O presente trabalho tem por objeto demonstrar de que forma a mediação e a
conciliação pré-processual podem contribuir para um acesso efetivo à Justiça no Estado do
Tocantins. O direito de acesso à Justiça é um direito social básico, garantido pelo artigo 5º,
inciso XXXV, da Constituição. Nas sociedades contemporâneas, os conflitos aumentaram não
somente em quantidade, mas em complexidade, sendo diversos os obstáculos enfrentados
pelo Judiciário, dificultando ou impedindo o acesso à Justiça. Várias soluções para esses
problemas foram buscadas, dentre as quais os meios alternativos de resolução de disputas,
incluindo-se aqui a conciliação, mediação e a arbitragem, os quais apresentam as seguintes
vantagens: custos baixos, celeridade, informalidade. Enfim, a mediação e a conciliação
formam novos paradigmas de resolução de controvérsias, na qual um terceiro imparcial e
independente procura, por meio da organização do diálogo entre as pessoas, ajudá-las a
restabelecer a relação social, a prevenir e a solucionar os litígios / The present research demonstrates the contribution mediation and pre-trail can bring
to the effective access to justice in the state of Tocantins. The Access to Justice is a basic
social right, guaranteed by Article 5, paragraph XXXV of the Constitution. In contemporary
societies, conflicts have increased not only in number but in complexity, with many obstacles
faced by the judicial system, hindering or restraining this right. Several solutions to these
problems were sought, among them, alternative ways for the resolution of legal disputes,
including conciliation, mediation and arbitration, which have the following advantages: low
costs, speed, informality. Finally, mediation and conciliation provides new dispute resolution
paradigms, in which an impartial and independent third party helps the disputants to restore
the social relationship, to prevent and to solve legal disputes on their own, by organizing the
dialogue between them.
