Ungdomspåföljder och barnets rättigheter : En kvalitativ dokumentstudie av rättsutvecklingen för unga lagöverträdare i Sverige (1993-2023) / Juvenile Sanctions and the Rights of the Child : A Qualitative Document Study of The Legal Development for Young Offenders in Sweden (1993-2023)

I denna kandidatuppsats utforskas hur lagstiftningen för unga lagöverträdare mellan 15-17 år som misstänks eller döms för grova brott har förändrats under tidsperioden 1993-2023 ur ett kritiskt barnrättsteoretiskt perspektiv. Under denna tidsperiod ska barnets rättigheter framträda under lagstiftningsprocessen och studiens syfte är att undersöka huruvida barnets rättigheter framkommer vid utvecklingen av nya ungdomspåföljder. Studien belyser den ökade tendensen av lagstiftaren att tillämpa strängare straff som respons på ungdomsbrottslighet och i bekämpandet av kriminella nätverk. Detta  reflekterar ett skifte från fokus på rehabilitering, till allt mer straffande åtgärder med inslag av kontroll och frihetsberövande. Denna studie granskar hur dessa förändringar påverkas av barnets rättigheter enligt FN:s barnkonvention och diskuterar den komplexitet som uppstår när barn misstänks eller döms för grova brott, samt vid utformandet av ungdomspåföljder. Genom riktad kvalitativ innehållsanalys av fyra statliga offentliga utredningar identifierades flera centrala teman, såsom skiftet i ansvarande myndigheter, utveckling av straffsystemets principer, balansen mellan samhällsskydd och rehabilitering, barnkonventionen och barnperspektiv, barnets bästa och barnets behov. Denna studies resultat visar att det har skett en markant ökning av straffande åtgärder, vilket har lett till att unga lagöverträdare i högre grad hamnar inom Kriminalvårdens system snarare än att få stödjande åtgärder från socialtjänsten under senare tid. Detta har resulterat i en förskjutning där samhällsskydd prioriteras framför rehabilitering och barns rättigheter enligt barnkonventionen, där särskilt principen om barnets bästa riskerar att åsidosättas.

Intresset för föreliggande uppsatsarbete har varit att analysera synen på unga lagöverträdare som döms till frihetsberövande påföljder. Avstamp har gjorts i propositionen som 1998 föreslog att sluten ungdomsvård skulle införas i påföljdssystemet i en ambition att undvika fängelsestraff för unga (Prop. 1997/98:96) samt i betänkandet som 2023 föreslår att unga lagöverträdare återigen ska verkställa fängelsestraff (SOU 2023:44). Utifrån en diskursanalytisk ansats var syftet att synliggöra hur påföljdssystemet för unga framställs som ett ’problem’, hur dessa problemrepresentationer motiverar respektive förslag om frihetsberövande påföljd samt hur det kan förstås i ljuset av en ’straffande vändning’. Resultatet visar att påföljdssystemet i propositionen framställs som ett rättssäkerhetsproblem där en framträdande juridisk diskurs har ökat såväl samhällets rättsmedvetande som det enskilda barnets rättsstatus. I betänkandet framställs påföljdssystemet i stället som ett trygghetsproblem, baserat på en alarmistisk bild av ökad och grövre brottslighet bland unga vilka samhället behöver skyddas från. En utveckling har skett från att unga lagöverträdare betraktas vara i fara, offer för en social utsatthet, till att de betraktas som farliga barn som skapar otrygghet i samhället. Det är den senaste kategorin av ‘farliga barn’ som betänkandets förslag vilar på. Ett förslag som förväntas bidra till ökade samhällsklyftor och ökad stigmatisering av en redan utsatt grupp unga lagöverträdare. Ett förslag som också får direkta konsekvenser, i huvudsak för de barn som underrepresenteras i betänkandet: De barn som är flickor, och de barn som är i särskilt behov av stöd, vård och behandling. / The interest in the present study has been to analyze the way juvenile offenders, who are sentenced to a custodial sanction, are portrayed. The study draws from the proposition that 1998 suggested the new sanction of youth custody in an aspiration to replace prison for juvenile offenders (Prop. 1997/98:96) and in the deliberation that 2023 suggested that juvenile offenders once again should be sentenced to prison (SOU 2023:44). Drawing from a discourse analysis, this study aims to uncover the way the youth penal system is produced as a ‘problem’, how this problem representation justifies the different suggestions about custodial sanctions and how it could be understood in the light of a ‘punitive turn’. The results show that the penal system in the first document is produced as a problem regarding penal certainty, whereas a prominent juridical discourse has raised a general legal awareness as well as the legal status for the individual child. In the second document the penal policy is produced as a problem regarding public safety, based on the view of an increased and rougher crime scene among youngsters whom society needs to be protected from. A development can be identified from where juvenile offenders are portrayed as being in danger, victims of social circumstances, to that they are portrayed as dangerous kids that constitutes a threat to the society. It is the latter category of ‘dangerous kids’ that the suggestions in the second document lays upon. Suggestions that are expected to contribute to increased stigmatization of an already exposed group of juvenile offenders. Suggestions that also have direct consequences, especially for those who are underrepresented in the second document: Kids who are girls, and kids who need care, treatment, and protection.

