguised men in maracatu rural in Pernambuco, we sought to do an ethnographic study based on participant observation from aspects of the travestility trajectories of maracatu’ men-players in rehearsals and performances during the carnival period. This travestility relates to the constitution of the person, focusing on symbols and gender classifications, resulting in normalized sexual practices, including relationships with the same sex and the opposite sex to some contrastive point with the western standard that values heterosexuality and correspondence sex/gender. Male and female roles within the popular merriment maracatu constitute organizational elements that reaffirm the difference between men and women in contexts of social relations.

The necessity of this study arises from the fact that the Brazilian legal system does not provide exceptions to situations where gender contrast with the information on identification documents, which is an experience that these individuals go through. On the opposite of what they are required to be, the transsexual people and the travestis live gender differently from the rules created in the context of heterosexism, which demand coherence and continuity among sex, gender and sexuality. The main objective consists of questioning the discourses produced in the juridical field by the magistrates responsible for the trial and consequently the ruling of these cases. To achieve that, this paper studies, through the analysis of documents and bibliographic reviews, some rulings that deal with the modification of data in the civil registry of transgenders. In the first chapter, the concepts of “discourse”, “power”, and “truth” are analyzed from the French Discourse Analysis point of view of Michel Foucault, presenting the ideas of Michel Miaille and Clemerson Merlin Clève with the purpose of understanding the discourse aspects of Law. In the second chapter, statements such as sex, gender, sexuality and transsexuality, are examined mainly through Judith Butler. In the third chapter, some rules that deal with the right to have a name, as well as the possibilities and the ways of modifying information from the civil registry are investigated. In addition, some Brazilian rulings related to this subject are analyzed through bibliographic review. In the end, the rulings given in the state of Maranhão are examined. The results of the research demonstrate that the state of Maranhão, contrasting with the national reality, has been partially given positive answers to the cases involving transsexual individuals, mainly through the recognition of the importance of the rectification to the travesties and the transsexual men and women who have not undergone the sex reassignment surgery. / O trabalho aborda as respostas dadas pelo Poder Judiciário para as demandas de retificação de nome e sexo jurídico no registro civil de sujeitos transexuais e travestis, uma vez que o ordenamento jurídico brasileiro não prevê exceções quando as expressões de gênero contrastarem com os atributos presentes nos documentos de identidade, experiência pela qual passam esses indivíduos. Ao contrário do que são interpelados a ser, as mulheres e homens transexuais e travestis vivenciam o gênero diferentemente das normas criadas no contexto do heterossexismo que exigem a coerência e continuidade entre sexo, gênero e sexualidade. A problemática consiste em indagar os discursos produzidos, no âmbito do campo jurídico, pelos magistrados responsáveis pelo julgamento desses casos. Abordamos os conceitos de “discurso”, “poder” e “verdade” a partir da Análise do Discurso de linha francesa, de base foucaultiana, dialogando com autores como Michel Miaille e Clémerson Merlin Clève com o objetivo de compreender os aspectos discursivos do Direito. A seguir, tratamos de enunciados como “sexo”, “gênero”, “sexualidade” e “transexualidade”, principalmente através de Judith Butler. Depois, examinamos algumas normativas acerca do direito ao nome, bem como as possibilidades e meios de alteração de dados do registro civil. Ao final, avaliamos, através de análise documental e revisão bibliográfica, algumas sentenças proferidas no estado do Maranhão. Os resultados da pesquisa demonstram que o estado do Maranhão, em parte, tem dado respostas positivas aos processos envolvendo sujeitos trans, principalmente pelo reconhecimento da importância da retificação para as travestis e para sujeitos transexuais não operados, contrastando com o contexto nacional.

