Previous issue date: 2010 / A reason that, for being so consummate, has no more room for the exercise of rational thought. A matter so alive and energized obliged to fit in the formulism and foreseen schemes of such racionality. The shock between the need of justice, that happens only in the urge of the instant, and the answer of the bureaucratic state, embodies in the law, that moves slowly through procedures, which, for the inadequacy of the given task, never seems fast enough to accomplish the impossible: to make quantity become quality, to turn law into justice. As key to interpret this fundamental philosophical matter, Theodor W. Adorno’s dialectic, moved by the respect to the difference, so that no events like Auschwitz happen again, with the expressionist ilustration of Franz Kafka, jurist that found in literature a way to spill all the anguish experienced for someone who hasn’t been numbed by the reason that is kept by small doses of violence. / Uma razão que, de tão completa, não tem mais espaço para o exercício da racionalidade. Uma questão tão viva e pulsante obrigada a se enquadrar nos formulismos e esquemas previstos por dita racionalidade. O choque entre a necessidade de justiça, que ocorre apenas na emergência do instante, e a resposta estatal burocratizada, encarnada no direito, que se arrasta por procedimentos, os quais, pela impropriedade da tarefa atribuída, nunca se mostram suficientemente rápidos para realizar o impossível: transformar quantidade em qualidade, transformar direito em justiça. Como chave interpretativa dessa questão filosófica fundamental, a dialética de Theodor W. Adorno, movida pelo respeito à diferença para que não se repitam eventos como Auschwitz, com a ilustração expressionista de Franz Kafka, jurista que encontrou na literatura uma forma de extravasar toda a angústia experimentada por quem não foi anestesiado pela razão que se conserva à base de pequenas doses de violência.
