Previous issue date: 2011 / O objetivo deste trabalho foi compreender a administração e a justiça desenvolvida no território mineiro através de funcionários designados pelo rei para atuar em possessões portuguesas: os juízes de fora. O recorte cronológico abrangeu o período de 1730 até 1777, contemplando a criação do cargo de juiz de fora em Mariana e o fim do chamado período pombalino. O primeiro capítulo tratou de uma exposição sobre a institucionalização da capitania mineira, isto é, mostrou os principais ofícios e instituições criadas nos primeiros anos da colonização em Minas Gerais. Expôs-se como estava estruturada a administração e a justiça no período anterior à chegada do primeiro juiz de fora de Ribeirão do Carmo em 1730. Já no segundo capítulo, deteve-se especificamente na atuação dos juízes de fora que estiveram, no período de 1730 a 1777, em Ribeirão do Carmo. Objetivou-se, nesse capítulo, compreender como estava organizada a Câmara de Mariana nos primeiros anos da administração de d. José e seu ministro, Sebastião José de Carvalho e Melo. Designado pelo rei, esse funcionário ocupava a presidência da Câmara. Vistas como locais privilegiados, as Câmaras são consideradas por muitos estudiosos como um dos principais pilares da administração real. Os juízes de fora, presidente delas, representaram da forma como puderam os ditames da política metropolitana, servindo mesmo como um lembrete do rei nesse Senado. Sua presença, mesmo indiretamente, tolhia algumas manifestações locais de desvios e interesses, mesmo que cooptados, por vezes, pelas amarras do poder local. _______________________________________________________________________________________________ ABSTRACT: The objective of this essay is the understanding the administration and justice developed in the territory of Minas Gerais by the nominatees assigned in charge of it by the king to actuate in the Portuguese possessions: the ‘juízes de fora’. The chronological outline involved the period from 1730 up to 1777, when the job position of the ‘juiz de fora’ in Mariana was created and the end of the ‘pombalino’ period. The first chapter analyses the institutionalization of the ‘capitania mineira’, i. e., shows the main offices and the first institutions created during the first period of the colonization of Minas Gerais. It presents how the administration and the justice were structured during the period prior to the arrival of the first ‘juiz de fora’ from Ribeirão do Carmo in 1730. In the second chapter the subject is specifically the acting of the ‘juízes de fora’ that were in Ribeirão do Carmo during the period 1730-1777. In this chapter the aim is the understanding of how the council of Mariana was organized in the first years of d. José’s administration, together with his minister, Sebastião José de Carvalho e Melo. Assigned by the king, this employee was the president of the Council. Seen as privileged places, the Councils were considered by many studious persons as one of the principal pillars for the regal administration. The ‘juízes de fora’, presidents of the Councils performed as possible the directions given by the metropolitan policy, yet being a reminder of the king in this Senate. Their presence, even indirectly, would reprimand local manifestations of embezzlement and interests even so co-opted, sometimes by the binding of the local power.
