En la presente investigación se analizará la multicausalidad de los accidentes de
trabajo en el marco de un procedimiento administrativo sancionador. Ello en
virtud de principios de la seguridad y salud en el trabajo (prevención, protección,
cooperación y responsabilidad), la Ley de Seguridad y Salud en el Trabajo, su
Reglamento, y doctrina nacional e internacional. Asimismo, se postulará el
método de cadena causal de Frank E. Bird Jr., cuya base es la multicausalidad.
La referida metodología cuenta con elementos que pueden asimilarse a las
figuras existentes en la regulación peruana, tales como las causas inmediatas
(actos subestándares y condiciones subestándares) y causas básicas (factores
personales y factores de trabajo)
La mencionada indagación especializada en seguridad y salud en el trabajo se
plantea a fin de analizar la imputación de infracciones con relación a la Matriz de
la IPERC, condiciones de seguridad, y formación e información en el siniestro en
particular. La relevancia de la aplicación de la técnica de la multicausalidad
responde a que la atribución de responsabilidad del empleador debe ser en
consideración de la identificación de determinado actuar ilícito y con vinculación
al accidente de trabajo, lo cual no fue lo suscitado en la Resolución de Sala Plena
No. 005-2022-SUNAFIL/TFL. / This research will analyze the multi-causality of occupational accidents within the
framework of an administrative sanctioning procedure. This is based on the
principles of occupational safety and health (prevention, protection, cooperation
and responsibility), the Occupational Safety and Health Law, its Regulations, and
national and international doctrine. Likewise, the causal chain method of Frank
E. Bird Jr. will be postulated, which is based on multi-causality. The referred
methodology has elements that can be assimilated to the existing figures in the
Peruvian regulation, such as immediate causes (substandard acts and
substandard conditions) and basic causes (personal factors and work factors).
The aforementioned specialized inquiry in occupational safety and health is
proposed in order to analyze the imputation of violations in relation to the IPERC
Matrix, safety conditions, and training and information in the particular accident.
The relevance of the application of the multi-causality technique responds to the
fact that the attribution of the employer's liability must be in consideration of the
identification of a certain unlawful act linked to the work accident, which was not
the case in Full Chamber Resolution No. 005-2022-SUNAFIL/TFL.
