El propósito de este artículo es determinar qué garantías debe entregar el proveedor
y la plataforma de metaverso frente a las infracciones al deber de idoneidad en la
adquisición de NFT’s dentro del Metaverso. Partiremos de las definiciones y
características que tienen los NFT’s y el Metaverso, así como, la forma de gobernanza
que presentan estos. Luego de ello, se presentará las problemáticas del deber de
idoneidad en cuanto a la adquisición de NFT’s en el metaverso. En este punto se
presentará 3 retos actuales que enfrentan los consumidores en la adquisición de estos
productos digitales. En base a los retos presentados en la adquisición de NFT's en el
metaverso, se propondrá el uso de garantías explicitas para asegurar el deber de
idoneidad en la adquisición de NFT’s en el metaverso. / The purpose of this article is to determine guarantees that providers and metaverse
platforms must provide against breaches of the duty of suitability in the acquisition of
NFTs. We will start from the definitions and characteristics of NFTs and the Metaverse,
as well as the form of governance that they present. After that, we will presented
problems of the duty of suitability regarding the acquisition of NFT's in the metaverse.
At this point, 3 current challenges faced by consumers in the acquisition of these digital
products will be presented. Based on the challenges presented in the acquisition of
NFT's in the metaverse, the use of explicit guarantees will be proposed to ensure the
duty of suitability in the acquisition of NFT's in the metaverse.
