Ingeniero en Recursos Naturales Renovables / La Ley N° 20.417 del año 2010 creó la Superintendencia del Medio Ambiente (SMA) con el
propósito de velar por el cumplimiento de las normativas ambientales del país, entre las que destaca
la Resolución de Calificación Ambiental (RCA). Lograr el cumplimiento adecuado de esta última
es complejo producto de la escasa información sobre quiénes cumplen o infringen con ella, el
volumen de RCAs entregadas a la fecha y lo reciente de la nueva institucionalidad.
Ante esta situación, la literatura especializada recomienda que los gobiernos fortalezcan su nivel
de información mediante la identificación de los individuos afectos a la normativa de interés y la
comprensión de los motivos que influyen en que ellos muestren un mayor o menor nivel de
cumplimiento. Luego, recomienda que, a partir de este conocimiento, se diseñen acciones
específicas que favorezcan el cumplimiento adecuado de la normativa.
El propósito de este estudio es revelar cuáles son los motivos que influyen en el mayor o menor
nivel de cumplimiento de la RCA y, mediante este conocimiento, generar recomendaciones que
fortalezcan el rol de la SMA.
Para lograrlo se plantean tres objetivos: (1) identificar los factores que influyen en el cumplimiento
de regulaciones ambientales, mediante el análisis de investigaciones internacionales; (2) identificar
los factores asociados al cumplimiento de la RCA, mediante la aplicación de entrevistas a
funcionarios de gobierno; y, (3) generar recomendaciones que favorezcan el cumplimiento de la
RCA, considerando los factores identificados y la experiencia comparada.
Como resultado se identifican 13 factores que influyen en el cumplimiento de regulaciones
ambientales, 11 en el cumplimiento de la RCA –destacando: el interés de la jefatura, el
conocimiento de los empleados, la coordinación del cumplimiento y la capacidad operativa de la
empresa–, y se generan 9 recomendaciones para favorecer su cumplimiento. La principal
conclusión es que la comunicación que sostenga la SMA con los regulados por RCA, será clave
para fortalecer su cumplimiento. / Law No. 20,417 of 2010 created the Superintendency of the environment for the purpose of
ensuring compliance with environmental regulations, among which the Environmental
Qualification Resolution (RCA) is very important. Achieving this purpose is complex, due to the
limited information on those who obey the law, the volume of RCAs delivered and recency of the
new institution.
In this situation, the literature recommends that governments strengthen their knowledge by
identifying the regulated and understanding of the reasons that influence whether they show a
higher or lower level of compliance. After, it recommends use this knowledge to design specific
actions to promote better compliance.
The purpose of this study is to identify what are the reasons that influence the compliance with the
RCA and generate recommendations to strengthen the role of the SMA.
To achieve this, three objectives were defined: (1) to identify the factors that influence compliance
with environmental regulations, through the analysis of international research, (2) to identify the
factors associated with compliance with the RCA, through analyzing testimonies obtained in semistructured
interviews to government officials, and (3) provide recommendations favoring RCA
compliance, considering the factors identified and the experiences of similar institutions to the
SMA.
As a result thirteen factors were identified influencing compliance with environmental regulations,
eleven in compliance with the RCA- emphasizing the interest of the leadership, knowledge of
employees, coordination of compliance and operational capacity of the company, and nine
recommendations to encourage their compliance. The main conclusion is to hold communication
between the SMA and the regulated by RCA, will be key to strengthen compliance with the RCA.
