El caso materia del presente informe jurídico versa sobre una solicitud de cese colectivo
de setenta y siete trabajadores presentada por Papelera nacional S.A; la cual, fue
aprobada por Dirección General de Trabajo en vía de revisión. El análisis de este caso
se concentra en verificar si, efectivamente, se identifica la presencia de los motivos
tecnológicos y estructurales que fueron invocados como causa objetiva. De igual
manera, parte del análisis incluye la justificación que ofrece la DGT en cuanto al silencio
positivo administrativo que en primera instancia no se aplicó en favor de la empresa
como sujeto administrado. Para el presente análisis será fundamental utilizar el T.U.O
de la Ley de Productividad y Competitividad Laboral y la Ley de Procedimiento
Administrativo General / The case of the present legal report develops a Labour Force Adjustment Plan (ERE),
which petitioned the dismissal of seventy-seven employees; filed by Papelera Nacional
S.A., which was approved by the Labor General Directorate on the level of reviewal. The
analysis of this case focuses on verifying whether the technological and structural
reasons that were invoked as an objective cause are indeed present. Likewise, part of
the analysis includes the justification offered by the General Directorate of Labor (DGT)
regarding the positive administrative silence that in the first instance was not applied in
favour of the company as an administered subject. For this analysis it will be essential to
use the T.U.O. of the Labor Productivity and Competitiveness Law and the General
Administrative Procedure Law