The work has been organized into four sections. Initially, it introduces an historical debate and academic production about the topic related to gender and sexuality, then it addresses entrance to the search field, from ethnographic contributions and, finally, to contextualize the territories where the research took place. The second section considers the multiplicity of ways to consider and to construct signs of what is considered feminine in bodies assigned as male. Additionally, it presents the history of each interlocutor of this research, trying to point out their unique experiences in these body, subjective and identity building processes. In the third section, we discuss the different techniques and strategies used by them to participate in different contexts such as family, school and prostitution, and how these relations are built depending on the persons involved, as well as their interests and desires. And lastly, contextualizes the propositions of social occupational therapy and its possible implications in everyday life of the individuals in their territories belonging, pointing out how the circulation of these young people in their territories have repercussions on the levels of insertion and restriction, allowing or not their existences in different spaces. It is believed that this dissertation contributes, beyond the multiplicity of forms of construction and understanding bodies, subjectivities and transvestites identities, with a dialogue among the possible links between social occupational therapy and circulation of individuals in their territories belonging. / O objetivo deste trabalho foi compreender, a partir da vivência com quatro jovens que em algum momento da pesquisa se autodenominaram travestis, residentes na cidade de São Carlos (SP), as principais técnicas e estratégias utilizadas por elas para o manejo e manipulação de suas próprias características corporais, subjetivas e identitárias, a fim de se inserirem em determinados espaços de sociabilidade, focalizando-se nos contextos familiares, de instituições formais de ensino e também de prostituição. Procurou-se organizar o trabalho em quatro seções. Na primeira, inicia-se uma contextualização histórica do debate e da produção acadêmica sobre a temática referente ao gênero e à sexualidade, em seguida apresenta-se a entrada em campo, a partir de contribuições etnográficas e, por último, contextualizam-se os territórios onde a pesquisa aconteceu. Na segunda seção, pondera-se a multiplicidade de formas de considerar e construir signos do que é considerado feminino em corpos assignados como masculinos. Além disso, apresenta-se a história de cada interlocutora desta pesquisa, tentando assinalar suas vivências singulares nestes processos de construção corporal, subjetiva e identitária. Na terceira seção, discute-se as diferentes técnicas e estratégias utilizadas por elas para se inserirem em diferentes contextos como família, escola e prostituição, e como estas relações são construídas a depender dos sujeitos envolvidos, bem como de seus interesses e desejos. E, por último, contextualiza-se as proposições da terapia ocupacional social e suas possíveis implicações na vida cotidiana dos sujeitos em seus territórios de pertencimento, apontando como a circulação destas jovens em seus territórios têm rebatimentos nos níveis de inserção e restrição, possibilitando ou não suas existências em diferentes espaços. Acredita-se que esta dissertação vem contribuir, para além da multiplicidade de formas de construção e compreensão dos corpos, subjetividades e identidades travestis, com um diálogo em meio às articulações possíveis entre terapia ocupacional social e a circulação dos sujeitos em seus territórios de pertencimento.

Fundação de Amparo a Pesquisa no Estado do Rio Grande do Sul / This dissertation is chacaracterized as a study of media consumption wich articulates the senses formulated in Mundo T-Girl, an online Facebook community mainly composed of transsexuals women and travestis, their context and gender relation. Theoretically, we base ourselves in the perspective of Cultural Consumption, to assert that every consumer has a symbolic dimension subordinate to culture, revealing the meaning structures of social life. Methodologically, the research is configured as an ethnography in online context. The empirical field is Mundo T-Girl, a community on Facebook composed of transsexual women and travestis. We defined as the object of study the comments made about the celebrities. Our problem is to discover the senses that integrate and distinguish transsexual women and travestis. The main objective is to investigate the reasons why its members belong to this online space. For this, we conducted an analysis of the meanings formulated in the consumption of celebrities classified into two major groups: a) rights and political representation; b) gender roles. As results, we realize that the integrative practices in the community includes the adjustment to the current standard of femininity, as well as the discussion of a political project that consider their demands for social inclusion. At the same time, they seek to define the symbolic distance between themselves and women whose behaviors violate the conservative models of gender, as well as the part of society that does not consider them as political beings. / Esta dissertação se caracteriza como um estudo do consumo midiático, que articula os sentidos formulados no Mundo T-Girl, uma comunidade online no Facebook composta, majoritariamente, por mulheres transexuais e travestis, o contexto de suas integrantes e as relações de gênero. Teoricamente, fundamentamo-nos na perspectiva do Consumo Cultural, para afirmar que todo consumo tem uma dimensão simbólica subordinada à cultura, reveladora das estruturas de significado da vida social. Metodologicamente, a pesquisa se configura como um estudo etnográfico, realizado em âmbito online. O cenário empírico da pesquisa está inscrito nas relações sociais estabelecidas no Mundo T-Girl. Definimos como objeto de estudo os comentários realizados na apropriação de conteúdos veiculados nos meios de comunicação. Nossa problemática consiste em apreender os sentidos que integram e distinguem as mulheres transexuais e travestis. O objetivo central é investigar as razões pelas quais as suas integrantes pertencem a esse espaço online. Para isso, realizamos uma análise sobre os sentidos formulados sobre as celebridades mais presentes nas publicações da comunidade, os quais foram classificados em dois grandes grupos: a) direitos e representação política; b) papéis de gênero. Como resultados, percebemos que as práticas integrativas no Mundo T-Girl, que denotam o pertencimento ao espaço online, compreendem o ajustamento ao padrão de feminilidade vigente, bem como a discussão de um projeto político que considere as suas demandas de inclusão social. Ao mesmo tempo, elas buscam marcar a diferenciação e o afastamento simbólico entre si e as mulheres cujas condutas transgridem os modelos conservadores de gênero, assim como à parcela da sociedade que não as considera atores políticos.
