Previous issue date: 2005 / This thesis analyses the Brazilian economic and political contexts in the last decades and the ruling legislation related to Archaeology in Brazil as well as in other countries. It was researched in what moments, under what circumstances and according to what concerns, Archaeology is demanded to accomplish its studies, one of the requirements for the licensing of Engineering works which cause environmental (natural and cultural) impacts. / Nesta tese realizamos uma análise crítica dos contextos econômicos e políticos brasileiros nas últimas décadas e qual a legislação em vigor no Brasil e em outros países relacionada à Arqueologia. Procuramos verificar em que momento, em que circunstâncias, e atendendo a que interesses, a Arqueologia é chamada a realizar seus estudos, um dos requisitos para o licenciamento de obras de Engenharia que causam impacto ao ambiente (natural e cultural).