Denna studie har undersökt advokaters uppfattning och erfarenheter av straffrabattens avskaffande för unga lagöverträdare mellan 18-20 år. Studiens syfte var att undersöka på vilket sätt advokater upplever att avskaffandet av straffrabatten har medfört några konsekvenser samt hur lagändringen fungerat i praktiken och hur lagändringen framställs av advokaterna. Studiens undersökningsmetod var semistrukturerade intervjuer, och resultatet analyserades med hjälp av en tematisk analys. Resultatet visade att advokaterna beskrev konsekvenser på flera nivåer och tre teman utvecklades ur materialet: konsekvenser för de unga lagöverträdarna, konsekvenser för advokater samt konsekvenser för samhället. Studiens slutsats är att advokaterna ställer sig kritiska till lagändringen, något som kan förklaras både utifrån ett instrumentellt perspektiv och ett rättighetsperspektiv. / This study has examined lawyers' perceptions and experiences of the abolition of the penalty discount for young offenders aged 18-20 years. The purpose of the study was to investigate how lawyers perceive the abolition of the penalty discount to have brought about any consequences, as well as how the legal amendment operates in practice and how it is portrayed by the lawyers. The study’s research method was semi-structured interviews, and the results were analyzed using thematic analysis. The findings revealed that the lawyers described consequences on multiple levels and three themes developed from the material: consequences for young offenders, consequences for lawyers, and consequences for society. The study's conclusion is that lawyers are critical of the legal amendment, which can be explained from both an instrumental perspective and a perspective of human rights.

<p>The intention of this study was to examine the interaction between authorities. More specifically it had a purpose to look at the ongoing cooperation between social workers and staff of special homes of closed institutional youth care. The sanction system for young offenders’ reform of 1999 where young people between the ages of 15-17 who have committed serious crimes, can be sentenced to secure institutional treatment instead of prison, aims to counteract the harm which can result from a stay in prison. The social welfare board in the young person´s local authority and the national board of institutional care shall cooperate during the youth’s placement at the special home of closed institutional youth care. This study was based on eight qualitative interviews with social workers chosen randomly from all over Sweden and staff members from different special homes of closed institutional youth care. To interpret the material we have been using theory of collaboration and cooperation of Danermark and Kullberg. We have also used earlier studies within the area. The study has resulted that the social welfare board are more satisfied with the corporation than the national board of institutional care are. The study also shows that there has been an improvement. Significant reasons for this result has proved to be; the two different employers with different mission statement who are cooperating, unclear guidelines and the lack of knowledge within in the social services. Today there’s an ongoing cooperation that needs to be developed.</p>

The aim of our study is to gain increased knowledge and understanding of how young people who has been sentenced to closed institutional care experience their own possibility to participate and influence the transition and aftercare, and which, if any, importance they believe this has for their readjustment to society. The study is based on a qualitative method. The data consist of interviews with four young persons, of which three, at the time for our interviews, where in the transitionphase, and one had left the institution a few years ago. The study’s theoretical framework is based on Erving Goffmans theory about stigma and the empowerment theory. We have also used earlier studies within the area to understand and interpret our data. The result indicates deficits in terms of the young people’s possibility to participate and influence the planning and implemantation of the transition from the special home of closed institutional youth care.  The youths express a wish to be more involved and be able to influence more, yet at the same time there seems to be an acceptance among the youths concerning the fact that they are not given the possibility to participate, which can be related to a view of themselves as less worthy.

Recent changes and amendments have been made in the Swedish Aliens Act (2005:716), regarding the possibility of a permanent residence permit. These rules are regulated in Ch. 5 sec. 7 para. 1 and in Ch. 5 sec. 8 para. 2 in the Swedish Aliens Act. These amendments were made in the light of the modern society, dealing with the problem of migrant offenders in Sweden, only a couple of years after the Convention on the Rights of the Child was incorporated into Swedish law. Nonetheless, these rules have been criticized by various legislative bodies and human rights organizations. Hence, the special requirements that apply according to these conducted provisions in the Aliens Act raise questions about the child perspective in these rules. The purpose of this thesis is to identify the premises on which these rules rest, and the consideration taken of the child being a child, the child perspective, in these rules and how they relate to Sweden’s international commitments, mainly the United Nations Convention on the Rights of the Child. The purpose includes identifying and highlighting problems with the legislation and the need for changes in the Swedish law.  The conclusion drawn is that the studied provisions are not compatible with the statements made by the Committee on the Rights of the Child regarding the interpretation of the Convention, and that the legislation needs to be changed for Sweden to live up to the international obligations in the Convention on the Rights of the Child, so that these rules are reasonably legally secure and non-discriminatory. Furthermore, the conclusion is that the child in the studied provisions is not constructed as a child in need of protection, but rather as an adult being punished – as “a person”– an unwanted one – a ‘persona non grata’.
