Previous issue date: 2009-06-08 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / This dissertation analized how the miners of Estrela do Sul/MG became in the form cooperative organization. In this small city, the mining activity has been tradicionaly one of the main economic activities responsible for great hard work absortion. The origin of the town itself has direct relation with mining. Changes on the legal scene has created the cooporative mine of Vale do Rio Bagagem Ltda (Coogavarb) which was the main object study of this dissertation. The Brazilian Federal constitution promulgated in 1988 the changes on the legal scene and social valorization and economic of the environment, result of the intense discussion of what happened after the 80’s, it began to interfere directy on the way the mine workers should have organized themselves. With these changes the state of searches for transformation in the mine works activities by making the cooperative. That way the work is focused to understand the universe of the cooperative here studied. Having assumed that there would be conflicts between the cooperative organicing ways and the miners ways with natural resources. It is noticeabe that the legislators did not think of the eventual incompatibilities and the very characteristics of the cooperative organization. They coold not form an organization for the specific way of life the miners liad, or the problems the had. Because of this the had to understand why Coogavarb acted as they did regarding the enviorment. Because of that theories of the Contingencia and the Nova Economia Institucional were used to explain Coogavarb methods. It is concluded that this cooperative organization is not working on systems or areas. There fore this program is not ilegitimate and is not a weh functioning program. / Este trabalho analisou como os garimpeiros do município de Estrela do Sul/MG se apropriaram da forma organizacional cooperativa. Nesse município, a atividade garimpeira tem sido tradicionalmente uma das principais atividades econômicas, sendo responsável por grande absorção de mão-de-obra. A própria origem da cidade tem relação direta com o garimpo. Mudanças no marco legal promoveram a criação da Cooperativa Garimpeira do Vale do Rio da Bagagem Ltda (Coogavarb) a qual foi objeto de estudo desta dissertação. A Constituição Federal do Brasil promulgada em 1988 e as transformações no marco legal e na valorização social e econômica do meio ambiente, fruto da intensa discussão que ocorreu a partir da década de 80, passam a interferir diretamente na forma como os garimpeiros deveriam se organizar. Com essas mudanças percebe-se que o Estado busca a transformação da atividade garimpeira promovendo para isso a forma cooperativa. Neste sentido, o trabalho está direcionado a compreender o universo da cooperativa estudada, tendo como pressuposto que há um conflito inerente entre a forma de organização da cooperativa e a organização dos garimpos e sua forma de apropriação dos recursos naturais. Percebe-se que os legisladores desconsideraram eventuais incompatibilidades ou, até, as próprias características da organização cooperativa, induzindo uma forma organizacional específica como solução dos problemas que os garimpos vivenciam ou ocasionam. Desta forma buscou-se entender como se dá a apropriação da forma cooperativa no caso da Coogavarb e sua atuação na gestão ambiental. Nesse marco as teorias da Contingência e da Nova Economia Institucional são utilizadas para explicar a gênese da Coogavarb. Conclui-se pela não aplicabilidade da forma cooperativa em todo tipo de atividade, como no respectivo caso em atividade de garimpo como comumente visualizado pelo Estado, pois poderia acarretar numa apropriação inadequada embora involuntária, dessa forma organizacional.
