Previous issue date: 2010-11-17 / Cooling of social relations because of a larger tapestry of human relationships and the
fact that the individual has increasingly required the fulfillment of their constitutional
rights and guarantees under the state to produce more effective results in favor of the
community. However, this reality has produced a multitude of administrative and legal
conflicts involving the political and administrative spheres of the Brazilian state, due
mainly to the uncertainty of the plexus which is the competence of each of the entities
of the Brazilian federation. What is sought is exactly the mitigation of this conflict and
to be much debate on federalism and its main characteristics. Later, this concept relates
to the peculiar paternal current federalism, with the primary purpose solver conflicts
over the distribution of responsibility and ownership and involving Union County. The
main conclusion is that there is no hierarchy between federal entities and that the best
way to define the holder of that power is by using the analysis of the preponderance of
interest in each case, using both as tools for interpreting the constitutional principles.
Anyway, surely the city is the political entity best able to effectively meet the wishes of
the community, since it is the entity that is closest to the individual. So, since respecting
the precepts and constitutional limits, every jurisdiction that desideratum is to meet
directly and immediately place the interest must be owned by the municipality. With
this interpretation manifests itself the main goal of federalism, which is democracy,
because it gives opportunity to the different instruments and minorities to demand their
rights and participate in the greater will. / Arrefecimento das relações sociais em razão de um maior entrelaçamento das relações
humanas e do fato de que o individuo tem exigido cada vez mais o cumprimento de seus
direitos e garantias constitucionais força o Estado a produzir resultados mais eficazes
em favor da coletividade. Entretanto, esta realidade tem produzido uma enormidade de
conflitos administrativos e judiciais envolvendo as esferas político-administrativas do
Estado brasileiro em razão, principalmente, da indefinição de qual seja o plexo de
competência de cada uma das entidades federativas do Estado brasileiro. O que se busca
é exatamente a minoração deste conflito e para tanto debate-se sobre o federalismo e
suas principais características. Após, relaciona estes conceitos com o peculiar
federalismo pátrio atual, tendo por fim precípuo solver os conflitos relacionados à
distribuição e titularidade de competência envolvendo União e Município. A principal
conclusão obtida é a de que não existe hierarquia entre os entes federativos e que a
melhor forma de definir o titular de referida competência é fazendo uso da análise da
preponderância do interesse caso a caso, utilizando para tanto, como instrumentos
interpretativos, os próprios princípios constitucionais. De todo modo, certamente o
Município é o ente político com melhores condições de atender efetivamente as
vontades da coletividade, uma vez que é a entidade que se encontra mais próxima do
individuo. Assim, desde que respeitando os preceitos e limites constitucionais, toda
competência que tem por desiderato atender direta e imediatamente o interesse local
deve pertencer ao Município. Com esta interpretação concretiza-se o objetivo principal
do federalismo, que é a democracia, pois oportuniza aos diferentes e às minorias
instrumentos para requerer seus direitos, bem como participarem da vontade maior.
