Previous issue date: 2016-03-08 / Coordena??o de Aperfei?oamento de Pessoal de N?vel Superior - CAPES / This investigation analyzes the different dimensions present in the process of debt negotiation which act in the subjective reconfiguration of individuals in debt. Since the 1990s, with the implementation of the Plan ?Real?, Brazil has been experiencing an economic and political process which has granted ? by means of access to credit and increase to family income - the social and financial insertion of a rather significant quota of the population. On the other hand, this same process has had repercussions for the increasing indebtedness, moving more and more social players concerned about this phenomenon. The Brazilian legal system was one of those players who most felt the effect of this phenomenon, especially the restorative justice, the public defender?s offices and the department?s consumer defense, being triggered by consumers who were looking for mechanisms of debt negotiation. From 2006, by an initiative of the Rio Grande do Sul Court of Appeals, National Council of Justice (CNJ) and other entities oriented towards Consumer Rights, the first experiences of mediation for debt negotiations began. In 2009, these experiences led to the establishment of the Judicial Center of Settlement and Mediation. Through the ethnographic approach carried out at the Center of Settlement and Mediation during 2011 and 2013, it was possible to follow not only the service but also the debt negotiation sessions conducted by the public service. In addition, it was observed that following other social players, the Center of Settlement and Mediation also encourages the consumers to adopt practices to ?control? their finances. The main conclusion of this investigation resides in the fact that, despite involving distinct stories and ways of dealing with negotiated debts, as well as the meaning they have, negotiated debts contemplate not only economic criteria but also of moral and social order. At the same time, when pursuing the legal realm, individuals seemed aware of a code that defended them as consumers in their dignity, using in their own way, concepts of justice and citizenship. To problematize such criteria, the current investigation also presents the ethnographic approach carried out together with the social movement of the individuals in debt ?El Barz?n Popular?, which occurred during the PhD research from 2012 and 2013. / Esta investiga??o analisa as diferentes dimens?es presentes no processo de negocia??o de d?vidas e que atuam na reconfigura??o subjetiva dos sujeitos endividados. Desde os anos de 1990, com a implanta??o do Plano Real, o Brasil tem vivido um processo econ?mico e pol?tico que garantiu ? por meio do acesso ao cr?dito e do aumento da renda familiar ? a inser??o social e financeira de um contingente expressivo da popula??o. Por outro lado, este mesmo processo repercutiu para o crescente endividamento, mobilizando cada vez mais atores sociais, preocupados com esse fen?meno. O aparato judicial brasileiro ? sobretudo a justi?a restaurativa, as defensorias p?blicas e os ?rg?os de defesa do consumidor ? foi um dos atores que mais sentiu o reflexo deste fen?meno, sendo acionado por consumidores que buscavam por mecanismos de negocia??o dos d?bitos em aberto. A partir de 2006, por iniciativa do Tribunal de Justi?a do Rio Grande do Sul, Conselho Nacional de Justi?a (CNJ) e de outras entidades voltadas para o Direito do Consumidor, iniciaram-se as primeiras experi?ncias de media??o para negocia??o de d?vidas. Em 2009, essas experi?ncias culminaram com o estabelecimento da Central Judicial de Concilia??o e Media??o. Por meio da abordagem etnogr?fica realizada na Central de Concilia??o e Media??o, durante 2011 e 2013, foi poss?vel acompanhar o atendimento, bem como as sess?es de negocia??o de d?vidas conduzidas pelo servi?o p?blico. Al?m disso, verificou-se que, seguindo outros atores sociais, a Central de Concilia??o e Media??o tamb?m estimula os consumidores a adotarem pr?ticas para o ?controle? de suas finan?as. A principal conclus?o dessa investiga??o reside no fato de que, apesar de envolverem hist?rias e maneiras distintas de manejar, as d?vidas negociadas, bem como seus significados, tencionam crit?rios n?o apenas econ?micos, mas morais e sociais. Ao mesmo tempo, ao buscarem a esfera legal, os sujeitos se mostram cientes de um c?digo que os defende como consumidores, em sua dignidade, utilizando, ?s suas maneiras, as no??es de justi?a e cidadania. Para problematizar tais crit?rios, a presente investiga??o tamb?m apresenta a abordagem etnogr?fica realizada junto ao movimento social dos endividados El Barz?n Popular, ocorrida durante est?gio doutoral entre 2012 e 2013.
