El objetivo del presente trabajo de investigación consiste en realizar un breve
análisis sobre la aplicación de las reglas de responsabilidad civil en el ámbito de
las relaciones laborales derivadas de accidentes de trabajo. En esta línea, se
analizarán las particularidades del Derecho del Trabajo y las obligaciones del
empleador de garantizar el desarrollo del trabajo en un entorno y espacio seguro,
así como el contenido del deber de prevención y el criterio de previsibilidad como
fundamentos para reforzar el estándar de diligencia del empleador y como límite
frente a la interposición de causa no imputable (hecho determinante de tercero,
caso fortuito o fuerza mayor). De esta forma, el análisis realizado se aplicará en
distintas sentencias en materia laboral de indemnización por daños y perjuicios. / The aim of this research work is to carry out a brief analysis on the application of
the rules of civil liability in the field of labor relations arising from accidents at
work. In this line, the particularities of Labor Law and the employer's obligations
to guarantee the development of work in a safe environment and space will be
analyzed, as well as the content of the duty of prevention and the criterion of
foreseeability as grounds to reinforce the employer's standard of diligence and
as a limit against the interposition of a non-imputable cause (determining fact of
a third party, fortuitous event or force majeure). In this way, the analysis made
will be applied in different judgments in labor matters of compensation for
