Previous issue date: 2017-11-24 / The present study deals with the sonship resulting from gestational surrogacy.
Alongside the origins of biological, socio-affective, and adoption kinship, which
establishes the sonship, a fourth origin is defended called parental autonomy. This
conclusion results from the interpretation based on the Constitution, especially from
the conjugation of the principles of the dignity of the human person, in the aspect of
autonomy, of the free family planning, and the inscribed rule in art. 226, ?? 7, of the
Constitution, that indicates that the parenting of children born through assisted
reproduction techniques, including gestational surrogacy, must be attributed to the
idealizers of the parental project. The contribution of this study is in the sense of
removing the socio-affective origin for the establishment of sonship in medically
assisted procreation, as defended by the great majority of doctrine, showing that the
origin of kinship based on parental autonomy is autonomous. This conclusion,
decisively, interferes in the solution of several problems related to the parenting of
these children, reducing the interference of moral and religious theories in the legal
environment. Resolution No. 2,168 / 2017, of the Conselho Federal de Medicina,
which deals with medical ethics on assisted reproduction, and Provision No. 63/2017
of the Conselho Nacional de Justi??a, which regulates the civil registry of children
born using these techniques, are discussed to show the correctness and mistakes of
these norms. It is necessary to create rules that establish sonship resulting from the
techniques of reproduction assisted by the Congresso Nacional to stabilize the
normative expectations of those who intend or have already used these techniques.
Regulating sonship is essential, but it is not enough. It is necessary to establish legal
rules for the protection of persons involved in the procedure, avoiding bad medical
practices, commercial exploitation and other legal problems, and punishing
professionals who do not follow them. The method used was juridic-sociological,
seeking to concretize the fundamental rights in question and to dialogue with other
disciplines to understand the problem in a wider social environment. / O presente estudo trata da filia????o decorrente da gesta????o por substitui????o. Ao lado
das origens de parentesco biol??gica, socioafetiva e de ado????o, que estabelecem a
filia????o, ?? defendida uma quarta origem denominada autonomia parental. Essa
conclus??o decorre da interpreta????o, ?? luz da Constitui????o, das normas que
estabelecem a filia????o no Direito brasileiro, especialmente a partir da conjuga????o
dos princ??pios da dignidade da pessoa humana, sob o aspecto da autonomia das
pessoas, do livre planejamento familiar e da regra insculpida no art. 226, ?? 7??, da
Constitui????o, que indica que a parentalidade das crian??as nascidas por meio das
t??cnicas de reprodu????o assistida, inclusive na gesta????o por substitui????o, deve ser
atribu??da aos idealizadores do projeto parental. A contribui????o desse estudo ?? no
sentindo de afastar a origem socioafetiva para estabelecimento da filia????o na
procria????o medicamente assistida, como ?? defendida pela maioria da doutrina,
demonstrando que a origem do parentesco fundada na autonomia parental ??
aut??noma. Essa conclus??o interfere, decisivamente, na solu????o de diversos
problemas relativos ?? parentalidade dessas crian??as, reduzindo a interfer??ncia de
teorias de ordem moral e religiosa no meio jur??dico. A Resolu????o n?? 2.168/2017, do
Conselho Federal de Medicina, que trata da deontologia m??dica sobre a reprodu????o
assistida, e o Provimento n?? 63/2017, do Conselho Nacional de Justi??a, que regula o
registro civil das crian??as nascidas por meio dessas t??cnicas, s??o discutidos para
mostrar os acertos e desacertos dessas normas. ?? necess??ria a cria????o de regras
sobre a filia????o decorrente das t??cnicas de reprodu????o assistida pelo Congresso
Nacional para estabiliza????o das expectativas normativas das pessoas que t??m a
inten????o ou j?? se utilizaram dessas t??cnicas. A regula????o da filia????o ?? essencial,
mas n??o basta. ?? preciso estabelecer regras legais para a prote????o das pessoas
envolvidas no procedimento, evitando-se m??s pr??ticas m??dicas, explora????o
comercial e outros problemas legais, e para punir os profissionais que n??o as
seguirem. O m??todo utilizado foi o jur??dico-sociol??gico, procurando concretizar os
direitos fundamentais em quest??o e dialogar com outras disciplinas para entender o
problema em um ambiente social mais amplo.
