Previous issue date: 2013-11-12 / The sustainable development concept have a straight relationship with water conservation and preservation. The waste water reuse is regard like a useful mean to diminish partially the water scarcity in some regions, such as the São Paulo Metropolitan Region (SPMR), it‟s shown according this development of the sustainability concept. The SPMR region may be seen like the great one problematic regions of the Brazil country facing utmost complex urban issues, most because the limited availability in water resources (52,834.44 U.S.gallon/inhabitants per year) and a so great water degradation of the quality in its river, therefore it is plenty justified the strives toward the adoption of all waste water reuse in any situation where it is possible. Water is a main resource and an input to most of the economic activities any in SPMR and a significant portion of water is used in industrial activities, it makes the main focus of the production and use of waste water reuse be directed to a range of economics activities that demand no potable water at very different level, measure that turn possible to relieve the use of drinking waters. The present dissertation intend to make an analytical assessment about the role of legal standards in the waste water reuse field enhancing the environmental and institutional features the difficulties and current hindrances to implementation of this practice, proposing legal innovations in this area of operation whether with relation to the interpretation and further in the adoption of specific proposal to discuss roles that may possible the promotion of this use, facing the need of the sustainable development. Thereunto, it was made an analyze in the doctrinal discussion in regard this subject, taking like leading case the São Paulo Metropolitan Region. Than at first moment it was regard the specific aspect related to the water in SPMR dealing with the hydric situation and the principal conflicts and threats for the water supply in the region. In a second step we remark the significance of the water use in the economic activities and the important role of the law to the sustainability. Then the present analysis take the waste water reuse and its relationship with the water management and the right. Complement the present thesis the study of the waste water reuse and the sustainability challenges. / O conceito de desenvolvimento sustentável relaciona-se de modo direto ao processo de conservação e preservação das águas. O reúso de água, sendo considerado um instrumento útil para minimizar parcialmente os efeitos da escassez hídrica presentes em algumas regiões, como na Região Metropolitana de São Paulo (RMSP), se mostra congruente com a concepção de desenvolvimento sustentável. A RMSP pode ser considerada como uma das regiões mais problemáticas do país, enfrentando questões urbanas extremamente complexas, agravadas pela limitada disponibilidade de recursos hídricos (200 m3/hab/ano) e elevada degradação da qualidade das águas de seus rios, justificando, portanto, os esforços no sentido da adoção do reúso de água onde for possível. A água é um insumo imprescindível à maioria das atividades econômicas, sendo que, na RMSP, uma parte expressiva do uso da água é destinada ao uso industrial, motivo pelo qual deu-se ênfase ao reúso de água não potável para utilização em uma gama de atividades econômicas demandadoras de água em níveis muito diferentes e que possam dispensar a necessidade de água potável. A presente dissertação tem como objetivo geral analisar as normas jurídicas sobre Reúso de água, destacando os aspectos ambientais e institucionais, as dificuldades e entraves atuais para implementação dessa prática, propondo inovações jurídicas nessa área, seja em relação à interpretação das normas existentes, seja ainda na adoção de normas específicas para o fomento dessa prática diante da necessidade de um desenvolvimento sustentável. Para tanto, foram analisadas as discussões doutrinárias a respeito do tema, tomando como estudo de caso a Região Metropolitana de São Paulo. Assim em um primeiro momento foram estudados os aspectos referentes a água na RMSP destacando a situação hídrica e os principais conflitos por água nessa região. Em uma segunda etapa observou-se a importância da água para as atividades econômicas e o papel do direito para a sustentabilidade. Em seguida, foi objeto da presente análise o reúso e suas relações com a gestão das águas e direitos. Complementando a presente dissertação estudou-se o reúso e os desafios da sustentabilidade.
