Previous issue date: 2011-07-06 / This work aims to study the material conflict of jurisdiction as to the ownership of public
water supply, between the municipalities and the Member States, in metropolitan areas. One
of the important points of analysis is the realization of the fundamental right of access to
water, a right that is implicit in the Constitution of 1988, being prevented from having their
achievement considering the lack of definition of the ownership of the service. Knowing
discussed the essential public service, in all its stages, it will realize it is a complex activity
that depends for its operation, joint activities of federal entities and the society. In its pursuit

11.445 of 2007 is the universal access to service, require the adoption of popular participation
and the positive benefits of the state, such as planning. Moreover, it will find cooperation

? do servi?o p?blico de fornecimento de ?gua, entre os Munic?pios e os Estados-Membros,
nas Regi?es Metropolitanas. Um dos pontos importantes da an?lise ? a concretiza??o do
direito fundamental de acesso ? ?gua, direito este impl?cito na Constitui??o Federal de 1988,
que est? sendo impedido de ter a sua concretiza??o ante a aus?ncia de defini??o da
titularidade do servi?o. Conhecendo o discutido servi?o p?blico essencial, em todas as suas
etapas, perceber-se-? se tratar de uma atividade complexa, que depende, para o seu
funcionamento, de a??es conjuntas dos entes federados e a da sociedade. Para que seja
alcan?ado o desenvolvimento (entendido como melhores condi??es de vida das pessoas), que
na vis?o da Lei Federal n? 11.445 de 2007 ? a universaliza??o do acesso ao servi?o, necess?ria
a participa??o popular e a ado??o de presta??es positivas do Estado, como o planejamento.
Ademais, encontrar-se-? na coopera??o interfederativa (ap?s o estudo do Federalismo
brasileiro) a solu??o pac?fica para o embate, mediante a ado??o da gest?o associada ou
