Constitution is the goal of this dissertation. This concern is justified, given the gap between
the theoretical constitutional guarantee of citizenship to all Brazilians and the reality that
reveals the non-exercise of citizenship, with consequences that lead to violation of all human
rights, including individual, social and political ones. Furthermore, outside the nation which
is attached how can be assured to a citizen that the fundamental human rights will be
respected? This reality in Brazil is experienced by the majority population, which portrays all
the vulnerability of human beings and the resignation to their status as modifier agent of its
own history, being released alley of everyday life, for disregard of a training process.
Bringing light to this subject implies recover the meaning of political participation by citizens
in t􀁋􀁈􀁌􀁕􀀃 􀁆􀁒􀁐􀁐􀁘􀁑􀁌􀁗􀁜􀀏􀀃􀁄􀁆􀁆􀁒􀁕􀁇􀁌􀁑􀁊􀀃􀁗􀁒􀀃 􀀫􀁄􀁑􀁑􀁄􀁋􀀃􀀤􀁕􀁈􀁑􀁇􀁗􀂶􀁖 point of view. The characteristics of the
contemporary concept of citizenship in Brazil are analyzed from the contributions of Flavia
Piovesan. The relationship between the concepts of Citizenship, Human Dignity and Human
Rights is done by applying the Ethical Diamond, as the theory developed by Joaquín Herrera
Flores towards a critical and contextualized analysis of the concepts mentioned.
Contributions from political scientists José Murilo de Carvalho and Norberto Bobbio allow
us to understand the scope of the concept of citizenship that has been interested not only the
Law Science, but also Philosophy and Social Sciences. José J. G. Canotilho, Paulo
Bonavides, Luis Roberto Barroso and Daniel Sarmento are constitucionalists who bring a
new point of view, so called newconstitucionalism, to challenge the traditional concept and􀁄􀁏􀁖􀁒􀀃􀀵􀁒􀁅􀁈􀁕􀁗􀀃􀀤􀁏􀁈􀁛􀁜􀂶􀁖􀀃􀁌􀁇􀁈 / O estudo sobre o conceito de Cidadania no Brasil, após a promulgação da Constituição de
1988 é o objetivo desta dissertação. Tal interesse se justifica, diante do distanciamento
identificado entre a teórica garantia constitucional prevista no Princípio da Cidadania
atribuído a todos os brasileiros e a realidade que nos revela o não exercício da Cidadania com
conseqüências que propiciam a violação de todos os direitos do homem-cidadão conquistados
pela ampliação de direitos individuais, sociais, políticos. Além disso, fora da nação a qual está
vinculada sua Cidadania como poderá exigir o cidadão que os direitos fundamentais do
homem sejam respeitados? Essa realidade no Brasil é vivenciada pela maioria da população,
que retrata toda a vulnerabilidade do ser humano, do indivíduo que renunciou à sua condição
de agente modificador de sua própria história, ficando lançado a álea da vida cotidiana, por
prescindir de um processo de formação de cidadão. Trazer esse tema à luz implica em resgatar
o sentido da participação política do cidadão na sua comunidade, de acordo com o olhar de
Hannah Arendt. As características da concepção contemporânea da Cidadania brasileira são
analisadas a partir da contribuição de Flávia Piovesan. A relação entre os conceitos de
Cidadania, Dignidade Humana e Direitos Humanos é feita pela aplicação do Diamante Ético,
conforme a teoria desenvolvida por Joaquín Herrera Flores que visa uma análise crítica e
contextualizada dos conceitos citados. As contribuições dos cientistas políticos José Murilo de
Carvalho e Norberto Bobbio permitem nos compreender a abrangência do conceito de
Cidadania que permeia não só as Ciência Jurídicas, mas também a Filosofia e as Ciências
Sociais. Os constitucionalistas José J. G. Canotilho, Paulo Bonavides, Luis Roberto Barroso e
Daniel Sarmento trazem ao tema a visão neoconstitucionalista em contraponto à visão
tradicional, além das contribuições do jusfilósofo Robert Alexy.
