La presente tesis consiste en describir y analizar, desde el punto de vista jurídico, a la tarjeta de crédito adicional para menores de edad incapaces relativos, determinando su naturaleza jurídica, siendo que para ello se la diferenciará de otras instituciones jurídicas del Derecho Civil, para seguidamente determinar si es que tanto desde la perspectiva del Derecho Civil como desde la perspectiva del Derecho Bancario en el Perú es factible su otorgamiento.
Asimismo, se analizarán cuáles serían las principales aristas de la implementación operativa de este producto, evaluando el impacto de permitir o no cada uno de los tipos de consumo que podrían efectuar los menores de edad con este tipo de herramienta, así como evaluar la regulación prudencial y la regulación de conducta que sería aplicable a este tipo de producto.
Finalmente, se determinará a través de la entrevista a algunos actores del sistema financiero nacional si es que ellos permiten el otorgamiento de este tipo de producto y de no ser el caso, cuáles serían los requerimientos para que puedan implementar el mismo. / This work pretends to describe and analyse, under the laws perspective, the additional credit card for minors between sixteen years old up to eighteen years old (“incapaces relativos” under the Peruvian Civil laws), searching for that purpose, its specific characteristics among another forms of traditional credit cards. For reach this objective, we are going to compare this product with another institutions of the Peruvian Civil Law and then establish, if under the Civil Laws and the Banking Laws, it is possible to implement this kind of product in Peru.
It is also another objective of this work, analyse which would be the principal topics that must be take into consideration for the operative implementation of the product, evaluating for that purpose, the impact of the allowance or the forbiddance of each type of consumption that, the minors aforementioned, could realize with this plastic. We also will analyse the prudential and conduct rules applicable to this product under the Peruvian laws.
Finally, we are going to make some interviews to some actors of the financial system in Peru related to the credit card product, to establish if its corporations allow the issuance of this type of credit cards to the aforementioned sector of the population, and if it is not the case, which would be their specific requirements to implement this product.
