En el presente informe se analiza el accidente de trabajo producido por la
conducta negligente del propio trabajador accidentado. En ese sentido, el
informe busca determinar cuál es el sistema de responsabilidad civil del
empleador ante accidentes de trabajo y el criterio de imputación por el que el
empleador debe responder ante estos casos. Seguidamente, se analiza si el
artículo 1326 del Código Civil, el cual regula la figura de la denominada
“concausa”, puede ser aplicable supletoriamente al derecho del trabajo.
Finalmente, se desarrolla el contenido de la transacción extrajudicial celebrada
por las partes y si esta era válida para concluir el proceso judicial.
Palabras / This report analyzes the work accident caused by the negligent conduct of the
employee. In that sense, the report seeks to determine what the worker's civil
liability system should be use for work accidents and the imputation criteria by
which the employer must respond in these cases. Next, it is analyzed if article
1326 of the Civil Code, which regulates the figure of "concausa", can be apply for
labor law. Finally, the content of the extrajudicial transaction is developed and if
it was valid to conclude the judicial process.
