Un conflit normatif caractérise aujourd’hui la relation entre le privilège parlementaire de la liberté de parole et le droit à la dignité et à la réputation des citoyens. Ce phénomène, qui a ressurgi récemment au Canada, n’est pas limité à notre espace géographique. En effet, certaines affaires portées devant la Cour européenne des droits de l’homme ont démontré que ce conflit pouvait être constaté dans certains pays européens. Face à ce constat, comment en arriver à une meilleure conciliation des droits fondamentaux, tout en préservant les prérogatives des assemblées législatives? À partir d’une approche de droit comparé, cette étude dégage du droit parlementaire et constitutionnel étranger des modes de résolution qui interviennent sur les différentes dimensions du conflit normatif identifié. / A normative conflict today characterizes the relationship between the parliamentary privilege of freedom of speech and the citizens’ right to the safeguard of their dignity and reputation. This phenomenon, which recently resurfaced in Canada, is not limited to our juridical system. Indeed, some cases before the European Court of Human Rights have shown that this conflict can be observed in some European countries. Given this situation, how to achieve a better balance between fundamental rights and the legislatures' prerogatives ? From a comparative law approach, this study tries to identify foreign parliamentary, constitutional and jurisdictional conflict resolution mechanisms that can be used to solve different facets of the identified normative conflict.
