El estándar de la motivación de los laudos arbitrales ha sido motivo de múltiples
reflexiones y críticas respecto a su alcance. En ese sentido, el presente trabajo de
investigación tiene como finalidad enmarcar el análisis de dicho estándar en aquellos
arbitrajes que se encuentran sujetos a la aplicación de la Ley de Contrataciones del
Estado, Texto Único Ordenado de la Ley N° 30225.
Asimismo, se cuestionará cuál es el estándar mínimo que no vulnerará el derecho a
la debida motivación, siendo que esta será una pregunta que será objeto de reflexión
a lo largo del desarrollo del presente artículo académico.
Estando a ello, se abordará un análisis de la concepción del derecho a la motivación
a partir de un examen de jurisprudencia y doctrina calificada, además de cómo dicho
derecho opera en los arbitrajes en contrataciones públicas y cómo ha sido abordado
por los Tribunales Arbitrales en sede arbitral. / The standard of motivation for arbitration awards has been the subject of multiple
reflections and criticisms regarding its scope. In that sense, the purpose of this
research work is to frame the analysis of said standard in those arbitrations that are
subject to the application of the State Procurement Law.
Likewise, it will be questioned what is the minimum standard that will not violate the
right to due motivation, and this will be a question that will be the subject of reflection
throughout the development of this academic article.
With this in mind, an analysis of the conception of the right to motivation will be
addressed based on an examination of jurisprudence and qualified doctrine, in
addition to how said right operates in arbitrations in public procurement and how it has
been addressed by the Arbitration Courts at headquarters. arbitral. / Trabajo académico
