Previous issue date: 2013-10-24 / The current dissertation, which is associated to the research line of Contemporary Legal Systems, in the Post-graduation Program of the Criminal Sciences of Pontif?cia Universidade Cat?lica do Rio Grande do Sul, is a research whose main objective is to discuss the application of the effective constitutional principles, which are in the Democratic State of Law as well as in to the Police Investigation. The debate occurs, considering the legislative that is established in the article 155 of the Code of Criminal Procedure that foresees the possibility of the utilization of the informative elements which are in the Police Investigation, in order to give the background to the condemnatory decision, but they should not be the center of the investigation. In this context, there are the issues that are observed in the Court Jury, in which the juror, taking into consideration the principle of the inner conviction, is free to decide, based on any element, either processual or informative, without any substantial proves. Those decisions, that might mask the true, can condemn a person, grounded exclusively on the inquisitorial elements that were collected without the observation of the contradictory, and it is an affront to the guarantees that are ensured to the citizens by current the Federal Constitution. / A presente disserta??o, vinculada ? linha de pesquisa dos Sistemas Jur?dicos Penais Contempor?neos, do Programa de P?s-Gradua??o em Ci?ncias Criminais da Pontif?cia Universidade Cat?lica do Rio Grande do Sul, ? uma pesquisa desenvolvida, cujo objetivo ? discutir a aplica??o efetiva dos princ?pios constitucionais inerentes ao Estado Democr?tico de Direito aos procedimentos investigat?rios, em especial ao Inqu?rito Policial. Esse debate ocorre, tendo em vista a previs?o legislativa do artigo 155 do C?digo de Processo Penal, que prev? a possibilidade de utiliza??o de elementos informativos constantes no Inqu?rito Policial, para fundamentar a decis?o condenat?ria, desde que n?o sejam utilizados de forma exclusiva. Nesse diapas?o, tem-se tamb?m a problem?tica dos vereditos oriundos do Tribunal do J?ri, no qual o jurado, pelo princ?pio da ?ntima convic??o, est? livre, para proferir decis?o com base em qualquer elemento, seja ele processual ou informativo, sem a necessidade de qualquer esp?cie de fundamenta??o. Tais decis?es, mascaradas no plano concreto, resultam em condena??es, baseadas exclusivamente em elementos inquisitoriais, colhidos sem a observ?ncia do contradit?rio, em uma clara afronta ?s garantias que s?o asseguradas ao indiv?duo pela Constitui??o Federal vigente.
